Home My WebLink AboutContract 44546-AD2 „�,_CRETART SECOND ADDENDUM TO CITY SECRETARY CONTRACT NO.44546 This Second Addendum to City Secretary Contract Number 44546 ("Second Addendum") is by and between the City of Fort Worth ("City"), a home-rule municipal corporation of the State of Texas, acting by and through its duly authorized Assistant City Manager, and McKay Lodge Fine Arts Conservation Laboratory, Inc. ("Conservator"), an Ohio Corporation, acting by and through Robert G. Lodge, its President. The City has designated the Arts Council of Fort Worth& Tarrant County, Inc., to manage this Agreement on its behalf. WHEREAS, on June 19, 2013, the City and Conservator entered into a professional services agreement whereby Conservator will provide general maintenance, conservation, and consultation to the City for the City's art Collection, the same being City Secretary Contract (CSC) No. 44546; two amendments CSC 44546-A1 and CSC 44546-A2; three renewals CSC 44546-A2, CSC 44546-R2 and CSC 44546-R3; and one addenda CSC 44546-AD1; WHEREAS,the Contract sets forth that the Services to be provided shall be based on the annual Fort Worth Public Art work plan and on an as-needed basis in accordance with fully executed addenda; WHEREAS, this addendum is intended to serve as such and sets forth the Services to be provided per the Contract in accordance with the terms therein; and WHEREAS, the City and Conservator wish to set out the Services to be provided per the Contract that will be specific to this addendum with the intent that further Services may be requested by the City through future addenda. NOW, THEREFORE, in consideration of the mutual covenants herein expressed, the parties agree as follows: 1. Conservator hereby agrees to provide the City professional repair and restoration services for two untitled tile murals owned by the City and sited on Cattle Barns 1 and 2 at the Will Rogers Memorial Complex located at 3400 West Lancaster, Fort Worth 76107, each represented in Exhibit`B"Artwork. 9�Q y 12 2. The Services to be performed on the Artwork by the Contractor for this Second 4g� , Addendum are set forth in the Contractor's "Contractor's Proposal," which is attached r hereto as Exhibit "F" and incorporated herein for all purposes, and includes all labor, RECEIVED 4 2019 navel, and any other expenses required to complete the Services. Any and all Services to be performed under this Second Addendum shall be reviewed and approved by the Collection Manager, including all costs associated with performing the Services,prior to Conservator commencing such Services. 6. All terms and conditions of the Contract not specifically addressed herein remain in full force and effect and are binding upon the parties.
