DSHS is allowed to extend this availability to local governmental entities and state agencies ("Eligible Applicants") on the terms and conditions below. This participation must be evidenced and effectuated by the execution of this binding contract with DSHS. Eligible Applicants and DSHS are the parties to this contract. • Purchase must be made by the Eligible Applicant only. Separate purchases by different branches of the same local government will not be allowed. The prices given below are firm, non-negotiable prices. , • The Antivirals may be used only for the purposes allowed.by the CDC..At,this time the CDC has limited the use of the antivirals purchased through this contract to treatment of pandemic flu only. Antivirals cannot be released for usage until a pandemic influenza-specific public health emergency is declared by federal and/or state officials. Management, storage, and distribution are the sole responsibility of the Eligible Applicant. • This contract must be signed and returned to DSHS no later than December 15, 2006 for the subsidized purchase price at 75% of the contract price for Tamiflu� ($14.43 per course) and Relenza� ($16.26 per treatment course). The actual order will be placed after payment is received. • Eligible Applicant may place orders by sending the payment in full to the attention of the Community Preparedness Section of DSHS at 1100 W. 49`h St., Austin, TX 78756-3199. • The delivery of the antivirals will be made directly by the manufacturer to the Eligible Applicants at one site only. DSHS bears no responsibility for shipping costs. • The timing of the delivery is dependent upon the manufacturers' schedules and capacities and is beyond the control of DSHS. • Within two days of receipt of the antivirals from the manufacturer, Eligible Applicant must complete the packing lisf that comes with the order and send the packing list, by mail or fax, (preferably fax 512-458-7489) to the Phannacy Branch, DSHS so that it can be compared against the original order. • Should the order received be missing any product the local entity. must immediately contact the Pharmacy Branch at 512-458-7500 and ask to speak with the Pharmacy Branch manager or his designee to provide the details. • In the event cumulative orders made by DSHS and eligible applicants exceeds 2,320,701courses (the Texas limit for subsidized purchase), DSHS shall fill orders f,: , : �l:;r��L�l�,:� ;.�:�:,.,�.,� v�� l' Js�:;'��'�l�!�! f1%,, � " I � �.:� J ��( f � ��� !';'i''i 'ii,�J?i I � �� %1'•.: � ': �✓'1 U'� l: � �- � . �:_. _..... .,._ .. . on a first come, first served basis. Those who place an order by payment on the earliest date will have priority over those who submit the payment at a later date. DSHS may at its option, 1) submit multiple purchase orders upon receipt of payment for the antivirals from selected Eligible Applicants, or; 2) submit a single order in December 2007 after payment has been received from all Eligible Applicants. Payments for which DSHS cannot supply the product ordered shall be refunded by DSHS as quickly as practical. Please indicate, by filling in the blanks the amount of antivirals you will purchase. Please note that a course of Tamiflu� consists of 10 capsules, 75mg each, per bottle. A course of Relenza� consists of 20 powder blister packages per unit. The antivirals may be stored at room temperature away from sunlight and moisture and have a shelf life of approximately five (5) years. Within federal Department of Health and Human Service requirements these medications may not be used except in a declared pandemic and may not be rotated with other stocks of antivirals. Local entities have control over how and for whom these antivirals will be used. These guidelines do not apply to antivirals that are part of the Strategic National Stockpile or to state purchases, which may use different storage and distribution mechanisms. They also do not apply to any medications that are purchased independently from the manufacturers or other distributors. A longer, more comprehensive draft of Pandemic Influenza Plan Operating Guidelines regarding usage is currently under review and will soon be made available to you. Antiviral Storage: • Identify storage space for the antivirals ordered. o Space should be secure at all times. o Space should meet temperature guidelines for the medications (see attachment A) and should have a backup power plan to maintain temperature in case of an interruption. o Space should be large enough for the quantity ordered (attachment A) o Space must be available for at least 5 years, the entire shelf life of the product, with a plan for immediately finding an alternative should that space become unsuitable or unavailable. o Space must be ready for storage by the time the order arrives. o The shipping address may be different from that of the storage site, so the contractor should be prepazed to move the antivirals quickly into the appropriate storage space. Receive order. o One month prior to delivery time specified in the executed contract, DSHS verifies payment and works with contractor if not complete. o When payment has been verified, DSHS confirms the shipping address and contact person and completes the ordering process. o The drug company drop-ships the antiviral to the contractor at their designated address. Only one shipping address allowed per order. o Upon receipt, the contractor verifies the order, faxes a copy of the packing list/receiving report to the DSHS and Pharmacy Branch at 512-458-7489. The contractor should request the Pharmacy Branch to assist with any necessary adjustments if there are discrepancies. Ph. 512/458-7500 Ext. 2676 Guidelines for Antiviral Storage, Allocation and Distribution February 2007 Antiviral Allocation and Distribution: Develop a plan for antiviral usage and allocation in the event of a pandemic. Among other elements, the plan should address: • For whom the local antivirals are intended. • Employees and others who already have private insurance/medical home and who can obtain antivirals in that way rather using the stockpile medications. � Use of the local cache of antivirals wlien other antivirals (SNS, state purchases) may be available; which stock is used first and for whom. • Who decides when use of local antivirals is triggered. • How the antivirals are distributed locally. Include a backup provision to implement if those transportation/distribution resources become unavailable. • How extra security will be provided for storage and for distribution if needed during the pandemic. • How the plan will be exercised. Review and adjust plan as needed periodically, but at least annually. Approve appropriation of Metropolitan Medical Response System (MMRS) and Urban Area Security Initiative (UASI) funds in the amount of $51,435 (3,000 courses of Tamiflu @$14.43 per course and 500 courses of Relenza @$16.29 per course); and 2. Authorize the City Manager to execute a contract with the Texas Department of State Health Services (DSHS) for the purchase of 3,000 courses of Tamiflu (Oseltamivir phosphate) and 500 courses of Relenza (Zanamivir) to be used to treat first responders and other key City of Fort Worth personnel such as health care workers in the event of Pandemic Influenza. DISCUSSION: The Centers for Disease Control and Prevention (CDC) is encouraging state and local governments to stockpile additional antiviral medications for treatment of a pandemic should it break out within their jurisdictions. At this time, there is no eminent threat of a pandemic influenza breaking out in the City of Fort Worth or Tarrant County. The CDC is providing states and local governments an opportunity to the antivirals using the federal contract which includes a 75 percent federal subsidy. The stockpile will raise our preparedness level to ensure continuity of essential services should the threat of a pandemic exist. Precedents have been set by the Austin-Travis district Health Department as well as the Dallas County Commissioners Court authorizing the purchase of antivirals to treat first responders in the event of an outbreak to assure that essential services would continue. The number of courses cited in this recommendation is based on precedent by regional and state municipalities and discussions with the Fort Worth Emergency Management Office and the Fort Worth Homeland Security Planning Team. The recommendation of 3,500 total courses provides coverage for all Police and Fire personnel and allows for additional courses for other City of Fort Worth personnel such as health care workers. Although Tamiflu is primarily indicated in the event of Pandemic Influenza, guidance by the CDC recommends the purchase of a smaller inventory of Relenza to ensure medications are available if administration of Tamiflu is contra-indicated. While the number of courses in this recommendation is specifically intended to ensure the services of first responders and public health workers, it is recognized that additional medications will be made available for the broader community in the event of a Pandemic Logname: 02RX CACHE Page 1 of 2 from local inventories and state/federal assets, including the Strategic National Stockpile (SNS) and the Vendor Managed Inventory (VMI).
