HomeMy WebLinkAboutOrdinance 19793-07-2011Ordinance No.19793 -07 -2011 AN ORDINANCE INCREASING THE ESTIMATED RECEIPTS AND APPROPRIATIONS IN THE SPECIAL ASSESSMENTS FUND IN THE AMOUNT OF $384,149.80 FROM AVAILABLE FUNDS, FOR THE PURPOSE OF TRANSFERRING SAID FUNDS TO THE NEW DEVELOPMENT FUND FOR THE DESIGN AND CONSTRUCTION OF ROADWAY, SIDEWALK, STORM DRAINAGE AND STREET LIGHT IMPROVEMENTS ON OLD DENTON ROAD; PROVIDING FOR A SEVERABILITY CLAUSE; MAKING THIS ORDINANCE CUMULATIVE OF PRIOR ORDINANCES; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. That in addition to those amounts allocated to the various City departments for Fiscal Year 2010 -2011 in the Budget of the City Manager, there shall also be increased estimated receipts and appropriations in the Special Assessments Fund in the amount of $384,149.80 from available funds, for the purpose of transferring said funds to the New Development fund for the design and construction of roadway, sidewalk, storm drainage and street light improvements on Old Denton Road. SECTION 2. That should any portion, section or part of a section of this ordinance be declared invalid, inoperative or void for any reason by a court of competent jurisdiction, such decision, opinion or judgment shall in no way impair the remaining portions, sections, or parts of sections of this ordinance, which said remaining provisions shall be and remain in full force and effect. SECTION 3. That this ordinance shall be cumulative of Ordinance No.19355 and all other ordinances and appropriations amending the same except in those instances where the provisions of this ordinance are in direct conflict with such other ordinances and appropriations, in which instance said conflicting provisions of said prior ordinances and appropriations are hereby expressly repealed. Adopt the attached appropriation ordinance increasing the estimated receipts and appropriations of the Special Assessments Fund in the amount of $384,149.80; 2. Authorize the transfer of $384,149.80 from the Special Assessments Fund to the New Development Fund; 3. Adopt the attached appropriation ordinance increasing the estimated receipts and appropriations of the New Development Fund in the amount of $384,149.80; 4. Authorize the City Manager to execute Amendment No. 1 to City Secretary Contract No. 39257, a Community Facilities Agreement with Keller Independent School District, the Developer, to allow the City of Fort Worth participate in the amount of $473,362.11 for the design and construction of approximately 520 linear feet of Old Denton Road and an additional 2,500 linear feet of sidewalk to provide connectivity to Timberview Middle School; and 5. Upon approval by the Keller ISD Board, authorize payment to Keller ISD in the amount of $473,362.11 for the design and construction of roadway, sidewalk, storm drainage and street light improvements on Old Denton Road. DISCUSSION: On October 6, 2009, the Keller Independent School District executed a Community Facilities Agreement, City Contract No. 39257 for community facilities to serve its new Timberview Middle School located on Old Denton Road. Old Denton Road is identified as a future four -lane divided major arterial in the 2009 City of Fort Worth Master Thoroughfare Plan and the Keller ISD was required to improve at its own expense 750 linear feet of the eastern half of the road, along the frontage of the new middle school. City staff is recommending participation in the project to extend said road improvements an additional 520 linear feet to the south to Crawford Farms Drive. Additionally, staff is recommending City participation to extend the sidewalk from Crawford Farms Drive to Amador Drive to provide pedestrian connectivity to the school. The Cost Summary of the Community Facilities Agreement has been revised using actual construction cost to Logname: 20OLD DENTON ROAD/ KELLER ISD Page 1 of 3 reflect the additional work and City participation and is shown in the Revised Summary of Costs table below. Based on construction costs, funding in the amount of $473,362.11 is requested for the City's portion of the construction cost, construction inspection, materials testing, engineering, surveying and construction manager fee. Developer Future Improvement Funds will be utilized for a portion of this cost in the amount of $384,149.80 and an additional amount of $89,212.31 will come from the 2004 Capital Improvements New Development funds. Upon Council's approval City staff will execute Amendment No. 1 to the Community Facilities Agreement to include City participation.
