This Individual Case Basis (ICB) Pricing Schedule ("Pricing Schedule") is an attachment the Agreement between AT&T and
Customer referenced above, and is part of the Agreement.

installed. Note: Customer site preparation is a major factor impacting service implementation dates.

GENERAL TERMS AND CONDITIONS
The following terms and conditions apply to the Services subscribed to by Customer under this Pricing Schedule. ICB pricing is
offered to Customer pursuant to this Pricing Schedule because of the unique size or configuration of these business services.
1. GENERAL DESCRIPTION OF SERVICE TO BE PROVISIONED, INSTALLED AND MAINTAINED.
The Service(s) described below is provisioned solely by AT&T and is not jointly provisioned with any other carrier.
OPT-E-MAN� OPT-E-MANO Service. ("Service") OPT-E-MAN� Service provides a fiber-based service that
transparently interconnects two or more Customer locations within a Metropolitan Area Network (MAN) as
if they were segments on the same LAN using packet-based switching technologies. The Service
provides dedicated bandwidth from 5 Mbps up to 1 Gbps. The handoff to Customer will be a 10/100
Mbps or 1 Gbps Ethernet interface.
Customers may connect any two or more locations together, as long as they are in the same LATA or
MAN and the Service is available. The Service offers logical point-to-point or point-to-multipoint or
multipoint-to-multipoint configurations that support Ethernet-to-Ethernet LAN connections. If Customer
connects to the OPT-E-MAN network using a bridge or switch for Layer 2 connectivity, only 50 Media
Access Control (MAC) addresses can be used per Layer 2 device, per port. Any additional MAC
addresses will be assigned additional charges, with a limit of 100 MAC addresses total per port as set
forth in the applicable tariff.
2. PRICING SCHEDULE TERM AND EFFECTIVE DATES
Pricinq Schedule Term and Term Start Date
The term of this Pricing Schedule shall begin upon Cutover ("Term Start Date") but if regulatory approval is required, in no event shall
Term Start Date occur prior to the date of last approval by a regulatory agency with jurisdiction over the Pricing Schedule, and will
continue for sixty (60) months ("Pricing Schedule Term"). No rates or discounts shall be applied prior to Term Start Date. Upon the
expiration of the Pricing Schedule Term, any rates or discounts provided hereunder will no longer apply.
Customer and AT&T may agree in writing prior to expiration of the Pricing Schedule Term, that upon the expiration of the Pricing
Schedule Term and pending negotiations of a new agreement, the terms, conditions and provisions of the Pricing Schedule shall
remain in effect for an extended specified period of time.

3. GROWTH / ADDITIONAL SERVICES, INSTALLATION. ADDS, MOVES AND CHANGES
Unless otherwise stated herein, the price in Section 4.1 below also includes the non-recurring charge (or a portion thereof) to initially
provision and install the new quantities of Service(s) as set forth in Section 4.2.
Unless otherwise stated herein, for all other installations, adds, moves and changes of any Service provided hereunder, Customer will
pay the prevailing tariff monthly and non-recurring charge or shall be added subject to new negotiations.

Authorize a Purchase Agreement With AT&T (SBC) for Local Telephone Services for the
Information Technology Services Department
RECOMMENDATION:
It is recommended that the City Council:
1. Authorize a purchase agreement with AT&T (SBC) for local telephone services for the Information
Technology Solutions (IT Solutions) Department; and
2. Authorize use of the amended State of Texas Department of Information Resources (DIR) Texan 2000-
SWB-LS contract terms and conditions to begin April 11, 2006, and expire on August 31, 2009.
DISCUSSION:
IT Solutions wilf use a State of Texas DIR contract to procure local felephone senrices from AT&T (SBC) for
the City. Local services include items such as flat rate business lines, voice services, analog/digital trunk
services, disaster routing service, extended metropolitan service, digital subscriber service (DSL} and
Plexar services. All of these locally related telephone services are covered with the existing DIR Texas
Agency Network (TEX-AN 2000) contract. The contract is designed so that local entities may enter into
agreements directly with the vendor. Additionally, the DIR contract for Plexar Service allows for Individual
Customized Bids (ICB). Plexar Service for large users is generally customized to meet customer
needs. The City still has about 30% of its phones on the Plexar System. Over the next few years, use of
Plexar service will continue to diminish as the City changes to Public Branch Exchange (PBX) service.
The DIR contract is the result of a public procurement process conducted in compliance with applicable
Texas law. The contract has been amended and one of the amendments allowed an extension of the
cantract period. D{R and SBC signed the Fourth Amendment to TEX-AN 2000-SWB-LS to extend the
contract period through August 31, 2009.
DIR is authorized to offer the cooperative purchasing program to state agencies, public institutions of higher
learning, public school districts and local govemments. Pursuant to Government Code Section 791.025, a
local government that purchases goods and services under the Interlocal Cooperation Act satisfies
otherwise applicable competitive bidding requirements.
Over the last year approximately $2.9 million was spenf with SBC on services that are considered within the
scope of local telephone services.
M/WBE - A M/WBE goal is not assigned when making a purchase agreement from an approved purchasing
cooperative or other public entity.
