WHEREAS, the City of Fort Worth (CITY) and Freese & Nichols, Inc. ,
(ENGINEER) made and entered into City Secretary Contract No. 34445, (the
CONTRACT) which was authorized by the City Council by M&C C-21884 on the
12th day of December, 2006; and subsequently revised by Amendment Number
1 which was authorized by the City Council on the 9th day of October,
2007 (M&C C-22439) ;
WHEREAS, the Contract involves engineering services for the following
project:
Precinct Line Road from Hurst Boulevard to Concho Trail
(Project No. 00147) ;
WHEREAS, it has become necessary to execute Amendment No. 2 to said
Contract to include an increased scope of work and revised maximum fee;
NOW THEREFORE, CITY and ENGINEER, acting herein by and through their
duly authorized representatives, enter into the following agreement,
which amends the Contract:

Article I of the Contract is amended to include the additional
engineering services specified in the proposal letter dated December 23,
2009, copies of which are attached hereto and incorporated herein. The
cost to City for the additional design services to be performed by
Engineer total $53,210 .00
2 .
Article II of the Contract is amended to provide for an increase in
the maximum fee to be paid to Engineer for all work and services
performed under the Contract, as amended, so that the total fee paid by
the City for all work and services shall not exceed the sum of
$892, 876 . 00

Re: City Secretary Contract No. 34445, M&C No. C-21884: Precinct Line Road: Proposal to
provide engineering design for the relocation of a 12" waterline, archeological survey,
and additional surveying services.
Dear Mr. Weiss:
This letter is written in response to your request for Freese and Nichols, Inc. (FNI) to prepare a
combined contract amendment for additional engineering services for the design of a 12"
waterline relocation, archeological survey, and additional surveying services.
The purpose of the waterline relocation is to relocate the waterline to the east of the proposed
TxDOT Bridge widening to maintain accessibility for line maintenance following the bridge
construction. The existing 12" waterline is located approximately 15' east of the existing bridge,
which would be located in the center of the proposed bridge and would be in conflict with the
proposed bridge drilled shafts. Refer to the attached location map for the limits of the 12"
waterline relocation. The existing 12" waterline connects to a 33" concrete cylinder main that is
located on the north side of Trinity Boulevard. The City Water Department has stated that they
will only allow a connection to the 33" main between the months of October and March. In
addition, the City Water Department has requested that the entire 1,600 linear feet of existing
12" waterline between Trinity Boulevard and the concrete plant be relocated in conjunction with
the roadway construction, due to the height of the embankment that is planned within this area.
FNI will sub-consultant with AR Consultants to complete the following scope. This scope was
not included in our original proposal due to TxDOT historically has performed the archeological
survey services. However, with the funding cutbacks, TxDOT is no longer performing those
services. An archeological survey is required as part of the TxDOT Categorical Exclusion and
the USACE preconstruction notice.
The additional surveying services includes additional permanent slope easements, temporary
construction easements and right-of-way documents.

Project Scope— 12" Waterline Relocation
Task No. 1 —Data Collection
FNI will collect as built plans of the existing waterline facilities and shop drawings of the
existing 33" concrete cylinder pipe. The proposed waterline relocation is located within the
limits of the survey for Precinct Line Road, so no additional survey is included in this proposal.
Task No. 2— Construction documents
FNI will prepare plans and specifications for construction. The plans will include the following
sheets: general notes, plan and profile sheets, and construction detail sheets. FNI will prepare
specifications in accordance with the City of Fort Worth requirements.
Task No. 3—Proiect Meetings
FNI will attend up to four (4) project meetings, these include the two previously attended
concept plan meetings and two additional plan review meetings.
Task No. 4— Construction Phase Services
FNI will review construction submittals and attend up to two (2) construction site visits or
progress meetings during the construction of the waterline relocation improvements.
Project Scope—Archeological Survey
The proposed investigations will consist of an intensive archeological survey of approximately
2,500 feet of South Precinct Line Road in the Cities of Hurst and Fort Worth, Tarrant County,
Texas prior to widening within existing and proposed right-of-way (ROW). The project would
also include the realignment of approximately 1,800 feet of Walker Branch immediately west of
the roadway for drainage improvement. The project area extends from IH 10 to Concho Trail,
with the proposed realignment channel located immediately west of the roadway between
Walker Branch and Calloway Branch.
Tasks
In order to conduct the intensive pedestrian archaeological survey, AR Consultants, Inc. intends
to perform the following tasks.
1. Coordinate with the Texas Department of Transportation, the Fort Worth District of the
Corps of Engineers, and the Texas Historical Commission to confirm that an archaeological
survey is warranted and the level of survey needed. Once this is done we will secure an
Antiquities Permit for the investigation.

