HomeMy WebLinkAboutContract 34886 (2)AMENDMENT NO. 2 STATE OF TEXAS § CITY SECRETARY CONTRACT NO.`'����� (No M&C Needed) COUNTY OF TARRANT § WI�REAS, the City of Fort Worth (City) and Carter & Burgess, Inc., Consultants (Engineer) made and entered into City Secretary Contract No. 30109 (the Contract) which was authorized by the City Council by M&C C-20071 on the l lth day of May, 2004; and WI�REAS, the Contract involves engineering services for the following project: Engineering Contract for Alliance Airport Runway Extension Project, Phase 4— Design of FM156, Railroad and Eagle Parkway. WI�REAS, it has become necessary to execute Amendment No. 2 to said Contract to delete the remaining scope of work and fee for the Rail Design; NOW THEREFORE, City and Engineer, acting herein by and through their duly authorized representatives, enter into the following agreement, which amends the Contract: 1. Article I of the Contract is amended to delete the engineering services specified in a proposal letter dated December 18, 2006, a copy of which is attached hereto and incorporated herein. The net cost to City for this amendment is a decrease of $744,265.00. 2. Article II of the Contract is amended to provide for a decrease in the ma�mum fee to be paid to Engineer for all work and services performed under the Contract, as amended, so that the total fee paid by the City for all work and services shall not exceed the sum of $2,114,319.66 (Amendment No. 2 Contract Amount). 3. The design of this portion of the project was put on hold after BNSF withdrew their support for the relocation of the mainline through the Intermodal Yard. There is $744,265 remaining in C&B's contract for design of the rail relocation. Carter & Burgess understands that the City of Fort Worth is facing a"short fall" in the funding of FM 156 Construction and has requested that any available FAA grant funds be re-programmed for the FM 156 project. Therefore, Carter & Burgess has prepared a contract modification to the Alliance Runway Extension Project — Phase IV that deletes the remaining scope of work and budget for rail design. The remaining budget associated with this task, $744,265.00 is hereby deducted from the contract amount. The revised contract amount is $2,114,319.66. All other provisions are unchanged and remain in full effect.
