WHEREAS, the City of Fort Worth (City) and TCB, Inc., formerly known
as Turner, Collie & Braden, Inc., (Engineer) made and entered into City
Secretary Contract No. 31833 (the Contract) which was authorized by the
City Council by M&C G20660; and
WHEREAS, the Contract involves engineering services for the following
project:
Pavement Reconstruction and Water and Sanitary Sewer
Replacement on Provine Street (Normandy Road to Edervifle Road),
Norma Street (North Hughes Avenue to North Edgewood Terrace),
Morris Court (Rand Street to East Dead End)
WHEREAS, it has become necessary to execute Amendment No. 1 to
said Contract to include an increased scope of work and revised maximum
fee;
NOW THEREFORE, City and Engineer, acting herein by and through
their duly authorized representatives, enter into the following agreement
which amends the Contract:
1.
Article I of the Contract is amended to include the additional
engineering services specified in proposal letters dated November 21, 2006
and December 5, 2006, copies of which are attached hereto and incorporated
herein. The cost to City for the additional services to be performed by
Engineer total $24,990.00.
2.
Article II of the Contract is amended to provide for an increase in the
maximum fee to be paid to Engineer for all work and services performed
under the Contract, as amended, so that the total fee paid by the City for all
work and services shall not exceed the sum of $147,212.40.

Supplemental Agreement No. 1(Revised) — Provine Street Alignment Revisions and
100-year Storm Drain Design
Dear Mr. Argomaniz:
As part of the above referenced project, TCB prepared plans and contract documents for Provine
Street from Ederville Road to Normandy Road. The existing configuration of Provine Street between
approximate Stations 10+50 and 12+50 has a sharp offset and does not meet City of Fort Worth or
AASHTO horizontal alignment criteria for any design speed. In the conceptual design report dated
August 3, 2005, TCB recommended a minor realignment of this portion of Provine Street. The
recommended realignment meets AASHTO design speed criteria for 15 mph, but requires additional
right-of-way to implement. The realignment was approved as part of the conceptual design and was
included into the final design plans, which were also approved. TCB prepared and submitted the right-
of-way taking documents, and we understand the City has acquired the necessary right-of-way. Bids
were received for this project on July 27, 2006, and as of the date of this letter the construction
contract has not been awarded.
Based on a meeting in the field on October 13, 2006 and a subsequent phone conversation on
October 25, 2006, it is our understanding that, due in large part to citizen input, the City of Fort Worth
is directing TCB to revise the plans to reflect the original horizontal alignment for this portion of Provine
Street. TCB will make the revisions as directed; however, these requested revisions neither reflect
TCB's recommendation for alignment of this roadway segment nor meet City of Fort Worth or
AASHTO criteria for horizontal alignment. As part of the revisions, TCB will add to the plans the
appropriate cautionary signage in accordance with the Texas Manual on Uniform Traffic Control
Devices (MUTCD). In addition, because the current design was previously approved by the City, we
feel the revisions are not included in our original scope of work. Therefore, TCB is requesting
additional compensation in the amount of $3,850 to make the plan revisions.
As part of the design, TCB recommended storm drain improvements along Provine Street. The
recommended improvements were included in the bid as an alternate. A meeting was held on
November 14, 2006 to discuss these improvements, specifically their inclusion into the project. The
minutes of this meeting are attached. As a result of that meeting, the City requested that TCB provide
a scope and fee to re-design the storm drain improvements along Provine Street to contain flows from
a 100-year event. In addition, TCB will provide a scope and fee to design an upgrade to the outfall
pipe from the sump in Provine Street to the outfall point at the City owned lake across Ederville Road.
This supplemental request addresses only the storm drain re-design along Provine Street and a
separate request will be made, if required, at a later date to address the outfall pipe.
To address the 100-year event, TCB will provide the following:
- Evaluate placement and locate inlets along Provine Street required to capture flows
generated from the 100-year event.
- Make the appropriate revisions to the hydraulic computations.

- Revise the storm drain plan and profile sheets to include the revised inlet placement and
upsized storm drain pipe as necessary.
- Evaluate and determine the required outfall pipe size. The design of the necessary
upgrade is not included in this scope.
TCB proposes to perform this scope of work for a lump sum fee of $7,640.
In conclusion, TCB is requesting $11,490 to make the revisions as discussed in this letter. A
breakdown of this fee is included in Attachment A. We will submit the revisions for your review within
2 weeks of our receiving the authorization to proceed.

