The parties to this Memorandum of Understanding (MOU) are the SafeHaven of Tar�ant County (hereafter known as "SafeHaven") located at 6815 Manhattan Blvd Suite 105 Fort Worth, Texas, 76120 and the City of Fort Worth (hereafter known as "City") located at 350 West Belknap Street, Fort Worth, TX, 76102. 2. AUTHORITY. This MOU facilitates SafeHaven's and the City's responsibilities under the U.S. Department of Justice, DOJ, Office on Violence Against Women, FY 2007, Grant to Encourage Ari•est Policies and Enforcement of Protection Orders Program ("Grant Program"). 3. PURPOSE. The purpose of this MOU is to enhance the worlcing relationship between the parties in order to facilitate effective implementation of the Grant Program funds, if awarded, in compliance with the DOJ Program. Once awarded, grant funds shall provide for the salary of one Spanish-spealcing attorney with immigration experience for a 24 month period. 4. RESPONSIBILITIES: A. SafeHaven: SafeHaven shall participate in a collaborative effort with the City in the grant application, administration, and implementation of the Grant Program tluoughout the life of the grant. 2. SafeHaven shall meet all requirements per�taining to administration, procurement, and reporting of the Grant Program 3. SafeHaven shall submit to the City monthly activity reports regardless of level of activity. In addition, the SafeHaven shall submit Grant Program updates and other reports requested by the City and DOJ in appropriate format and on a timely basis. The monthly Grant Program activity reports are due to the City no later than 15t�, calendar day of the month. 4. SafeHaven shall submit monthly Request for Reimbursement (RFR) with an original signature to Sasha Kane, Research & Planning Unit, Fort Worth Police Department, 350 West Bellcnap Street, Fort Worth, TX 76102. Payments shall be made within 30 days upon receipt of an acceptable and approved RFR and monthly Grant Program activity reports. 6. SafeHaven shall maintain financial, programmatic, and supporting documents, statistical records, and other records pertinent to claims submitted during the contract period for a minimum of five (5) years after the termination of the contract period, or for five (5) years after the end of the federal fiscal year in which services were provided. If any litigation, claim, or audit findings involving these records begins before the five (5) year period expires, SafeHaven will keep the records and documents for not less than iive years and until all litigation, claims, or audit findings are resolved. The case is considered resolved when a final order is issued in litigation, or a written agreement is entered into between the City, DOJ, and SafeHaven. This Section 4.A.6 shall survive the expiration or termination of this MOU. B. City of Fort Worth: 1. The City is the grant recipient of the Grant Program and agrees to participate in a collaborative manner with the SafeHaven tluoughout the life of the grant. 2. When the Grant Program grant is awarded, the City shall facilitate and manage the Grant Program throughout the life of the grant as required by the grant. 3. The Fort Worth Police Department, Research and Planning Unit, will oversee the administration, procurement, and reporting for SafeHaven's grant funded activities and will act as the Fiscal Agent for the Grant to Encourage Arrest Policies and Enforcement of Protection Orders Pi•ogram funds. 4. The City shall pay SafeHaven an amount not to exceed $$155,080.00 from available funds grant funds for approved Grant Program services and expenses rendered in accordance with the terms of this MOU upon receipt of a proper and verified billing statement with accompanying documentation. The reimbursement made to the SafeHaven shall not exceed actual costs to provide the Grant Program services under this MOU and actual costs, both direct and indirect, must be reasonable and allowable according to the Office of Management and Budget (OMB) Circulars A-122 and 1- 110. 5. Email address: s asha lcane @foi-tworthgov. org. 6. ENTIRETY OF AGREEMENT. This MOU, consisting of four pages, represents the entire and integrated agreement between the parties and supersedes all prior discussions and negotiations, representations and agreements, whether written or oral as related specifically to the Grant Program. 7. IMMUNITY. The City and its governing body does not waive its sovereign immunity by entering by entering into this MOU, and retains all immunities and defenses provided by law with respect to any action based on or occuning as a result of this MOU. 8. LIABILITY. By executing this MOU, each entity agrees to work together to on the Grant Program. However, the entities are not legally "partners" to the extent that the term encompasses joint and several liabilities. Each legal entity under this MOU is responsible for its own employees, representatives, agent and subcontractors. 9. OTHER PROVISIONS. Nothing in this MOU is intended to conflict with current law or regulation or the directives of SafeHaven or the City. If a term of this MOU is inconsistent with such authority, then that term shall be invalid, but the remaining terms and conditions of this MOU shall remain in full force and effect. 10. EFFECTIVE DATE. The terms of this MOU will become .effective on the date it is signed by both parties. This MOU is terminated immediately if Grant Program funds are not awarded or if this MOU is not approved by City's governing body. 11. MODIFICATION. This MOU may be modified upon the mutual written consent of the parties. 12. TERMINATION. This MOU will remain in effect until expiration of the grant period and/or submission of the final report to the Grant Program, or whichever is later, unless one of the parties requests to terminate or change the MOU with 60 days notice by either party. Authorize the City Manager to apply for and accept, if awarded, the FY 2007 Grant to Encourage Arrest Policies and Enforcement of Protection Orders Program from the U.S. Department of Justice (DOJ), Office of Violence Against Women (OVV1n in the amount of $750,000.00; 2. Approve an Agreement to have the City of Fort Worth serve as the cognizant fiscal agency on the grant for SafeHaven of Tarrant County; and 3. Adopt the attached appropriation ordinance increasing estimated receipts and appropriations in the Grants Fund by $750,000.00, subject to receipt of the grant. DISCUSSION: The City of Fort Worth, in a collaborative effort with the SafeHaven of Tarrant County, is requesting funds to implement a multi-approach plan designed to provide additional personnel to hold offenders accountable for their actions through investigation, arrest and prosecution of domestic violence offenders. The City of Fort Worth will use OVW grant funding to hire three additional officers in the Police Department Fugitive Unit. These officers will immediately follow-up and enforce Emergency Protect Orders (EPOs). Grant funds of $414,960 are budgeted for three officers salaries, $109,964 for fringe benefits and $57,500 for necessary overtime during the 24 month grant period. Also $1,960 is budgeted for additional computer equipment to be utilized by these grant funded officers and $10,536 in travel for OVW grant required training. In 2006, 1,245 EPOs were issued. Under this funding, officers will visit the victim's residence to verify that the offender has not returned, and if so, make an immediate arrest. In addition, these officers will serve arrest warrants for penal violations as a result of domestic violence. Under the OVW grant funding, Safe Haven of Tarrant County will hire a bilingual attorney with immigration experience to deal with an increasing number of Spanish speaking clients and many with immigration issues.
