AN ORDINANCE INCREASING THE ESTIMATED RECEIPTS AND APPROPRIATIONS
IN THE 2007 CRITICAL CAPITAL PROJECTS FUND IN THE AMOUNT OF $50,000.00
FROM THE DISTRIBUTION OF AVAILABLE FUNDS IN THE TAX INCREMENT FUND
OF TAX INCREMENT REINVESTMENT ZONE NUMBER FOUR (SOUTHSIDE TIF), FOR
THE DESIGN AND CONSTRUCTION OF THE PUBLIC PLAZA IN ASSOCIATION WITH
FIRE STATION NUMBER 5; PROVIDING FOR A SEVERABILITY CLAUSE; MAKING
THIS ORDINANCE CUMULATIVE OF PRIOR ORDINANCES; REPEALING ALL
ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING AN EFFECTIVE DATE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS:
SECTION 1.
That in addition to those amounts allocated to the various City departments for Fiscal Year 2010 -2011 in the
Budget of the City Manager, there shall also be increased estimated receipts and appropriations in the 2007
Critical Capital Projects Fund in the amount of $50,000.00 from the distribution of available funds in the Tax
Increment Fund of Tax Increment Reinvestment Zone Number Four (Southside TIF) for the design and
construction of the Public Plaza in association with Fire Station Number 5.
SECTION 2.
That should any portion, section or part of a section of this ordinance be declared invalid, inoperative or void
for any reason by a court of competent jurisdiction, such decision, opinion or judgment shall in no way
impair the remaining portions, sections, or parts of sections of this ordinance, which said remaining
provisions shall be and remain in full force and effect.
SECTION 3.
That this ordinance shall be cumulative of Ordinance No.19355 and all other ordinances and appropriations
amending the same except in those instances where the provisions of this ordinance are in direct conflict
with such other ordinances and appropriations, in which instance said conflicting provisions of said prior
ordinances and appropriations are hereby expressly repealed.
SECTION 4.
This ordinance shall take effect upon adoption.

and Authorize a Contract Change Order in the Amount Not to Exceed $39,750.00 with Imperial
Construction, Inc., and Adopt Appropriation Ordinance (COUNCIL DISTRICT 8)
RECOMMENDATION:
It is recommended that the City Council:
1. Authorize the distribution of $50,000.00 from the Tax Increment Fund of Tax Increment Reinvestment
Zone Number Four, Southside TIF for the design and construction of the Public Plaza in association with
Fire Station No. 5;
2. Adopt the attached appropriation ordinance increasing estimated receipts and appropriation in the 2007
Critical Capital Projects Fund by $50,000.00 from the distribution of available funds in the Tax Increment
Fund of the Southside TIF; and
3. Authorize a change order in the amount not to exceed $39,750.00 with Imperial Construction, Inc., for
the construction of the Public Plaza.
DISCUSSION:
Fire Station No. 5 was identified for replacement in the 2007 Critical Capital Needs requirement. The
existing fire station, located on Evans Avenue just north of Rosedale Street, is in the midst of the overall
development plan of the Evans and Rosedale Business and Cultural District. The replacement Station
(New Fire Station No. 5) is located just south of this District.
In association with the replacement Station, the Arts Council of Fort Worth and Tarrant County proposed a
plaza with mosaic artwork depicting the neighborhood's history. The proposed plaza would be between
the location for the replacement Station and Evans Avenue. The board of directors of the Southside TIF
has consented to the distribution of $50,000.00 from the tax increment fund of the Southside TIF to pay
costs associated with the design and construction of the Public Plaza.
The Public Plaza design will be executed with an amendment to the RPGA Design Group, Inc., agreement
and with a change order to the Imperial Construction, Inc., construction contract.
The TIF portion of $50,000.00 is expected to be utilized as follows:

On June 8, 2010, M &C C -24256 authorized the execution of the construction contract in the amount of
$2,413,807.00 with Imperial Construction, Inc., to construct replacement Fire Station No. 5 located at 850
Irma Street.
On July 10, 2007, M &C C -22224 authorized the execution of a professional services agreement in the
amoung to $121,555.00 plus $6,600.00 for reimbursable expenses with RPGA Design Group, Inc., for the
design of replacement Fire Station No. 5.
This project is located in COUNCIL DISTRICT 8.
FISCAL INFORMATION / CERTIFICATION:
The Financial Management Services Director certifies that upon approval of the above recommendations,
funds will be available in the current capital budget, as appropriated, of the 2007 Critical Capital Projects
Fund.
