This delay impacted the project beginning on February 11, 2015 until the issuance of approved plans on May 26, 2015. The net result is 75 days of additional cost to the project due to absence of approved plans and TxDOT instructions not to work on the scope of work until the TCP was resolved. Haydon is requesting the following compensation: • Compensation for added construction cost, due to inefficiencies (equipment cost have been corrected for previous delay claim). • Compensation for fees paid by Haydon for TCP at Chevron (according to correspondence chain, engineer of record was dealing with all traffic pattern issues) • Compensation for 2 additional mobilizations to milling subcontractor, due to changes in plans. As shown on the "Work Impact Zones Exhibit" there was not a continual path of lime treating on the project while waiting for the "Traffic Control Plan Revisions" dated 5/22/2015. Since this piece of equipment can only be used for lime treating, it was idle much of the time Haydon was waiting on direction. Ends of Pipes &Conduits: Pipes and conduits were unable to be finished since Haydon did not know what the slope catch point would be to determine where the end of pipe would be. This is all contingent on the designer submitting the "Traffic Control Revisions" that show the added roadway width, which identifies the toe of slope location to give the end of pipe location. Euless Blvd Euless,TX 76040 RE: Project Status Update 0902-48-539 Texas Department of Transportation ("TxDOT") The City of Fort Worth ("Fort Worth") Freese and Nichols Inc.(Freese and Nichols") Aguirre& Fields LP("Aguirre&Fields") Oncor("Oncor") Atmos Energy("Atmos") Tarrant County Precinct Line at Walker Branch (the"Project") Haydon Building Corp ("Haydon") HBC#: OC-0902-48-539-1065-0010-029 Dear Mr. Tran: Thank you for your response in the letter dated March 23,2015.The purpose of this letter is to update you on several matters that Haydon has encountered during construction of the Precinct Line Road at Walker Branch Project and to serve as a response to your letter dated March 23, 2015. You may notice that the status of some of these items have changed since our latest update, while others may not.While Haydon, TxDOT, Fort Worth, and the design teams continue to diligently partner to find acceptable solutions to each matter, it is important that we keep you regularly informed of the impact these items have on the Project Schedule. Lhoist Water Utilities- TxDOT requested a proposal from Haydon on February 13, 2015. Haydon contacted a licensed plumber, investigated the scope of work, and provided a proposal to TxDOT on 3-18-15. To date Haydon has not received a directive authorizing work to begin. At the partnering meeting held on April 2, 2015, TxDOT stated the directive would be given on April 3, 2015. At the time this directive is received, Haydon will schedule the subcontractor to perform this work as quickly as possible. Haydon continues to resequence work operations in order to mitigate delays to the project. The issue is encompassed within Delay Claim #2—ROW/Fence Relocation Issues. Haydon will submit the cost associated with this delay once the full extent of the delay is known. This is incorrect. November 19,2015 is in fact the date Haydon submitted the RFI to TxDOT. Haydon received a response to RFI#45 from Freese and Nichols on February 19, 2015. TxDOT issued a written directive to Haydon on March 2, 2015. This work will be completed per the CPM schedule in Phase 2 of Precinct Line Rd in accordance with the response provided by TxDOT per TxDOT specifications for item 508-2002 Construction Detours. Haydon has requested that TxDOT or Fort Worth make contact with the property owner to ensure the work can be completed without delay. Overhead Utility Relocation- Overhead utility relocation operations are still incomplete. No update has been given to Haydon since the last correspondence. Haydon continues to resequence operations in order to mitigate delays to the project. This delay will continue to delay final completion until it is resolved. Once the extent of this delay is known, Haydon will submit a time and cost impact analysis for your approval. AT&T Distribution Line Conflict- On November 20, 2014 Haydon encountered an AT&T Distribution Line in conflict with System A Storm Drain and earthwork operations south of Trinity Blvd. This was immediately brought to TxDOT's attention and was also addressed in RFI#48—AT&T Communication Line Conflict. On March 20, 2015, Haydon received an email from Kevin Bruton with the City of Fort Worth stating that AT&T was"100%complete with this project. Storm Drain System A Water Service Conflict- Haydon completed water service relocation on February 13, 2015. Fort Worth Sanitary Sewer Manhole and Water Sampling Station near Sta.38+49- Haydon relocated the sampling station on February 18, 2015. TxDOT issued an official change order for this work on March 26, 2015. Haydon returned the signed change order to TxDOT on April 2, 2015. This work will begin as soon as material is fabricated. After further communication with TxDOT, Haydon will survey two other Fort Worth manholes to determine the required adjustments, and submit a proposal on all remaining manhole adjustments on the project. This will encompass both Hurst and Fort Worth municipalities. Verizon/MCI Box- On January 13, 2015, the utility contractor performed the adjustment to the Verizon/MCI Box. Embankment Protection Near 66+00- On February 19, 2015, Haydon received the response to RFI#55 from Freese and Nichols. Haydon will construct the detour as directed as soon as overhead Utility