The above, together with combined concrete curbs and gutter on proper grade and line where same are not already
so constructed, together with storm drains and other necessary incidentals and appurtenances ; all of said improve- .
ments are to be so constructed as and where shown on the plans and in strict accordance with the Plans and
Specifications therefoi• : and contract has been made and entered into with SRa AS PI-�ALT ZI�C ,
for the making and construction of such improvements on the above said portion of streets, avenues and public
places.
WHEREAS, estimates of the cost of the improvements of each_such .portion of streets, avenues and public
places were prepax ed and filec� and approved and adopted by the City Council of the City, and a time and place
was fixed for a hearing and the proper notice of the time, place and purpose, of said hearing was given and said

I�.
Where more than one person, firm or corl�oration owns an interest in any pt�operty above described, each
saici pei•soii, fii•m or coi•poi�ation shall be pet•sonally liable only for its, her oi• his pro rata of the total assessment
against such property in proportion as its, his or hei� respective interest beai•s to the total ownership of such
propei•tv, and its, his oi� i•espective interest in sueli property may be released from the assessment lien upon pay-
ment of such pi•oportionate sum.

The several sums above mentioned and assessed against the said parcel� of pi�operty, and the owners
thereof, and interest thereon at the i�ate of six per cent (6���) per annum, together with reasonable attorney's
fees and costs of collection, if incurred, ai•e her•eby decla�•ed to be and a��e made a lien upon the respective parcels
of property �,g.�inst wliicll the same are assessed, and a personal liability and charge against the �°eal and tr•ue
owners of such property, whether such owners be co�•rectly nanied herein or not, and the said liens shall be and
constitute the first enforceable lien and claim ag•ainst the l�roperty on whicli such assessments are levied, and
shall be a first and paramount lien thei•eon, superioi• to all other liens anci claims, except State, Count,y, School
District anci Citv ad valorem taxes.
Tlle sums so assessed against tl�e abutting pt-o�ert,y and the ownei�s thereof shall be and become due and
pa,yable as follows, to-wit: in five (5) equal installments, due respectively on or befot�e ihirty (30) days, one (1),
two (2), three (3), and foui• (4) years from the date of completion anfl acceptance of the improvements in the
z•espective unit, and the assessments against the propert,y auutting upon the remaining units shall be and become
due and pavable in sucll installments after tlie c3ate of tlle completion and acceptance of sucli res��eetive units, and
shall bear interest fi•om said date at the i°ate of six pei� cent (6�� ) per annum, payable annually wit11 each install-
ment, except as to tl�e first installment, which shall be due and pa,yaUle at the maturity thereof, so that upon the
completion and acceptance of the im��rovements in a particular t�nit, assessments against the property abutting
upon sucit completed and aceepted unit shall be and become dt�e and pa,yable in such installments; and with
interest frotn the date of such com�letion and acc�eptarlce. Provided, however, tllat any owner• shall liave the
i•ight to pav the entire assessment, or any installment thereof, before maturity by payment of principal and
accrued interest, anci providecl further that if default shall be mac�e in the l�avment of principal or interest
promptly as the same matures, then tlle entire �nlount of the assessment upon whicll sucl� default is made s11a11,
at the option of said Citv of Fort Worth, or its assigns, be and become imnleciiatel,v dtie and payable, and shall be
collectable, together with i•easonable attoi•ne�r's fees and cost of eollection, if inctu•��ed, PROVIDED, however,
th�t acting thi•ough its dtil�� authoi•ized Director of Pubiie VPorks tl�e Citv of Fort Wot�th retains the right to
�uthorize l�a,yment of the sums assesed ag•ainst abutting propertv upoii sucl� completed and accepted unit in not
more than fort�-eight (48) eqllal rebular montl�lv installnlents of not less than $9.00 eacli, the first of such
installments to become due and pavable not more tllan tllirtv (30) c�a��s aftel• tlle completion and acce��tance by
the Cit,v of the particul�lr unit. PROVIDED FURTH�R, that the Cit�� Attoi•ne�� is 11ei�ebv empowered to autho�•ize
payments of s�ic� sums of lesser installments and/or over � longer periocl of time in clses in wllich the Dii°ector
of Public Works has previouslp determinect that an extreme financial harciship ul�on the propet•ty owner will
otherwise result; and PROVIDED FUP.THER, that such method of papments shall be authorized only in instances
whei•e tlle owner oi• ownei•s of pi•opert�- abuttin�- upon sucll completed anci accepted i�nit shall have executed and
cielivereci to the Citv of Fort Worth a lawful, valid anc� bincting• note ard mechanic's and materialman's contract
upon forms supplied b�- the Cit�- branting a mechanic's lien upon anc� conve��ing the said abutting in•opet•ty in

VI.
If default sh�ll be made in the pa�-ment of an�- assessnlent, collection tl�ereof shall be enforced either Uy
tile sale of the in�ol�ert�� b�- tlle Assessoi• and Collectoi• of Taxes of said Cit�� as near as possible in the same man-
ner providec� for tlle sale of l�i�opei•t� for the non-pa�rment of ad �-aloi•em taaes, or at the op_tion of t�1e City of
Fort Worth, o�� its assigns, pavment of said sunls shall be enforced bv suit in any court of competent jurisdic-
tion, or as provicied in anv inechanic's or materialman's contract as aforesaid, and saic� Citv sl�all exercise all of
its lawful l�owers to aid in the enforcement and collection of said assessments. �
Tl�e total amount assessed against the respective pai•cels of abutting property, and the ownei•s tllei�eof, is
in accordance with the proceedings of the City 2�elating to said improvements and assessments thereof, and is
less tl�an the proportion oi the cost allowed and permitted by the law in force in the Cit,y.

