AN ORDINANCE INCREASING THE ESTIMATED RECEIPTS AND APPROPRIATIONS
IN THE SEWER CAPITAL PROJECTS FUND IN THE AMOUNT OF $147,390.00, FROM
AVAILABLE FUNDS, FOR THE PURPOSE OF FUNDING CLEAR FORK DRAINAGE
BASIN SANITARY SEWER REHABILITATION AND IMPROVEMENTS, PART 4;
PROVIDING FOR A SEVERABILITY CLAUSE; MAKING THIS ORDINANCE
CUMULATIVE OF PRIOR ORDINANCES; REPEALING ALL ORDINANCES IN
CONFLICT HEREWITH; AND PROVIDING AN EFFECTIVE DATE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS:
SECTION 1.
That in addition to those amounts allocated to the various City departments for Fiscal Year 2010 -2011 in the
Budget of the City Manager, there shall also be increased estimated receipts and appropriations in the
Sewer Capital Projects Fund in the amount of $147,390.00, from available funds, for the purpose of funding
Clear Fork Drainage Basin Sanitary Sewer Rehabilitation and Improvements, Part 4.
SECTION 2.
That should any portion, section or part of a section of this ordinance be declared invalid, inoperative or void
for any reason by a court of competent jurisdiction, such decision, opinion or judgment shall in no way
impair the remaining portions, sections, or parts of sections of this ordinance, which said remaining
provisions shall be and remain in full force and effect.
SECTION 3.
That this ordinance shall be cumulative of Ordinance No.19355 and all other ordinances and appropriations
amending the same except in those instances where the provisions of this ordinance are in direct conflict
with such other ordinances and appropriations, in which instance said conflicting provisions of said prior
ordinances and appropriations are hereby expressly repealed.
SECTION 4.
This ordinance shall take effect upon adoption.

Authorize Execution of Change Order No. 3 in the Amount of $147,390.00 for a Total Contract Amount of
$1,582,689.00 to City Secretary Contract No. 41075 with Conatser Construction TX, LP, for Clear Fork
Drainage Basin Sanitary Sewer Rehabilitation and Improvements, Part 4, on Wilmington Drive and Rowan
Drive and Adopt Appropriation Ordinance (COUNCIL DISTRICT 3)
RECOMMENDATION:
It is recommended that the City Manager:
1. Authorize the transfer of $147,390.00 from the Sewer Operating Fund to the Sewer Capital Projects
Fund;
2. Adopt the attached appropriation ordinance increasing estimated receipts and appropriations in the
Sewer Capital Projects Fund by the amount of $147,390.00 from available funds; and
3. Authorize the City Manager to execute Change Order No. 3 in the amount of $147,390.00 to City
Secretary Contract No. 41075 with Conatser Construction TX, LP, for Clear Fork Drainage Basin Sanitary
Sewer Rehabilitation and Improvements, Part 4, thereby increasing the contract amount to $1,582,689.00.
DISCUSSION:
On November 9, 2010, (M &C C- 24584) the City Council authorized the City Manager to execute a
contract in the amount of $1,386,783.00 with Conatser Construction TX, LP, for Clear Fork Drainage
Basin Sanitary Sewer Rehabilitation and Improvements, Part 4. The contract was subsequently revised by
two change orders totaling $48,516.00 that are further described as follows:
Change Order No. 1, in the amount of $24,341.00 and administratively approved by the City Manager on
February 28, 2011, provided for the removal of a segment of a conflicting 72 -inch storm drain pipe.
Change Order No. 2, in the amount of $24,175.00 and administratively approved by the City Manager on
March 10, 2011, provided for the installation of additional curb and gutter on the project.
Change Order No. 3 will provide increased and additional pay item quantities for the following:
• 4 -inch two way sanitary sewer service clean outs that were miscalculated at the time the project was
advertised for bid, concrete pavement and irrigation system repairs within an apartment complex
across which a project sanitary sewer main was installed.
• The rehabilitation of another project sewer main by trenchless pipe enlargement method in lieu of a
cured in place pipe method as originally proposed, due to the severely deteriorated condition of the
existing pipe.

M/WBE — Conatser Construction TX, LP, is in compliance with the City's M/WBE Ordinance by committing
to an additional 14 percent M/WBE participation on this Change Order No. 3. The City's goal on this
change order is 13 percent.
This project is located in COUNCIL DISTRICT 3.
FISCAL INFORMATION / CERTIFICATION:
The Financial Management Services Director certifies that funds are available in the current operating
budget, as appropriated, in the Water and Sewer Fund and upon approval of the attached appropriation
ordinance, funds will be available in the current capital budget as appropriated, of the Sewer Capital
Projects Fund.
