HomeMy WebLinkAboutOrdinance 19791-07-2011Ordinance No.19791 -07 -2011 AN ORDINANCE INCREASING THE ESTIMATED RECEIPTS AND APPROPRIATIONS IN THE RENTAL REHABILITATION PROGRAM FUND IN THE AMOUNT OF $200,000.00, FROM PROGRAM INCOME FUNDS AVAILABLE, FOR THE PURPOSE OF REPAYING THE DEPARTMENT OF HOUSING AND URBAN DEVELOPMENT FOR CANCELLED PROJECTS FROM THE HOME INVESTMENT PARTNERSHIP PROGRAM; PROVIDING FOR A SEVERABILITY CLAUSE; MAKING THIS ORDINANCE CUMULATIVE OF PRIOR ORDINANCES; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. That in addition to those amounts allocated to the various City departments for Fiscal Year 2010 -2011 in the Budget of the City Manager, there shall also be increased estimated receipts and appropriations in the Rental Rehabilitation Program Fund in the amount of $200,000.00, from program income funds available, for the purpose of repaying the Department of Housing and Urban Development for cancelled projects from the Home Investment Partnership Program. SECTION 2. That should any portion, section or part of a section of this ordinance be declared invalid, inoperative or void for any reason by a court of competent jurisdiction, such decision, opinion or judgment shall in no way impair the remaining portions, sections, or parts of sections of this ordinance, which said remaining provisions shall be and remain in full force and effect. SECTION 3. That this ordinance shall be cumulative of Ordinance No.19355 and all other ordinances and appropriations amending the same except in those instances where the provisions of this ordinance are in direct conflict with such other ordinances and appropriations, in which instance said conflicting provisions of said prior ordinances and appropriations are hereby expressly repealed. SECTION 4. This ordinance shall take effect upon adoption. Authorize the payment of up to $200,000.00 from the Rental Rehabilitation Program Fund to the United States Department of Housing and Urban Development to close findings regarding the use of Home Investment Partnerships Program grant funds; and 2. Adopt the attached appropriation ordinance increasing estimated receipts and appropriations in the Rental Rehabilitation Program Fund by $200,000.00 from program income currently available in the fund. DISCUSSION: The City has received HOME Investment Partnerships Program (HOME) grant funds from the United States Department of Housing and Urban Development (HUD) to rehabilitate or build new single or multifamily residential units for low to moderate income individuals or families. In March of this year, the City received an inquiry from HUD regarding 29 HOME - funded projects that had not had any activity for more than 120 days. HUD required that these projects, which were funded from 2002 to 2007, be completed and reported closed to HUD within 30 days. Staff requested additional time to investigate and complete the projects. Staff has completed and closed 10 of the projects and continues to work to complete and close the remainder. However, because of lack of documentation that meets HOME program requirements, staff recommends that City Council authorize repayment to HUD of up to $200,000.00 from Rental Rehabilitation Program Funds Program income for any project that cannot be closed in compliance with HUD regulation. FISCAL INFORMATION / CERTIFICATION: The Financial Management Services Director certifies that upon approval of the above recommendations and adoption of the attached appropriation ordinance, funds will be available in the Rental Rehabilitation Program Fund.
