Harley Avenue and Bryce Avenue Infrastructure Construction Agreement CSC No. 48760 Amendment No. 1 WHEREAS, Event Facilities Fort Worth, Inc., ("Developer") and the City of Fort Worth, ("City"), entered into an Infrastructure Construction Agreement (CS No. 48760) (Administratively approved February 28, 2017) (the "ICA") for certain improvements to Harley Avenue and Bryce Avenue (the "Improvements") in conjunction with construction of the Dickies Arena; and WHEREAS, Section C. of the ICA stipulates that the Improvements may be modified as necessary through the course of construction by written Change Orders; and WHEREAS, additional work has been identified, specifically, the removal and replacement of failed existing clay street pavers within Trail Drive ("Additional Work") which was not included in the original ICA relative to the Dickies Arena; and WHEREAS, Developer will continue to engage the services of the General Contractor defined in the ICA to complete the original scope of work identified under (CS No. 48760) as well as the Additional Work which has been identified and included in this amendment; and WHEREAS, Staff has reviewed the scope, fee, cost allocations and schedule for the Additional Work and find them to be fair and reasonable. NOW, THEREFORE, KNOW ALL BY THESE PRESENTS: For and in consideration of the covenants and conditions contained herein, the City and the Developer do hereby agree as follows: General Requirements A. This Amendment will generally consist of removal of failed and failing clay street pavers and replacement with concrete street pavers in the same basic color and pattern as described on Attachment A. B. City agrees to increase the amount of the reimbursement to the Developer for the Additional Work, in accordance with the payment terms stipulated in the ICA, by an amount up to $300,000.00. The amount includes $23,000 for contingencies. This amount shall not be considered as part of the "Adjusted Public Contribution Amount"as defined in the Arena Funding Agreement(CS 48732). C. Developer will execute a change order with General Contractor for the construction of these additional Improvements. O� SkGQ D. All other terms of the original Infrastructure Construction Agreement not specifically amended or altered herein remain in full force and effect. ACCORDINGLY, the City and Developer have each executed two original copies of this instrument by and through their duly authorized representatives in to be effective as of the date subscribed by the City's designated Assistant City Manager. DISCUSSION: Events Facilities Fort Worth, Inc., and the City desire to amend City Secretary Contract No. 48760, an Infrastructure Construction Agreement related to the construction of certain infrastructure improvements adjacent to and supporting the "Dickies Arena" project, to include additional street surfacing work on Trail Drive. The Trail Drive work will entail removal of failing clay street pavers and replacement with concrete street pavers in the same basic color and pattern. Cost for the work is estimated to be $300,000.00, which includes a contingency amount of$23,000.00. The funding for the repair work has been provided from available funds from the original Trail Drive Project No. 00143. Event Facilities Fort Worth, Inc. will add this scope of work to their existing contract with Dennett Construction for the Infrastructure Construction Agreement work.
