AMENDMENT NO. 1 TO THE INTERLOCAL AGREEMENT BETWEEN THE CITY OF FORT WORTH AND THE CITY OF SANSOM PARK FOR RECONSTRUCTION AND MAINTENANCE OF BEVERLY HILLS DRIVE FROM JACKSBORO HIGHWAY TO McCANDLESS AVENUE AND McCANDLESS AVENUE FROM BEVERLY HILLS DRIVE TO 23RD STREET This Agreement is entered into by and between the City of Sansom Park , acting by and through Robert Armstrong, its duly authorized Mayor, hereinafter referred to as Sansom Park, and the City of Fort Worth, acting by and through Marc Ott, its duly authorized Assistant City Manager, hereinafter referred to as Fort Worth, both of Tarrant County, State of Texas. WHEREAS, Sansom Park and Fort Worth entered into Fort Worth City Contract No. 34388, authorized by Fort Worth City Council on October 11, 2005 via M&C No. C- 21075 and executed by Sansom Park on December 13, 2006 (the "Agreement"); and WHEREAS, the Agreement is an Interlocal Agreement for the Reconstruction and Maintenance of Beverly Hills Drive From Jacksboro Highway to McCandless Avenue and McCandless Avenue from Beverly Hills Drive to 23�d Street; and WHEREAS, costs increased by $30,000 between the authorization and execution dates of the Agreement; and costs; WHEREAS, Sansom Park and Fort Worth shall equally share the increased NOW THEREFORE, Sansom Park and Fort Worth agree to amend the Agreement as follows: Section 2 of the Agreement shall be amended to be and read: 2. Costs. Fort Worth and Sansom Park reasonably believe that the total cost of the necessary materials, survey, and engineering for the Project will not exceed $90,000.00. The materials cost is estimated at $82,000.00. Fort Worth and Sansom Park shall each pay fifty percent (50%) of the materials cost. The estimated cost of the survey and engineering is $8,000.00. Fort Worth and Sansom Park shall each pay fifty percent (50%) of the survey and engineering costs. Within thirty (30) days of the execution of this Agreement, Sansom Park shall deposit with Fort Worth, $45,000.00 for its share of the total estimated costs of the Project. Fort Worth will not issue County the Notice to Proceed until Fort Worth receives the deposit from Sansom Park. If the actual costs of the materials, survey, and engineering services exceed the estimated costs, Fort Worth and Sansom Park shall each pay 50% of the actual costs. If the actual costs of the materials, survey, and engineering services are less than the estimated costs, Fort Worth shall refund Sansom Park its proportionate share of the savings. Authorize the City Manager to execute Amendment No.1 to the Interlocal Agreement with the City of Sansom Park, wherein Sansom Park is responsible to deposit with the City of Fort Worth 50 percent of the total cost of engineering, surveying materials and other incidentals for the reconstruction of Beverly Hills Drive from Jacksboro Highway to McCandless Avenue and McCandless Avenue from Beverly Hills Drive to 23rd Street in the City of Fort Worth and the City of Sansom Park. Amendment No. 1 will increase the total estimated cost by $30,000 for a total not to exceed $90,000 ($82,000 for materials, plus $8,000 for engineering and surveying); and 2. Authorize additional funds to be paid under an authorized but not executed Interlocal Agreement with Tarrant County for the reconstruction of Beverly Hills Drive from Jacksboro Highway to McCandless Avenue and McCandless Avenue from Beverly Hills Drive to 23rd Street in the City of Fort Worth and the City of Sansom Park to increase the City's participation by $30,000 for a total not to exceed $90,000. DISCUSSION: On October 11, 2005 (M&C C-21075), the Fort Worth City Council approved Interlocal Agreements with the City of Sansom Park and Tarrant County. The estimated total project cost for materials, engineering and surveying was $60,000. Due to delays by the City of Sansom Park in negotiating boundary adjustments between Fort Worth and Sansom Park and other issues, the project was not implemented. Consequently, the material prices have increased resulting in the need to amend these interlocal agreements. Under the terms of the County agreement, Tarrant County will provide all necessary labor and equipment to perform the work and Fort Worth will, at its sole option, deliver all the materials necessary for the construction of the roads to Tarrant County, or pay for the material provided by Tarrant County. Also under the County agreement, Fort Worth will provide the plan specifications and engineering drawings for the project. Under the agreement with Sansom Park, the two cities will equally share the cost of engineering, surveying, materials, and other incidentals necessary to complete the project. Sansom Park is required to deposit its half of the estimated project costs ($45,000) with Fort Worth before the work begins. Additionally, the City of Fort Worth and the City of Sansom Park agree to take the necessary steps to Logname: 20BEV HILLS (2) Page 1 of 2 close the road to through traffic for the duration of the project or as deemed necessary by Tarrant County. This project is located in COUNCIL DISTRICT 2.
