HomeMy WebLinkAboutContract 34264AMENDMENT NO.1 STATE OF TEXAS § CITY SECRETARY CONTRACT NO.,3U04 COUNTY OF TARRANT WHEREAS, the City of Fort Worth, a municipal corporation situated in Tarrant County, Texas hereinafter called "City" and Camp Dresser & McKee Inc., here after called "Engineer" made and entered into City Secretary Contract No. 28008 (the Contract) which was authorized by the City Council by M&C C-19179 on the 301h day of July, 2002. WHEREAS, the Contract involves engineering services for the following project: Construction Management of the Village Creek Wastewater Treatment Plant High Rate Clarification Project Project Number P172-070172301030 WHEREAS, it has become necessary to execute Amendment No. 1 to said Contract to include an increased scope of work and revised maximum fee; NOW THEREFORE, City and Engineer, acting herein by and through their duly authorized representatives, enter into the following agreement, which amends the Contract: 1. Article I, of the Contract is amended to include the additional engineering services specified in a proposal letter dated August 2, 2006, copies of which are both attached hereto and incorporated herein. The cost to City for the additional services to be performed by Engineer total $ 293,572. 2. Article II of the Contract is amended to provide for an increase in the maximum fee to be paid to the Engineer for all work done and services performed under the Contract, as amended, so that the total fee paid by the City for all work and services shall not exceed the sum of $2,100,703.00. 3. The scope of services for the amendment has been revised to reflect this request and this document presents the final scope of work. The scope of services in this document is presented as basic services, additional services and future special services. Construction management services for the Village Creek Trinity River Siphon Project shall be provided under a separate document. The HRC construction management services schedule was extended by six months and additional services have been provided by CDM that have impacted the scope and schedule for the project and have increased the associated engineering costs beyond the original contract upper limit. On October 4, 2006 we requested an amendment to our contract to cover these costs. The following is a brief description of the schedule revisions and additional services. Additionally, we have provided a proposed fee for future special services to assist the City during standard warranty periods, extended HRC operator training and process performance testing for the City to consider under a separate contract. Attached is a task and hour schedule for the amendment broken down into basic services and additional services and separate schedule for special services. Contract Amendment consulting - engineering - construction -operations Mrs. Madelene Rafalko August 2, 2006 Page 2 Basic services under this amendment cover the extension of project tasks authorized by the original contract dated September 26, 2002. Additional services are tasks that were performed during the course of the project that were identified as additional services in the original contract and have been authorized by the City. The total requested amendment amount for basic and additional services is $193,206. Special services are those services that may be necessary beyond the completion of the construction of the HRC Improvements, but are not authorized until CDM is given additional written approval by the City. The total fee for future special services is $100,366. Basic Services The schedule for construction management services for the HRC Project outlined in the original contract was to be completed in April 2005. The associated fee covers construction management services for a total of 28 months. The actual construction schedule was extended to October 15, 2005, a total of 34 months. This amendment covers the project costs incurred from May 1, 2005 to October 15, 2005. The fee for these services is $132,654. Each task is identified in the attached fee breakdown schedule. Additional Services Additional services are those services not included in the basic services of the original contract which have been provided by CDM, following authorization by the City of Fort Worth. The fee for these services is $60,552. A brief description of each task is detailed below and the hours associated with each task are identified in the attached fee breakdown schedule. EPA Grant Assistance CDM provided assistance to the City for the EPA grant application process by preparing supporting documents for the grant application, providing data for details of the application, and attending meetings with the EPA and City. CDM tracked the amount of time spent for these services in our project budget and provided the amount on each monthly invoice. Odor Control Redesign and Bar Screen Building 3 Odor Control Evaluation Additional services provided by CDM during the construction of the HRC Project included assistance to the City with odor control coordination and re -design of the odor control ductwork system at the Headworks Facility to coordinate with the new biofilter south of the facility. Additionally, the City requested CDM to evaluate the existing odor control system at Bar Screen