Although the afoi�ementioned chai•ges have been fixed, levied, and assessed in the respective amounts
hereinak�ove stated, the City Council does hereby 7°eserve unto itself the right to reduce the aforementioned
assessments uy allawing credits to certain pr�oper�ty ownei•s whe��e deemed approg�riate, Notwithstanding the City
Council has hel•ein reserved tlie right to issue cr•edits, it s11a11 not be required to issLie c�°edits, and will not do so,
if same would result in an,y equit,y and/or unjust discrimination.
The principal amount of each of the sevei•al assessment cet•tificates to be issued the City of Foi•t Wor�th,
Texas, as hereinaftei� provided, sllal] be fixed and determineci b,y dedttcting from the amount of any assessment
hereinabove levied such amount or amounts, if an�, as ma,y l�ereafter be �llowect bv the City Council as a cz°edit
against the respective assessmenis.

For ttle ��urpose of evidencing the several,sums assessed �lg�ainst the respeetive parcels of abutting prop-
er�ty ancl the owners thereof, and the time and te��ms oi' pa�-ment, and to �id in the enforcement and collection
ther�eof, assignable ceitificates in the principal amount of tlle respecti��e assessments less the anzount of any re-
spective credit allowed tl�ereon, shall l�e issLzed by the City of Foz•t ��orth, Texas, upon completion and accept-
ance b,y the City of the im�roven�ients in eacll unit of in�pi•onement as the woi•k in such unit is completed and
acceptecl, which certificates shall be executed by the mavor in the nanie of tl�e City and attested k�y the City
Secretar•y, with t11e corl�ol•ate seal of tlie Citp impr�essecl tl�ereoti, anc� shall k�e pa�rable to the City of Fort Worth,
ot� its assigns, ancl sl�ali cleclare tlle said amounts, time and tei•ins of I�a�rnlent, rate of interest, and the date of
the completion and acceptance of the imp�•�vements abutting• u��on such propertv for which the certificate is
issued, and sl�all contain tl�e nar�ie of the ownei• oi• owners, if 1.zlown, clesci•iption of tlle�pr�opei•ty by lot and block
ntimbel•, or front feet thereon, or such otller descipti_on as n�ay otherwise identifv the same; and if the said
pt�opertp sl�all be ownecl l�v an��estate, tf�en tlle clesei•iption of sanle as so owned shall be suf�ieient anc� no erior or
mistalce in deseribing an5� propert��, oi� in g•i��ing• the nanle of the owner, shall invaliclate or in anvwise impair �
sueh certificate, to tlle asse�sments levied.

Said cei�tificates shall further recite that the City of Fort Worth, Texas shall exercise all of its lawful
powers, when requested so to do, to aid in the enforcement and collection thereof, and may contain recitals sub-
stantially in accordance with the above and other additional recitals pertinent or appropriate thereof, and it
shall not be necessary that the recitals be in the exact form above set forth, but the substance thereof shall be
sufficient. The fact that such improvements may be omitted on any poi•tion of any of said units adjacent to any
premises exempt from the lien of such assessments shall not in anywise invalidate, affect or impair the lien of
such assessments upon other premises.
X.
Full power to make and levy reassessments and to correct mistakes, errors, invalidities or irregularities,
eithex in the assessments or in the certificates issued in evidence thereof, is, in accordance with the law in force
in this City, vested in the City.
XI.
All assessments levied are a personal liability and charge against the real and true owners of the premises
described, notwithstanding such owners may not be named, or may be incor•rectly named.
XII.
The assessments so levied are for the improvements in the particular unit upon which the property
described abuts, and the assessments for the improvements in any unit are in nowise affected by the improve-
ments or assessments in any other unit, and in making assessments and in holding said hearing, the amounts
assessed for improvements in any one unit have been in nowise connected with the improvements or the assess-
ments therefor in any other unit.
XIII.
The assessments levied ai�e made and levied under and by virtue of the terms, powers and provisions of an
Act passed at the First Called Session of the Fortieth Legislature of the State of Texas, known as Chapter 106
of the Acts of said Session and now shown as Article 1105b of Ver�non's Texas Civil Statutes, which Act has been
adopted as an amendment to and made a part of the Charter of the City of Fort Worth, Texas.
XIV.
The City Secretary is hereby directed to engross and enroll this ordinance by copying the caption of same
in the Minute Book of the City Council of Fort Worth, Texas, and by filing the complete Ordinance in the appro-
priate Ordinance Records of said City.
XV.
This or•dinance shall take effect and be in full force and efiect from and after the date of its passage and
it is so ordained.
