FIRST AMENDMENT TO CITY SECRETARY
CONTRACT NO. 34252
THIS FIRST AMENDMENT ("Amendment") to City Secretary Contract No. 34252 ("Contract")
is entered into by and between the City of Fort Worth ("City"), a home -rule municipality in the State
of Texas, acting through Fernando Costa, its duly authorized Assistant City Manager, and Intercon
Environmental, Inc. ("Contractor"), by and through Karen Andrews, its duly authorized President.
WHEREAS, the City and Intercon Environmental, Inc. have entered into that certain agreement
identified as City Secretary Contract No. 34252 for the asbestos abatement and demolition of
structures located within Vickery Corridor in Fort Worth, Texas, in compliance with the terms of the
Contract;
WHEREAS, the original Contract not -to -exceed amount was established at $1,577,117.25;
WHEREAS, additional funds are necessary to complete the costs for demolition and disposal of
Parcel 51 and Parcel 61 of the Vickery Corridor;
WHEREAS, staff believes that Contractor has proposed a fair and reasonable fee for the additional
services in the amount of $264,037.54;
WHEREAS, on December 9, 2008, the City Council authorized this Amendment to the Contract to
increase the not -to -exceed amount from $1,577,177,25 to $1,843,163.59 to pay for the cost of the
additional services (M&C C-23230); and
WHEREAS, the parties agree that all other conditions and terms shall remain the same as stated in
City Secretary Contract No. 34252.
NOW, THEREFORE, for and in consideration of the mutual covenants contained herein, and other
good and valuable consideration, the receipt and sufficiency of which are hereby acknowledged and
confessed, the parties hereto agree as follows:

2. Miscellaneous. Nothing contained herein shall be deemed to amend or modify the
Contract, except as expressly set forth herein. Any defined term used herein, but not
defined herein, shall have that meaning set forth in the Contract.

Authorize Amendment No. 1 in the Amount of $264,037.54 to Contract No. 34252 with Intercon
Environmental, Inc., for Asbestos Abatement and Demolition of Structures for the Southwest Parkway
RECOMMENDATION:
It is recommended that the City Council authorize the City Manager to execute Amendment No. 1 to City
Secretary Contract No. 34252 with Intercon Environmental, Inc., for asbestos abatement and demolition
services of the identified structures located in the Vickery Corridor for right-of-way for the Southwest
Parkway project area in the amount of $264,037.54.
DISCUSSION:
The Capital Improvement Program included funds for the City's share of construction of the Southwest
Parkway project. The 2007 Critical Capital Program included additional funds for the project.
On October 17, 2006, (M&C C21776) the City Council authorized the City Manager to execute a contract
with Intercon Environmental, Inc., for $1,577,117.25. The contract was for asbestos abatement and
demolition of structures located within the Vickery Corridor (see attached map).
Amendment No. 1 to City Secretary Contract No. 34252 with Intercon Environmental, Inc., in the amount
of $246,393.71 provides asbestos abatement and demolition on remaining parcels within the
corridor. While most parcels came in at the anticipated costs, two key items contributed to this increase.
Parcel 61 had additional disposal costs that were not previously estimated. The disposal cost on this
parcel was approximately $100,00.00. Parcel 51 was not accessible when original estimates were being
prepared and a survey of asbestos containing materials was not available. The first estimate of
$200,000.00 was made without knowing actual quantities. After the quantities were determined the actual
cost for abatement will be $344,780.00, a difference of $144,780.00 more than previously estimated. This
parcel also required relocation of utilities located on a power pole near main building and
decommissioning of a large underground cistern located on the north side of the main building which
requires an additional $19,652.63.
These two parcels resulted in the total estimated contract amount increasing from $1,577,117.25 to
$1,843,163.59. The total increase is $264,037.54.
Intercon Environmental, Inc., is in compliance with the City's M/WBE Ordinance by committing to an
additional 15 percent M/WBE participation for this Amendment No. 1. The City's M/WBE goal on this
amendment is 15 percent.
The Vickery Corridor is located in COUNCIL DISTRICT 9.