Relocation Operations have been completed. Please see above for details associated with the Utility Relocation Operations Delay. Atmos Gas Line- Atmos completed the relocation of this line on January 30,2015. Trinity Paving Widths- Your letter states that RFI#56—Phase 2 Trinity TCP was submitted on February 11,2015. This is correct. However, your letter also states that Haydon received a written directive on February 19, 2015. This is incorrect. Haydon did not receive written directive from TxDOT until March 2, 2015. It was on February 19, 2015 that TxDOT received the response from the Engineer of Record. Haydon requested direction from TxDOT again on March 2,2015 at which time the direction was received by TxDOT. At this point, Haydon began analysis of the response. Haydon held field meetings with TxDOT to discuss the RFI response. Haydon also built electronic drawings and calculated actual quantities for the minimum detour necessary. Due to the vast differences in quantities between Haydon's calculations and TxDOT's directive, Haydon submitted its findings for approval on March 16, 2015. Haydon was instructed on March 31, 2015 not to perform any work on the detours until a revised response was issued from the Engineer of Record. Haydon received a revised directive on April 1, 2015. Haydon will communicate with TxDOT to determine the best method for performing this work in a safe manner and will proceed as directed. Precinct Line Paving Widths- Haydon notified TxDOT in the February 18, 2015 weekly meeting of an issue with available roadway width on Precinct Line. There is not enough room available outside of existing traffic to construct Phase 1 roadway per plan. Haydon again requested directive in project meetings on March 18, 2015 Haydon submitted RFI#62—Phase 1 Precinct Line Road TCP on March 23, 2015. Haydon met with Freese and Nichols along with TxDOT in field to discuss the RFI on March 27, 2015. Haydon requested an update on the RFI on March 30, 2015. Haydon received a written directive on April 2,2015. Haydon will communicate with TxDOT to determine the best method for performing this work in a safe manner and will proceed immediately. Haydon greatly appreciates TxDOT taking the time to hold an additional partnering meeting on April 2, 2015 and the partnering efforts of all involved in the resolution and/or progress of any or all of the above mentioned conflicts. Authorize payment of these change orders to Texas Department of Transportation in the amount of$476,647.08 under Local Transportation Project Advance Funding Agreements for the projects (City Secretary Contract No. 44743), and revising the total City contribution to $4,071,258.21 (City Project Nos. 00105 and 00147). ' DISCUSSION: The 2004 Bond Program provided funding for improvements to widen Precinct Line Road from two- lanes to four-lanes from State Highway 10 to Concho Trail including a new four lane bridge over Walker Branch and intersection improvements at Trinity Boulevard. This project includes reconstructed travel lanes, left and right turn lanes, storm drain improvements, sidewalks, railroad crossing, bridge and traffic signal improvements. Under these change orders, TxDOT's contractor, Haydon Building Corp, will be compensated for temporary pavement quantity overruns, and delay claims resulting from franchise utility conflicts and constructability issues with the design plans. These claims consist of 3 months of additional barricades, signs, and traffic handling, water service, material price escalations, and standby equipment costs. These items affected the critical construction path and prevented the contractor from continuing construction in an efficient manner. TxDOT and the contractor engaged in a mediation process to arrive at a settlement for the expenses associated with these unanticipated delays. An additional 90 working days will be added to the contract. Staff considers the cost for this change order to be fair and reasonable for the proposed roadway construction. Previous M&Cs approved by City Council for the Walker Branch Bridge Project (City Project No. 00105): C-20868, 7/26/05; C-26154, 3/19/13; and C-27891, 8/30/16, and administratively approved change orders for this project authorized total payments to TxDOT in the amount of $626,403.47. This change order will authorize payment to TxDOT in the amount of$424,578.94 for Change Order Nos. 38, and 47 - 51. Previous M&Cs approved by City Council for the Precinct Line Road Project (City Project No. 00147): C-26154, 3/19/13; and C-27830, 8/2/16, and administratively approved change orders for this project authorized total payments to TxDOT in the amount of$2,898,207.66. The Water Department also paid TxDOT the amount $70,000.00 for Change Order No. 12 (M&C C-28093, 1/31/17). This change order will authorize payment to TxDOT in the amount of$52,068.14 for Change Order Nos. 43, 45, and 46. The total payment to TxDOT for both projects is $476,647.08 and increases the City contribution to $4,071,258.21. The overall City project budget is $4,296,974.05 for Precinct Line Road (City Project No. 00147) and $1,292,000.45 for the Walker Branch Bridge (City Project No. 00105). The total project budget is $17,357,207.50 and includes federal participation of$7,249,075.00, state participation of $1,790,158.00, and Tarrant County participation of$2,729,000.00. The completion of this project will have no significant impact on the general fund operating budget. Construction was substantially complete in July 2017. Funding for these change orders is being provided from the 2004 Capital Improvement Program. The project is in COUNCIL DISTRICT 5.
