HomeMy WebLinkAboutResolution 3975-03-2011RESOLUTION NO. 3975-03-2011 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS AUTHORIZING THE CITY ENGINEER TO SUBMIT A GRANT APPLICATION TO THE TEXAS WATER DEVELOPMENT BOARD (TWDB) FOR GRANT FUNDS TO ADDRESS FLOOD PROTECTION PLANNING WITHIN THE UPPER BASIN OF MARY'S CREEK WATERSHED; SUPPORTING THE CITY'S APPLICATION TO THE TWDB FOR MATCHING GRANT FOR STORM WATER PLANNING; AND AUTHORIZING THE MAYOR TO EXECUTE A CONTRACT WITH THE TWDB. WHEREAS, the City of Fort Worth is authorized to apply for a grant from the Texas Water Development Board (TWDB), and WHEREAS, the City of Fort Worth meets the official entity requirements of the TWDB for grant application through the City's legal authority to plan for and abate flooding and its participation in the National Flood Insurance Program, and WHEREAS, the City Council desires that the City Engineer submit a grant application to the TWDB for grant funds to address flood protection within the MSC -2 Watershed, and WHEREAS, the City Council has the authority to enter into a contract with the TWDB and is prepared to commit matching funds in cash and /or in -kind services once the grant application is accepted, and WHEREAS, the grant program requires a 50150 local and TWDB participation split, and the recommended budget is $197,900.00 with $98,950.00 contribution from the TWDB and $98,950.00 from the City of Fort Worth, and WHEREAS, the commitment of these funds or services is in the best interest of the health and safety of the Citizens of the City of Fort Worth, NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: That the City Council hereby adopts and approves the recitals and findings set forth in the preamble above. 2. That the City Council hereby passes this resolution authorizing the City Floodplain Administrator to submit this grant application to the TWDB for grant funds to address flood protection within the MSC -2 Watershed. RESOLUTION NO. 3975-03-2011 3. That the City Council agrees to commit a maximum of $98,950.00 for the purpose of this program. That the City Council hereby authorizes the Mayor to enter into and sign a contract with the TWDB for grant funds to address flood protection planning within the MSC -2 Watershed. 5. This Resolution is contingent upon the preparation and submission of an application by the City of Fort Worth to the TWDB for fifty percent (50 %) grant funding from the TWDB and upon approval and commitment of the TWDB to grant said funds. 91 It is hereby found and determined that the meeting at which this Resolution was adopted was open to the public as required by law and that notice of the time, place, and purpose of said meeting was given as required by Chapter 551, Texas Government Code. Adopt the attached Resolution authorizing application for and, if offered, acceptance of, a one year grant from the Texas Water Development Board in an amount not to exceed $98,950.00; 2. Adopt the attached supplemental appropriation ordinance increasing the appropriations in the Stormwater Utility Fund in the amount of $98,950.00 and decreasing the unaudited, unreserved, undesignated Stormwater Utility Fund balance by the same amount; 3. Authorize the transfer of $98,950.00 as required for the one - hundred percent match to the total amount of the grant ($98,950.00) from the Stormwater Utility Fund to the Grants Fund; and 4. Adopt the attached appropriation ordinance increasing estimated receipts and appropriations in the Grants Fund by $197,900.00 subject to the receipt of the funds. DISCUSSION: The Texas Water Development Board offers Flood Protection Planning grants for the evaluation of structural and nonstructural solutions to flooding problems within a watershed. The goal of the Flood Protection Planning Grant is to plan for and implement flood protection measures that reduce or eliminate flooding. The proposed study area must be regional in nature by inclusion of the entire watershed and must consider the upstream and /or downstream impacts of flood protection measures. The money from this grant will be used to perform a detailed study of stream MSC -2, a tributary to Marys Creek located on the west side of Fort Worth. The scope of work will include a detailed study to determine the extent of existing problems resulting from or relating to flooding, identification of potential solutions, estimating the benefits and costs of the potential solutions and development of a flood mitigation plan for properties and roadways that are subject to flooding. It is anticipated to cost $197,900.00 for a qualified engineer to perform this study based on the size of the watershed. The project is located in COUNCIL DISTRICTS 3 and 7. Upon approval, the unaudited, available cash balance in the Stormwater Utility Fund will be above the minimum reserve required by the City's Financial Management Policy Statements.
