enter upon all public rights-of-wa}� For tlie purpose of making inspections to determine
compliance with the terms, covenants and conditions l�ei•ain. Ia the event that any inspaction
should revenl a bre�ch of any terms, caven��rts or couditions herein, City shall give Gra��tee
notice of such breach. SIiauld such breftcl� n�t be corrected 6y Gr�ntee �vithin iwenLy-faur (24)
hn��rs af receipt of the notice, or within suct� s!►ot�ter period of tinte as deemed necessmy by tlte
�3uitding O�cial for the protection oi public (te�lth or safety, City may terminato and cancel rhis

tl3e Cifiy are necessat-y to bring the public rights-of-�vay to tl�e condition presaribed hereio, and
City sf�a31 not he raspo�isible for trespass ar any otlier damage or liabiliky in connectioit with sucl�
removal or restoration, Grantee sl�alt reimburse City for the�cost and expe»se af s�ac[� removal

Nothing herein shall be construed as n waiver by City to enforce penal sanotioi�s prescribeci
by the Code of tha City af fart Worth afid tite laws af the Shate of Texas fo�� Grantee's enntini�ed
encroachment upan the pi�blic rights-of-way fatlo�ving terniination of this Consent Agreement.

It is further understqod and agreed bat�veen the pnrties hereto that City holds tt�e city streets,
alleys, sidewalks and �ther pubiic rights-of-w�y, inclucling tlte portions of such streets i�sed and
encrnaclted upo» as described herein, as trustee for the pnblic; tl�at City exercises suc[i powers
over ttie streels as have been delegated to it by tlie Constitution of tlte Sfate of Texas or by the
Le�;isllture; a�td �I�e Lity cannot conh•act away its dttty and its legisiative power to contra! Che
streets for tlte use and hene�t af ttic public, ft is accordingly ugreed f[�at if the governing body of
City, ta wit, its City Cnuncil, shall at any time dnring fi�e term tteraof determine in its sole
discretion to use or cnuse or perinit to be used for any pi�blic purpose tlte said encroached portian