Building #3 (BS Bldg #3) and recommend improvements to the odor control system when the west side of BS Bldg #3 work was completed. However, final construction drawings were not provided and the recommended improvements were not constructed due to deleting the west side scope of work from the construction contract. Operator Training CDM provided additional operator training beyond assistance during startup, testing and manufacturer's training activities on the headworks facility, HRC facility, and GBT facility. These services included preparing standard operating procedures for each facility and conducting operating training on each facility for each plant operations shift. Third Party Inspection for Plasti-Fab Stop Logs The Plasti-Fab stop logs provided under the HRC Improvements Project had defects due to fabrication and/or storage and handling abuse. The City authorized CDM to hire a fiberglass structural engineering company to provide a third party inspection of the stop logs which included general observation of the stop log condition, assistance in identifying any previously undiscovered defects, observing in -process repair work, and preparation of an inspection report. Special Services Special services are those services not identified in the basic services or additional services of the original contract but have been discussed for CDM to provide after construction is completed with the written authorization from the City of Fort Worth. The total for the special services as defined below and identified in the attached fee breakdown schedule is $100,366. These services should be considered as a separate contract and include field assistance during the standard 24-month warranty period, quarterly HRC operator training, and HRC process performance testing. Extended 24-month Standard Warranty Period The original contract included basic services for a 12-month warranty period. However, the standard warranty period was extended to 24-months during the bidding phase. A fee has been provided for assistance during the additional 12-month warranty period. Quarterly HRC Operator Training Assistance The construction contract requires the HRC equipment supplier to provide quarterly operator training for the first year after final acceptance of the equipment. CDM has provided a proposed fee for field assistance during this training period. Assistance During HRC Performance Testing A process performance test is required for the HRC Improvements Project and requires performance testing to occur during the first three years or no longer than 3 consecutive storm events that meet the testing criteria requirements. CDM has provided a proposed fee for field assistance and preparation for the performance testing. TOTAL $ 3,768 3.8 Page 1 of 2 City of Fort Worth, Texas Mayor and Council Communication COUNCIL ACTION: Approved on 9/19/2006 DATE: Tuesday, September 19, 2006 LOG NAME: 60VC HIGH RATE REFERENCE NO.: **C-21698 SUBJECT: Authorize Execution of Amendment No. 1 to the Engineering Agreement with Camp Dresser & McKee, Inc., for Construction Management of the Village Creek Wastewater Treatment Plant High Rate Clarification Project RECOMMENDATION: It is recommended that the City Council authorize the City Manager to execute Amendment No. 1 with Camp Dresser & McKee, Inc., City Secretary Contract No. 28008, for the construction management of the Village Creek VVVVTP High Flow Treatment Facilities, increasing the total contract cost by $293,572.00 from $1,807,131.00 to $2,100,703.00. DISCUSSION: On July 30, 2002, (M&C C-19179) the City Council authorized the execution of an engineering agreement with Camp Dresser & McKee, Inc. for construction management of the Village Creek VVWTP High Rate Clarification (HRC) Project. This contract included an on -site construction management team, full time inspection, project management/administration and review of contractor submittals. Proposed Amendment No. 1 is to compensate Camp Dresser & McKee, Inc. for additional construction management services and for additional services. The construction time was extended six months by approved change orders requiring additional project administration and inspection. This was due primarily to modifications requested by plant staff, existing conditions differing from plans and quantity overruns. Additional services include assistance in making the application for EPA grant funding, an evaluation of the existing odor control system at Bar Screen Building No. 3, operator training beyond the contract startup provisions, and third party factory inspection of Plasti-Fab stop logs. In addition, the HRC construction contract provided a three year performance test period for occurrence of three significant rain events that would necessitate the start up and use of the High Rate Clarification system and allow the required performance testing. The Plant Staff has requested additional special services to provide additional training of plant operations staff and to assist the City in performance testing of the new high rate clarifier, when the required rain events occur. Camp Dresser & McKee, Inc. is in compliance with the City's M/WBE Ordinance by committing to an additional 7% M/WBE participation on this Amendment No. 1. The City's goal on this amendment is 5%.