The purpose of this meeting was to discuss the drainage improvements recommended as part of
the above referenced project, in particular, the improvements recommended along Provine Street.
Currently, the section of roadway between Ederville Road and Normandy Road contains one pair of
inlets located at a sump near mid-block. Based on the drainage calculations performed during
design, TCB recommended that additional inlets be installed along Provine on either side of the
sump. Because the required construction budget may not be available to include the additional
storm drain, and because no drainage issues have been reported in this area based on the City's
database, the City requested that the additional inlets and associated storm drain pipe be included
in the bid as an alternate. Bids have been received and the low bidder, Gilco Contracting, Inc.
submitted a bid for the drainage improvements along Provine of $74,461.60. Below is a discussion
of the elements of the meeting.
Argomaniz gave an overview and update of the project. Bids have been received, but have not yet
been awarded due to Water Department funding issues. The M&C was prepared without the
inclusion of the additional storm drain improvements at the request of TPW staff. Since the time of
the bid opening, Argomaniz and Jann attended an on-site meeting with several homeowners that
live along Provine. During this meeting, the residents noted that flooding issues were present
during most rain events, especially near the "S" curve and location of the sump.
Jann noted that based on the calculations, the roadway did not have the adequate capacity to carry
flows generated by a 5-year storm event in accordance with City of Fort Worth drainage cri�eria - �,

proposed 28-feet up to the existing 30-foot width would provide adequate capacity for the flows
thereby meeting the drainage criteria. Jann noted that this difference in capacity between the two
sections was negligible and would not address the drainage issue.
Based on COFW drainage criteria, the design would require the 100-year event to be contained
within the ROW. Due to the existing grades, Provine Street was designed with split curbs. Eubanks
noted that because the roadway utilized a split curb design the 100-year event flows would most
likely not be contained within the ROW. Further he noted that the inlets and storm drain pipe should
be designed to contain flows from a 100-year event.
Eubanks also questioned the capacity of the existing storm drain pipe connecting the existing sump
inlets to the outfall at the City owned lake across Ederville Road. Based on the total 100-year flows
calculated, it appears that this line would not have sufficient capacity to carry the flows once the
improvements along Provine are implemented.
Eubanks noted that his group is agreeable to provide funding for the storm drain improvements
along Provine Street in addition to an upgrade of the storm drain pipe from the sump to the outfall.
The re-designed storm drain improvements along Provine will be included in the construction of the
roadway. The upgrade of the storm drain line may be included in the construction of the roadway,
or based on the schedule, may be constructed as part of another project.
TCB will provide the City with a request for supplemental authorization to re-design the storm drain
improvements along Provine to contain the 100-year event. In addition, TCB will determine the
need for an upgrade to the existing outfall pipe. TCB will also provide a scope and fee to design the
upgrade to this line.

Supplemental Agreement No. 2— Storm Drain Outfall Replacement
Dear Mr. Argomaniz:
As part of the design of the above referenced project, TCB recommended storm drain improvements
along Provine Street. The recommended improvements were included in the bid as an alternate. A
meeting was held on November 14, 2006 to discuss these improvements, specifically their inclusion
into the project. The minutes of this meeting are included as Attachment A. As a result of that
meeting, the City requested that TCB provide a scope and fee to re-design the storm drain
improvements along Provine Street to contain flows from a 100-year event. This scope and fee were
provided in a previous request dated November 21, 2006. Also discussed in the review meeting was
the outfall pipe from Provine to the connection with the 54-inch line west of Ederville Road. This line
does not have adequate capacity to carry the 100-year flows from the proposed Provine Street storm
drain system. Preliminary calculations indicate that this line will require an upgrade from 24 inches up
to 36 inches. Below, as requested by the City, is a scope and fee to design an upgrade to this outfall
pipe.
For design of the outfall pipe, TCB will provide the following:
- Topographic survey from the sump inlet location on Provine Street along the existing
alignment up to the connection with the existing 54-inch line west of Ederville. In addition,
the upstream manhole and outfall of the 54-inch line will be located and flowline elevations
measured.
- Prepare preliminary and final design, including plan and profile sheet(s) and applicable
details. Plan and profile will be prepared at a scale of 1"=20' Horizontal and 1"=2' Vertical.
This scope of work includes one review meeting to discuss plan comments.
- Prepare plan quantities and assist City in preparation of change order or inclusion into
another construction project. It is assumed that these improvements will not be a
separate project, but will be combined with another on-going project.
- Prepare up to 2 permanent easements and 2 temporary construction easements. This
scope of work does not include assistance with easement acquisition.
TCB proposes to perform this scope of work for a lump sum fee of $13,500. A breakdown of this fee is
included in Attachment B. We will submit preliminary plans for your review within 4 weeks of our
receiving the authorization to proceed. Note that this scope of work only includes improvements up to
the 54-inch storm drain outfall pipe west of Ederville Road. Analysis of other areas of the drainage
basin or modifications to the 54-inch line or outfall is excluded from this scope.
