WHEREAS, the City of Fort Worth (City) and Teague Nall and Perkins,
Inc., (Engineer) made and entered into City Secretary Contract No. 34074
(the Contract) which was authorized by the City Council by M&C C-21711 on
the 26th day of September 2006; and
WHEREAS, the Contract involves engineering services for the following
project:
Pavement Reconstruction and Water and Sanitary Sewer
Replacement on Canton Drive (Meadowbrook Blvd. to Craig St.),
Church Street (Louise St. to Handley Dr.), Halbert Street (Craig St. to
Routt St.) and Van Natta Lane (Muse St. to Janice Ln.), 2004 CIP
Contract 48, Project No. 00450, DOE No. 5409
WHEREAS, it has become necessary to execute Amendment No. 2 to
said Contract to include a net decreased scope of work and revised maximum
fee;
NOW THEREFORE, City and Engineer, acting herein by and through
their duly authorized representatives, enter into the following agreement
which amends the Contract:
1.
Article I of the Contract is amended to include the revised scope in
engineering services specified in a proposal letter dated May 16, 2007, a
copy of which is attached hereto and incorporated herein. The reduction in
cost to City for the revised scope of services to be performed by Engineer
total $32,110.00.
2.
Article II of the Contract is amended to provide for a reduction in the
maximum fee to be paid to Engineer for all work and services performed
under the Contract, as amended, so that the total fee paid by the City for all
work and services shall not exceed the sum of $285,035.00.

Dear Mr. Argomaniz:
Teague Nall and Perkins, Inc. is submitting this fee Amendment to the above referenced contract
based on additional services requested. The following is a brief description and cost for the
additional services provided on this project:
Additional Services to prepare Right-of-Way Documents
After obtaining survey results and evaluating pavement section alternatives, it is apparent
that additional right-of-way and temporary construction easements are required for a portion
of Church Street from Louise to Haynie. Based on discussions with City staff, we will
acquire right-of-way to allow a 24' Limited Local section. The fees are based on the
attached proposal along with 10% for MWBE administration.

Additional Services for Geotechnical Analysis and Report

Amendment No. 1 to the above referenced project did not include the fee for administering
a sub-consultant contract. Attached is the cover letter for that amendment explaining the
services to be provided. This line item includes the difference between the requested
amount and the amount authorized (RE: City Secretary No. 34882).

Fee Reduction for Removing 48-inch Water Line from Contract

During the course of design and City review of the project, the Water Department decided
to remove the replacement of the 48-inch Water Line from this project. To dete�mine the
applicable reduction in fee, we adjusted the construction cost projection to reflecf a project ' �����'�: - �

that does not include replacing the line. The result is a decrease in construction cost from
$3,920,000 to $2,670,000. The gross reduction in design fee (using the fee curves) is
$76,350. At this point in the project we have completed 40% of the effort allocated to the
water line design. Therefore, we have adjusted the gross fee reduction by 60%. The
following provides a net re�+uction in design fee for removing the 48" water line from this
contract.
■ Gross Fee Reduction x 60% = Net Fee Reduction —� $ 76,350 x 0.60 =($ 45,810)
