BACKGROUND
The Agreement with the State of Texas to provide a constituent seivice office to State
Representative Marc Veasey in Tech Fort Worth, the former gyinnasium on the James E. Guinn
School cainpus was not properly processed for attest by the City Secretary and for the issuance
of a Contract Number when the one (1) origi�ial was executed by Dale Fisseler, Assistant City
Manager and by the City Attoi7ley's Office, Assistant City Attoi�ley Cynthia Garcia. Tlus Lease
Agreeinent was approved by the Fort Worth City Council by M& C C-21917 on January 9,
2007. The Lease Agreement was executed with only one original that was sent bacic to the State
of Texas, House of Representatives and only a copy was kept for the City's official files.
AUTHORIZATION FOR CONTRACT NUMBER
Per the direction of Assistant City Attoiney Cynthia Garcia, the City Secretary's Office has been
requested to issue a contract number and place in the City of Fort Worth's official contract files
the attached "copy" of the Aimual Lease Agreement with the State of Texas to provide constituent
service office space to State Representative Marc Veasey in Tech Fort Worth, without the official
attest of the City Secretary due to the fact it is a copy and not the original document.
This request has been approved and a contract nuinber issued.

belonging thereto and usually had and enjoyed therewith, on the terms and condition contained herein.

/JU$ , 20 Q�_ but the Lessor understands and agrees that the Lessee may cancel this lease,
without penal , if funds for its continuation are not provided for the next fiscal period or if the Member for whose benefit this
lease is made ceases to be a Member of the House of Representatives.
II.
Lessee has the option to renew this lease for an additional period of /� �XQu�lil� forthe same monthly
rental and under the same conditions, covenants, and provisions applicable under this lease during the primary term. To
exercise the option, Lessee must give written notice of its election to do so to Lessor not later than 30 days before the expiration
of the primary term of the lease.
III.
As rental for the leased premises, Lessee will pay Lessor the sum of �����Q per month, which
shall be paid solely from the funds of the House of Representatives. However, the Lessor agrees that the liability of the House
of Representatives to pay the rental is limited to the amount of money in the Members operating account. If the Member's
account is depleted, the House of Representatives may immediately notify the Lessor in writing. Until further notice, neither
the House of Representatives nor the State of Texas is responsible for any rent that accrues after the date of the notice. The
Lessor may thereupon, terminate the lease or allow the Member to continue to occupy the leasehold on terms mutually
agreeable to the Lessor and the Member.
IV.
The leased premises will be used by the Member of the House of Representatives named herein as an office to be used
in connection with his official business as a State Representative.
V.
Although this lease is for the purpose of providing office space for the Member named in this instrument, no title, credits,
allowances, premiums, or anything of value shall inure to the benefit of the Member at any time because of this agreement.
(Under Art. III, Sec. 18, of the Texas Constitution, neither a legislator nor his firm may contract with the State of Texas if the
subject of the contract was authorized or funded by a legislature of which the individual was a member.) The Member named
in this lease is not related in the first degree by marriage, or through blood relationship, to anyone who has a financial interest,
either directly or indirectly, in the properry leased by the House of Representatives for this said Member. Any agreement
contrary to this paragraph renders the lease null and void and renders Lessor liable for the refund of all payments paid
hereunder together with interest on that at 10 percent per annum, reasonable attorney's fees for the collection of that amount,
and all costs incurred with said collection.
VI.
Either party may terminate this lease at any iime for failure of the other to comply with the covenants, conditions, and
provisions of the lease. Also, either party may terminate this lease by providing the other party a written notice 30 days prior
to date of termination.

The following additional covenants, and provisions are further agreed to by Lessor and Lessee:

or modifications of those terms are binding unless reduced to writing and signed by the parties to the lease.

I hereby state that I am not related in the first degree b�r marriage orthrough
blood relationship to anyone who has a financial interest either directly or

Chairman of the Committee on House Administration in writing and termi-

Enclosed please find the House of Representatives' district office contract with attachments. This
is the only contract that the Committee on House Administration will approve for district office
leases. In addition, no lease addendums to the lease contract can be approved.
When negotiating your lease, the term of the lease may not extend beyond the term of office of
the Representative (January 13, 2009). You or the landlord may cancel this lease for any reason
before the termination date, without penalties, with a thirty (30) days written notice.
Please complete the following:
(1) the lease form with the landlord's and the Representative's signatures;
(2) the property disclaimer form signed.� the Representative; and,
(3) the Application for Payee ID and�W-9 �orms with the landlord's signature for proper
identification in the State Comptrolle'r s Office.
The State Comptroller is offering property owners the opporturiity to have their monthly rent
payments direct deposited to a financial institution and to receive advance notification of this
direct deposit payment. If interested, please have the landlord complete the direct deposit
authorization form and the advance notification form. It takes approximately sixty (60) days
before the first check will be direct deposited to the financial institution.

RECOMMENDATION:
1) It is recommended that the City Council authorize the City Manager to enter into a lease agreement
with the State of Texas to provide a constituent service office to State Representative Marc Veasey in Tech
Fort Worth, the former gymnasium on the James E. Guinn School campus.
2) The lease shall be renewed annually unless terminated by the parties.
DISCUSSION:
Tech Fort Worth is located in the former gymnasium on the James E. Guinn School campus at I-35 South
and Rosedale. State Representative Marc Veasey represents the community surrounding the James E.
Guinn School campus, State District 95. The convenient location, accessible office space and abundant
free parking make the space appropriate for serving constituents.
The address of the leased property is 1120 South Freeway, Suite 121, Fort Worth, Texas 76104. The term
of the lease will be annually renewable, unless terminated by either party, beginning on January 1, 2007 at
the rate of $1.27/square feet per month ($555.00/month) or $15.24/square feet per year. This rental rate
may be increased, depending on current state guidelines.
The leased premises will be used by the Member of the House of Representatives as an office to be used in
connection with his official business as a State Representative.
The lease agreement is in the form required by the Committee on House Administration of the House of
Representatives of the State of Texas.
Tech Fort Worth is located in COUNCIL DISTRICT 8.
FISCAL INFORMATION/CERTIFICATION:
The Finance Director certifies that the Economic and Community Development Department will be
responsible for the collection and deposit of funds due the City under this agreement.
