HomeMy WebLinkAboutOrdinance 19811-07-2011Ordinance No.19811 -07 -2011 AN ORDINANCE INCREASING THE ESTIMATED RECEIPTS AND APPROPRIATIONS IN THE SEWER CAPITAL PROJECTS FUND IN THE AMOUNT OF $97,058.00, FROM AVAILABLE FUNDS, FOR THE PURPOSE OF FUNDING SANITARY SEWER REHABILITATION CONTRACT LXXII (72), PART 2; PROVIDING FOR A SEVERABILITY CLAUSE; MAKING THIS ORDINANCE CUMULATIVE OF PRIOR ORDINANCES; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. That in addition to those amounts allocated to the various City departments for Fiscal Year 2010 -2011 in the Budget of the City Manager, there shall also be increased estimated receipts and appropriations in the Sewer Capital Projects Fund in the amount of $97,058.00, from available funds, for the purpose of funding Sanitary Sewer Rehabilitation Contract LXXII (72) Part 2. SECTION 2. That should any portion, section or part of a section of this ordinance be declared invalid, inoperative or void for any reason by a court of competent jurisdiction, such decision, opinion or judgment shall in no way impair the remaining portions, sections, or parts of sections of this ordinance, which said remaining provisions shall be and remain in full force and effect. SECTION 3. That this ordinance shall be cumulative of Ordinance No.19355 and all other ordinances and appropriations amending the same except in those instances where the provisions of this ordinance are in direct conflict with such other ordinances and appropriations, in which instance said conflicting provisions of said prior ordinances and appropriations are hereby expressly repealed. Schultz, Inc., d /b /a Circle "C" Construction Company, for Sanitary Sewer Rehabilitation Contract LXXII, Part 2, on Killian Street, Eastover Avenue, Angle Avenue, Meadowbrook Drive and Ramey Avenue and Adopt Appropriation Ordinance (COUNCIL DISTRICTS 2, 5, 8 and 9) RECOMMENDATION: It is recommended that the City Council: 1. Authorize the transfer of $97,058.00 from the Water and Sewer Operating Fund to the Sewer Capital Projects Fund; 2. Adopt the attached appropriation ordinance increasing estimated receipts and appropriations in the Sewer Capital Projects Fund by the amount of $97,058.00 from available funds; and 3. Authorize the City Manager to execute a Contract in the amount of $1,968,610.00 with William J. Schultz, Inc., d /b /a Circle "C" Construction Company, for Sanitary Sewer Rehabilitation Contract LXXII, Part 2. DISCUSSION: On August 29, 2006, (M &C C- 21635) the City Council authorized an Engineering Agreement with Halff Associates, Inc., for Sanitary Sewer Rehabilitation Contract LXXII (72). This project, Part 2, consists of the replacement of the deteriorated sanitary sewer mains located on the following streets: Street From To Killian Street Angle Avenue Ramey Avenue Meadowbrook Drive Eastover Avenue Miller Avenue Eastover Avenue Prairie Avenue West Long Avenue Carruthers Drive Debra Court Drive Petworth Place North Edgewood Terrace Killian Street ;Wilbarger Street r Knec'7)n1_OTPOT PC Pagel of3 This project was advertised for bid on May 12, 2011 and May 19, 2011, in the Fort Worth Star - Telegram. On June 2, 2011, the following bids were received: Iliam J. Shultz, Inc. d /b /a $$1,968,610.00 ?250 Calendar Days 11 - Circle "C" Construction Company Conatser Construction TX, LIP ;$1,988,215.00 Cleburne Utility Construction, Inc. 1$2,048,289.50 Tri -Tech Construction, Inc. '....,$2,066,170.00 M/WBE - William J. Schultz, Inc., d /b /a Circle "C" Construction Company, is in compliance with the City's M/WBE Ordinance by committing to 20 percent M/WBE participation. The City's goal on this project is 20 percent. Most State Revolving Loans are granted for construction contracts only. However with this particular loan the City of Fort Worth was authorized to pay for both an Engineering Agreement (design and survey) and the Construction Contract. Since no other expenses can be covered by SRF funding, additional appropriations of $97,058.00 ($38,000.00 for construction staking, project management material testing and inspection and $59,058.00 for project contingencies) are needed from the Sewer Capital Projects Fund. This project is located in COUNCIL DISTRICTS 2, 5, 8 and 9. FISCAL INFORMATION / CERTIFICATION: The Financial Management Services Director certifies that funds are available in the current capital budget, as appropriated, of the Clean Water State Revolving Fund 2007, and upon approval of the above recommendations, and adoption of the attached appropriation ordinance, funds will be available in the current capital budget, as appropriated, of the Sewer Capital Projects Fund.
