COMIVIUNITY FACILITIES AGREEMENT

WHEREAS, the said Developer I�as requested the Ciiy o£Fort Worth, a inunicipal
corporaiion of Tarrai�i, Denton azid Wise Counties, Texas, hez�einaf�er called "City", to do
certain work in connection with said iznprovezne�ts.
NOW, THEREFORE, KNOW ALL BY THESE PRESENTS:
For and in eonsideration of tl�e covez�ants and conditzons contained harein, the City a�xd
the Developer do hereby agree as follows:
I. General Requirements
A. The Policy for the Installation of Caxnmunity Facilities ("Pol'zc�')
dated March 2001, approved by the Ciiy Council of the City of Fort
Woxth and subseque�rtly amended, is hereby incorparated u�to this
Co�nmunity Facilities Agreement as if copied hereiil verbatixn.
Developer agrees to comply with all provisions of said Policy ii� the
performance af its duties and obl'zgations hereunder.
$. The requirements of the k'olicy sI1a11 govern tl�is Community Facilities
Agreeznent, provided, however, thai any conflzct between the tern�s of
this Comnnunxty Facilities Agz-eement and ihe Policy shall be resolved

Developer s11a11 provide financial security in conformance with
paxagraph 6, Section II, o�the Policy.
Developer ack�lowledges that tk�ere shall be no reduction iz2 tl�e amouni
of fina��.cial security priox to project completion and acceptance by the

The Develaper sl�all a�ard all contraets for the canstructiozi of
comznunity facilities in accordaa�ce with Section II, paragraph 7 of the
Policy.

does hereby, fiilly indemnzfy, hoici haz-mless and defend the Cif�, its
officers, agen�s and en�ployees froin all suits, actions or clazrns of azzy
character, whether real or asserted, brougl�.t for or on account af any
ix�.juries or damages sustained by aarzy persoz�s (including death) oz� to
azry �roperty, resulting from or in coni�ectian with the const�-uction,
design, pezfonnance or completion of axzy work to Ue perfortned by
said Developer, his cont�aetors, subconfractors, officers, age�its or
eznployees, or in consequence o.f any failure to properly safeguard the
work, or on account of aary aet, intentiona� or otkzexwise, neglect or
znisconduct o£ sazd DEVELO�'ER, his contractors, sub�contraciors,
officers, agents or etnployees, wlzetlier or• not sucla ifr.rr�cr•ies, deatY: or

the City o�'Fo�i Wot•i1i, its oi�cers, servarits, or ettauloyees.
H. Developer shall install or adjust all of the required utilities to serve the
development or to construct the improveinenis reqt�ired herein.
I, rn the event that City participaiiori exceeds $ZS,000, Developer�' agrees
that no street construction or siorm drainage will begin prior to Ciiy
Couticil approval of this Community Facilities Agree�nent. (A.rticle
104_ 1.00, Ordinance 7234}.
r. Developer agrees tl�at no lot shall be occu�zed under a certi�Zcate of
occugai�cy ui�til the improveuiezlts required herein have been
constructed (Artiele 104.100, Ordinance 7234}.
K. Developer hereby releases and agrees to i�idemr�ify and hold the Ci#y
l�arm.less far any inadequacies in the preliminary plans, specifications
and cost estimates supplied by t�e Developez• for this cozrtract.
L. Developer agrees io provide, at its expense, all necessary rights of way
and easerrzents across property owned by Developer reqaixed to

Drain (B-1) Attached; Street Lights azzd Signs (C) Noi�e.
N. City shall not be res�onsible for any easis tliat inay be iz�currecl by
Developer in the relocaiion of a��y utilities that are ox n�ay be �in
eonflict witli an.y of tlie commui�ity faciliiies to be installed hereunder.
Street and Stoz�n Drain Facilities
A. The Developer(s) agree to install or to cause to have installed, tkie street,
storm drainage, street lighting, streei naine sign and otb.er conu��unity
facilities iznprovemezits shown as "current izx�pxovemenis" on the attached
Exl�ibits B, B 1; and C.
B. As shown below in tkte "Sumn�ary of Cost for Street and Storm Drain
Facilities", the Developer shail fiu�d its share of "current in�provements"
and shall pay ta the City for its sk�axe of the cost of street, storm d��ainage,
street lighiing, street name signs as showza on the aitached Exhibits B, B1,
and C. The estimated total cost of currei�i improvements and related
support se�wices specified in this agreement, including design,
constructzon and inspeciion is estimated to $954.00.