2. AR Consultants proposes to compile an inventory of historic and prehistoric archaeological
sites and architectural structures that are or were present within this study area. The first
step in the process will be the compilation of historic maps and records which provide
graphic representations of the entire area. In addition, we will compile records about
archaeological sites that have been recorded in the area. This will supplement the
information contained in earlier reports and in more recent survey reports.
3. We will conduct an intensive pedestrian archaeological survey of the entire site between
the railroad and Trinity Boulevard, which we estimate covers approximately five acres.
Shovel testing will be done on a judgmental basis, as recommended by the Council of
Texas Archeologists (2002), and we expect to excavate a minimum of ten shovel tests.
Shovel tests will be excavated to various depths depending upon their location. The sandy
loam matrix will be broken into small pieces and inspected carefully and screened through
'/4-inch hardwire screening. We expects to extend the shovel test depths to 1.75 in with the
use of a 4" diameter racket auger. The pit walls will be visually inspected for cultural
materials. Notes on the terrain, soils, vegetation and other relevant information will be
notated as well as photographs taken. We proposes to excavate four or five backhoe
trenches in the study area in order to explore for deeply buried archaeological site deposits,
and to determine the extent of the old creek channel and the potential for finding cultural
materials on unmapped high spots along the empty drainage channel. These trenches will
be immediately recorded and then will be backfilled after the profiles have been drawn and
photographed.
4. A draft report, following the guidelines recommended by the Council of Texas
Archeologists (ND) and accepted by the Texas Historical Commission (THC), will be
submitted to TxDOT and then the Archeology Division of the THC and to FNI for review.
Lastly, a final report will be prepared after review by the agencies above. Copies including
an unbound copy and an archival quality CD will also be submitted to the City of Fort
Worth, THC and TxDOT.
Proiect Scope—Additional Surveyin Services
The additional surveying services include preparation of two (2) additional permanent slope
easements, three (3) additional temporary construction easements, and five (5) additional right-
of-way documents.

Compensation
FNI proposes to provide the above mentioned basic services for a lump sum fee of $53,210.00.

We are using Gorrondona.Associates for Surveying and Aguirre& Fields for Traffic Control
and Construction Phasing and Blanton and Assoc. is providing 404 permitting services on the
Precinct Line Road project with TPW.With the additional services for waterline design, Archaeology, and
Surveying the project MWBE percentage will change from 33.9%to 33.3% of the contract that will be performed
by approved M/WBE firms,which exceeds our original goal of 28.0%for the Project.

RECOMMENDATION:
It is recommended that the City Council authorize the City Manager to execute Amendment No. 2 in
the amount of$53,210.00 to City Secretary Contract No. 34445, an Engineering Services Agreement
with Freese & Nichols, Inc., for the design of Precinct Line Road from Hurst Boulevard (State
Highway 10)to Concho Trail, thereby establishing a total contract cost of$892,876.00.
DISCUSSION:
This contract amendment is needed for the following additional design services:
Relocation of the existing 12 inch waterline east of the proposed Texas Department of
Transportation (TxDOT) bridge construction over Walkers Branch;
Completion of archeological survey required by Texas Department of Transportation (TxDOT) as a
part of the environmental review.
Additional surveying services for right-of-way, permanent slope and temporary construction
easements.
The City's 2004 CIP included $635,000.00 and the Special Assessments Fund included $444,000.00
for the design and construction of this four-lane divided roadway 1,000 feet north and south of Trinity
Boulevard. Subsequently, the 2006 Tarrant County Bond Program included $2,729,000.00 and
Federal transportation funding was approved for$800,000.00 to extend the project limits to SH-10 on
the north and Concho Trail on the south.
On December 12, 2006, (M&C C-21884)the City Council authorized the City Manager to execute an
Engineering Services Agreement with Freese & Nichols, Inc., in the amount of$263,346.00 for the
schematic design of Precinct Line Road from Hurst Boulevard to Trammel Davis Road.
On October 9, 2007, (M&C C-22439)the City Council authorized the City Manager to execute
Amendment No. 1 to City Secretary Contract No. 34445, an Engineering Services Agreement with
Freese & Nichols, Inc., in the amount of$576,320.00 for the final design of Precinct Line Road from
Hurst Boulevard to Concho Trail, thereby establishing a total contract cost of$839,666.00. During the
schematic design phase, it was determined that the southern project limit needed to be shortened
from Trammel Davis Road to Concho Trail because of additional expenses required for right-of-way
acquisition and roadway construction.
The Water Department is providing funding for Amendment No. 2 in the amount of$28,770.00 for the
relocation of the existing 12 inch waterline.
Freese& Nichols, Inc., proposes to complete Amendment No. 2 for a lump sum fee of
$53,210.00. City Staff considers this fee to be fair and reasonable for the scope of services to be
performed.
Freese & Nichols, Inc., is in compliance with the City's M/WBE Ordinance by committing to 24
percent M/WBE participation on this amendment. The City's goal on this amendment is 24 percent.
