HomeMy WebLinkAboutOrdinance 19818-08-2011Ordinance No.19818 -08 -2011 AN ORDINANCE INCREASING THE ESTIMATED RECEIPTS AND APPROPRIATIONS IN THE WATER CAPITAL PROJECTS FUND IN THE AMOUNT OF $126,051.00 AND IN THE SEWER CAPITAL PROJECTS FUND IN THE AMOUNT OF $50,742.00, FROM AVAILABLE FUNDS, FOR THE PURPOSE OF EXECUTING A CONTRACT WITH MWH AMERICAS, INC FOR WATER AND SEWER REPLACMENT CONTRACT 2009, WSM -J; PROVIDING FOR A SEVERABILITY CLAUSE; MAKING THIS ORDINANCE CUMULATIVE OF PRIOR ORDINANCES; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. That in addition to those amounts allocated to the various City departments for Fiscal Year 2010 -2011 in the Budget of the City Manager, there shall also be increased estimated receipts and appropriations in the Water Capital Projects Fund in the amount of $126,051.00 and in the Sewer Capital Projects Fund in the amount of $50,742.00, from available funds, for the purpose of executing a contract with MWH Americas, Inc for Water and Sewer Replacement Contract 2009, WSM -J. SECTION 2. That should any portion, section or part of a section of this ordinance be declared invalid, inoperative or void for any reason by a court of competent jurisdiction, such decision, opinion or judgment shall in no way impair the remaining portions, sections, or parts of sections of this ordinance, which said remaining provisions shall be and remain in full force and effect. SECTION 3. That this ordinance shall be cumulative of Ordinance No.19355 and all other ordinances and appropriations amending the same except in those instances where the provisions of this ordinance are in direct conflict with such other ordinances and appropriations, in which instance said conflicting provisions of said prior ordinances and appropriations are hereby expressly repealed. SECTION 4. This ordinance shall take effect upon adoption. Authorize the transfer of $176,793.00 from the Water and Sewer Operating Fund in the amounts of $126,051.00 to the Water Capital Projects Fund and $50,742.00 to the Sewer Capital Projects Fund; 2. Adopt the attached appropriation ordinance increasing estimated receipts and appropriations in the Water Capital Projects Fund by the amount of $126,051.00 and the Sewer Capital Projects Fund by the amount of $50,742.00 from available funds; and 3. Authorize execution of a contract in the amount of $159,793.00 with MWH Americas, Inc., for Water and Sewer Replacement Contract 2009, WSM -J on Meadowbrook Drive and Sycamore Terrace. DISCUSSION: This project consists of the preparation of plans and specifications for the replacement of the deteriorated water and sanitary sewer mains located on Meadowbrook Drive (Beach Street to Tandy Avenue) and Sycamore Terrace (Vickery Boulevard to Dead -end). MWH Americas, Inc., proposes to perform the design work for a lump sum fee of $159,793.00. City staff considers this fee to be fair and reasonable for the scope of services proposed. MWH Americas, Inc., is in compliance with City's M/WBE ordinance by committing to 32 percent M/WBE participation. The City's goal on this project is 17 percent. In addition to the contract amount, $17,000.00 (Water: $11,000.00; Sewer: $6,000.00) is required for project management, real property acquisition and utility coordination. The project is located in COUNCIL DISTRICT 8 FISCAL INFORMATION / CERTIFICATION: The Financial Management Services Director certifies that upon approval of the above recommendations and adoption of the attached appropriation ordinance, funds will be available in the current capital budgets, as appropriated, of the Water Capital Projects Fund and the Sewer Capital Projects Fund.
