AGREEMENT TO RENEW HERBICIDE TREATMENT CONTRACT

As provided for in the above-referenced contract and based upon satisfactory
performance by your company in the first two years of the contract, this contract is
hereby renewed for the third and final year by mutual agreement of both parties,
using the same unit costs contained in the original contract.

Authorize Execution of Contract with Vegetation Management Specialist, Inc. for the 2005 Herbicide
Treatment Program (2005-1)
RECOMMENDATION:
It is recommended that the City Council authorize the City Manager to execute a contract with Vegetation
Management Specialist, Inc. in the amount of $66,184.18 for one year, commencing upon the date of
execution, with the option to renew for up to two additional one-year terms based upon satisfactory
performance for the 2005 Herbicide Treatment Program (2005-1).
DISCUSSION:
In the FY2004-2005 Contract Major Maintenance Program, various types of maintenance techniques are
grouped into specific contract packages. As part of the City's annual Major Maintenance Program,
herbicide treatment is used to control vegetation growth in drainage channels, around traffic signal
equipment and around parking meters in the downtown area. This program provides for the hand
application of herbicide along 47 miles of drainage channels, around traffic signal equipment at 223
intersections and around parking meters along 20 blocks in the downtown area. Herbicide is applied once
or twice yearly, depending upon field conditions, typically during the months of June and October.
The funding for this project was appropriated February 8, 2005 under M&C G-14677.
The City also reserves the right to increase or decrease quantities of individual pay items within the
contract, provided that the total contract amount remains within plus or minus 25% of the contract award.
This project was advertised on October 7 and 14, 2004. On December 2, 2004 the following bids were
received:

Vegetation Management Specialist, Inc. is in compliance with the City's M/WBE Ordinance by committing to
12% M/WBE participation. The City's goal on this project is 10%.
This project is located in ALL COUNCIL DISTRICTS.
FISCAL INFORMATION/CERTIFICATION:
The Finance Director certifies that funds are available in the current capital budget, as appropriated, of the
Contract Street Maintenance Fund.
