FORT WORTH & WESTERN
CROSSING AGREEMENT
THIS AGREEMENT, made this �� day of ��_ A� 2007 by and between FORT
WORTH & WESTERN RAILROAD, ("Railroad"), and the CITY OF FORT WORTH, of the sta.te of TEXAS,
("the City"). WITNESSETH
RECITALS:
The City has requested that the Railroad improve one e�risting crossing at Long Avenue (DOT#
789550I-� to which the Railroad is agreeable, but solely upon the terms and conditions hereinafter set forth.
AGREEMENT:
NOW THEREFORE, in consideration of the premises and of the promises and conditions set forth
in this agreement, the parties hereto agree as follows:
1. The Railroad shall, subject to the reimbursement provided for in this agreement, furnish a111abor,
materials, equipment and supervision for crossing rehab including the insta.11ation of concrete panels
at the above location.
2. The City agrees;
To pay the entire cost of all materials which shall be payable upon Railroad notification to the City
that the project is complete. The City also agrees to place and remove barricades as needed for the
reconstruction and any approach pavement which shall be needed. The City's participation is
limited to $62,179.70. Amounts in excess of $62,179.70, if any, will require additional City
authorization before payment can be made.
3. The railroad agrees;
To pay the cost of all labor and equipment necessary for the track portion.
IN WITNESS WHEREOF, the parties hereto have duly executed this Agreement as of the
date and year first herein above written.

RECOMMENDATION:
It is recommended that the City Council authorize the City Manager to enter into an agreement with the Fort
Worth and Western Railroad (FWWR) for the installation of a new crossing surface in the 2400 Block of
Long Avenue for the estimated cost of $66,000.
DISCUSSION:
The 1998 Bond Program approved funds for Railroad Crossings at various locations throughout the City of
Fort Worth.
The FW1NR has agreed to share the cost of this project by providing labor and equipment to replace the old
crossing and a railroad switch located within the crossing. The City is to fund the purchase of all railroad
materials, traffic control, and install asphalt paving material after the crossing surface is replaced.
The City has received numerous complaints concerning the roughness of this railroad crossing.
Transportation Public Works Staff have evaluated all railroad crossing surfaces in the city and the FVW1/R
and Long Avenue crossing is one of the top five roughest crossings in the city.
This crossing is also scheduled for a railroad signal upgrade including new crossing gates under the Texas
Department of Transportation 2005 Federal Signal Program and that construction is expected to occur in
late 2007.
This project is located in COUNCIL DISTRICT 2.
FISCAL INFORMATION/CERTIFICATION:
The Finance Director certifies that funds are available in the current capital budget, as appropriated, of the
Street Improvements Fund.
