HomeMy WebLinkAboutOrdinance 19825-08-2011Ordinance No.19825 -08 -2011 AN ORDINANCE INCREASING THE ESTIMATED RECEIPTS AND APPROPRIATIONS IN THE ENVIRONMENTAL PROTECTION OPERATING FUND IN THE AMOUNT OF $62,000.00, AND DECREASING THE UNAUDITED, UNRESERVED, UNDESIGNATED FUND BALANCE BY THE SAME AMOUNT, FOR THE PURPOSE OF PUMPING CONTAMINATED SURFACE WATER AT 2500 BRENNAN AVENUE; PROVIDING FOR A SEVERABILITY CLAUSE; MAKING THIS ORDINANCE CUMULATIVE OF PRIOR ORDINANCES; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. That in addition to those amounts allocated to the various City departments for Fiscal Year 2010 -2011 in the Budget of the City Manager, there shall also be increased estimated receipts and appropriations in the Environmental Protection Operating Fund in the amount of $62,000.00, and decreasing the unaudited, unreserved, undesignated fund balance by the same amount, for the purpose of pumping contaminated surface water at 2500 Brennan Avenue. SECTION 2. That should any portion, section or part of a section of this ordinance be declared invalid, inoperative or void for any reason by a court of competent jurisdiction, such decision, opinion or judgment shall in no way impair the remaining portions, sections, or parts of sections of this ordinance, which said remaining provisions shall be and remain in full force and effect. SECTION 3. That this ordinance shall be cumulative of Ordinance No.19355 and all other ordinances and appropriations amending the same except in those instances where the provisions of this ordinance are in direct conflict with such other ordinances and appropriations, in which instance said conflicting provisions of said prior ordinances and appropriations are hereby expressly repealed. SECTION 4. This ordinance shall take effect upon adoption. CONTINUED FROM A PREVIOUS WEEK DATE: Tuesday, July 26, 2011 REFERENCE NO.: C -25076 LOG NAME: 20SUNBELT CHANGE ORDER #1 SUBJECT: Adopt Supplemental Appropriation Ordinance Increasing Appropriations in the Environmental Protection Operating Fund by $62,000.00 and Decreasing the Unreserved, Undesignated Fund Balance by the Same Amount, Transfer Funds to the Environmental Protection Project Fund, and Ratify Change Order No. 1 to City Secretary Contract No. 40686 with Sunbelt Industrial Services, Inc., for Pumping Contaminated Surface Water at 2500 Brennan Avenue in the Amount of $62,000.00 for a Total Contract of $1,136,363.00 (COUNCIL DISTRICT 2) RECOMMENDATION: It is recommended that the City Council: 1. Adopt the attached supplemental appropriation ordinance increasing appropriations in the Environmental Protection Operating Fund by $62,000.00 and decreasing the unreserved, undesignated balance by the same amount; 2. Authorize the transfer of $62,000.00 from the Environmental Protection Operating Fund to the Environmental Protection Project Fund; 3. Adopt the attached appropriation ordinance increasing estimated receipts and appropriations in the Environmental Protection Project Fund in the amount of $62,000.00 from available funds; and 4. Ratify Change Order No. 1 to City Secretary Contract No. 40686 with Sunbelt Industrial Services, Inc., in the amount of $62,000.00 for pumping contaminated surface water at 2500 Brennan Avenue. DISCUSSION: Soil contaminated with hydrocarbons was discovered to be impacting the drainage ditch that flows through 2500 Brennan Avenue into the Trinity River. The Transportation and Public Works Department worked with the Financial Management Services and Law Departments to initiate emergency response actions to protect the Trinity River. On July 13, 2010, Council ratified an emergency purchase order (M &C C- 24340) in the amount of $472,600.00 with Sunbelt Industrial Services, Inc., to excavate and dispose of hydrocarbon contaminated soils as well as control surface water influx through containment while pumping the contaminated water into the sanitary sewer system. On November 16, 2010, City Council ratified a continuance of the work in the amount $601,763.00 with Sunbelt Industrial Services, Inc. Following the hydrocarbon contaminated soil removal activities, box culverts were installed to allow maximum use of the site while still allowing storm water to flow through the site. During the course of the box culvert installation, contaminated surface water continued to accumulate in the work area. Sunbelt Industrial Services, Inc., was required to continue pumping the contaminated surface water into the Logname: 20SUNBELT CHANGE ORDER #1 Page 1 of 2 sanitary sewer system to allow construction activities to be performed. All discharges into the sanitary sewer were approved by the Water Department. Change Order No. 1 covers contaminated surface water pumping by Sunbelt Industrial Services, Inc., from September 2010 through April 2011 for a total cost of $62,000.00 thus increasing the total contract amount to $1,136,363.00. All work on this project is complete. The City's M/WBE Ordinance is waived for this Continuance of Work under the Emergency Purchase Order. This project is located in COUNCIL DISTRICT 2. FISCAL INFORMATION / CERTIFICATION: The Financial Management Services Director certifies that upon approval of the above recommendations and adoption of the attached appropriation ordinance, funds will be available in the project budget, as appropriated, of the Environmental Protection Project Fund.
