BAILEY ADDITION, AN ADDITION TO THE CITY OF FORT WORTH, TARRANT COUNTY, TEXAS AS RECORDED IN VOLUME 388-310, PAGE 61 OF THE PLAT RECORDS OF TAI2RANT COUNTY, TEXAS, BEING AN ALLEY 12 FEET WIDE, AND CONTAINING 1,244 SQUARE FEET OR 0.0285 ACRE OF LAND; PROVIDING FOR REVERSION OF FEE IN SAID LAND, PROVIDING THAT THE CITY SHALL RETAIN ALL EXISTING UTILITIES; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING AN EFFECTIVE DATE BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. That an alley located between Bailey Street and University Drive in the WM. Bailey Addition, an addition to the City of Fort Worth, Tarrant County, Texas as recorded in Volume 388-310, Page 61 of the Plat Records of Tarrant County, Texas and being an alley twelve (12) feet wide and containing 1244 square feet of land or 0.0285 acre of land, and as more specifically described in Exhibits "A", "B", and "C" attached hereto and incorporated herein by reference be and the same is vacated and extinguished. SECTION 2. That the easement to the land in the above-described vacated alley is hereby released and shall revert to the adjacent owner as provided by law. 1 SECTION 3. All existing utility easement be shall be retained by the City until such time all utilities located in that easement are relocated at the owner's expense. SECTION 4. That all ordinances or parts of ordinances in conflict herewith are hereby repealed. SECTION 5. That this ordinance shall take effect upon adoption. Bailey Addition of the City of Fort Worth RECOMMENDATION: It is recommended that the City Council: 1. Adopt an ordinance vacating the alley between Bailey Street and University Drive, being 107.01 ft. long and 12 ft. wide right-of-way, consisting of 0.0285 acre of land, in the WM. Bailey Addition, as recorded in volume 388-310, Page 61, PRTCT, City of Fort Worth, Tarrant County, Texas; and 2. Waive any and all fee value of the vacated area. DISCUSSION: Townsite, Co., of Fort Worth, Texas on behalf of Jagee Real Properties, L.P., requests to vacate the above referenced right-of--way to replat it with adjoining property for development of a U.S. Post Office. The City Plan Commission recommended approval of this request at its meeting on June 28, 2006. An acceptable final plat (FP-06-109) has been submitted. The existing utilities were relocated at the applicant's expense. The Engineering Department, Real Property Service's Division, states that the fee value of the subject property is $10,729.50. The City of Fort Worth originally obtained the above mentioned right-of-way through the platting process. Since no City funds have been expended to purchase property or easement rights, the collection of fee value, or any portion thereof, is recommended by the Staff to be waived. This request is in COUNCIL DISTRICT 7. FISCAL INFORMATION/CERTIFICATION: The Finance Director certifies that this action will have no material effect on City funds.
