(Engineer) made and entered into City Secretary Contract No. 30905 (the Contract) which was authorized by the City Council by M&C C-20373 on the 2nd day of November, 2004; and WHEREAS, the Contract involves engineering services for the following project: 2004 CIP Minor Channel Improvement Projects: Contract D— Miscellaneous Channel Improvements Drainage Project (Project No. 00096) WHEREAS, it has become necessary to execute Amendment No. 2 to said Contract to include an increased scope of work and revised maximum fee; NOW THEREFORE, City and Engineer, acting herein by and through their duly authorized representatives, enter into the following agreement, which amends the Contract: 1. Article I of the Contract is amended to include the additional engineering services specified in a proposal letter dated October 9, 2006, a copy of which is attached hereto and incorporated herein. The cost to City for the additional services to be performed by Engineer total $ 38,000. 2. Article II of the Contract is amended to provide for an increase in the maximum fee to be paid to Engineer for all work and services performed under the Contract, as amended, so that the total fee paid by the City for all work and services shall not exceed the sum of $160,590.00. 3. Page 1 of 2 City of Fort Worth, Texas Mayor and Council Communication COUNCIL ACTION: Approved on 11/28/2006 DATE: Tuesday, November 28, 2006 LOG NAME: 30AMEND2CONTD96 REFERENCE NO.: **C-21856 SUBJECT: Authorize Execution of Amendment No. 2 to Engineering Agreement with DeOtte, Inc., for the 2004 CIP Minor Channel Improvement Projects: Contract D— Miscellaneous Channel Improvements Drainage Project (Project No. 00096) RECOMMENDATION: It is recommended that the City Council authorize the City Manager to execute Amendment No. 2 to City Secretary Contract No. 30905 with DeOtte, Inc., in the amount of $38,000.00 to provide additional engineering services on the project, thereby increasing the contract amount to $160,590.00. DISCUSSION: On January 24, 2006, (M&C C-21264) City Council authorized Amendment No. 1 to the agreement in the amount of $27,000 for a change to the Fosdic Lake Spillway location in order to expand the desired study limits, which is required additional survey, geotechnical study, hydrologic and hydraulic modeling. On November 2, 2004, (M&C C-20373), the City Council authorized the City Manager to execute an agreement with DeOtte, Inc., in the amount of $ 95,590.00 for miscellaneous drainage improvements to Arrowood Channel, Mercado Channel, Cottonwood Creek and Fosdic Lake Spillway. Amendment No. 2 will address the following: A change in scope was made to Cottonwood Creek Channel to add gabion mats to the design and will require additional survey. DeOtte, Inc., Civil Engineering, proposes to perform the necessary work for a lump sum fee of $ 38,000.00. City staff considers this fee to be fair and reasonable for the scope of services proposed. In addition to the amendment amount, $1,919.00 is required for project management by the Engineering Department. This project is located in COUNCIL DISTRICTS 2, 4, 8 and 9, Mapsco 91G, 62L, 80D/81A and 64Z/65W.
