This letter and the attachments are a Notice of Establishment (NOE) for the creation of a quiet zone under 49 CFR 222.39(a)(1) and Appendix A to Part 222. As required by the Federal Railroad Administration under 49 CFR 222.43, the following information is provided to you and other parties. EFFECTIVE DATE OF QUIET ZONE—222.43(d)(1)(1) Routine use of the locomotive horn at the crossings listed below shall cease effective February 19, 2019. LIST OF GRADE CROSSINGS WITHIN THE QUIET ZONE—222.43(d)(2)(i) All public, private, and pedestrian grade crossings to be included within the proposed quiet zone are: Crossing ID Street Name Location on Street Improvement 971458F E 1 st Street 1500 SSM Four-Quadrant Gates The City plans to implement a quiet zone at these crossings with the proposed improvements described for each crossing below. E 1st Street(SSM Four-Quadrant Gates) The E 1 st Street crossing is an existing two-lane roadway crossing over one TEXRail mainline track. The crossing is equipped with a four-quadrant gate system, which includes flashing lights, gates, bells, constant warning circuitry, and power-out indicator. The four-quadrant gate system, qualifies as a SSM. Pedestrian flashing lights, gates, and bells are installed to provide additional warning to pedestrians on sidewalk south of the crossing. Signs and pavement markings are installed per TXMUTCD. REGULATORY BASIS FOR QUIET ZONE ESTABLISHMENT—222.43(d)(2)(ii) This quiet zone is being established under 49 CFR 222.39(a)(1), 49 CFR 222.59, Appendix A to Part 222.A.3(b) and Appendix E to Part 222.E(1-6). However, the agency did invite State agency representatives, all affected railroads, and the FRA to attend a diagnostic team review that was conducted on September 1, 2015. TIME PERIOD FOR HORN RESTRICTION -222.43(d)(2)(iv) The quiet zone is proposed to restrict the routine sounding of locomotive horns 24 hours a day. EXISTING GRADE CROSSING INVENTORY FORMS -222.43(d)(2)(v) Accurate and complete grade crossing inventory forms for each public, private, and pedestrian grade crossing within the quiet zone that reflects conditions existing at the crossings before quiet zone improvements were made are provided in Attachment C. QUIET ZONE GRADE CROSSING INVENTORY FORMS-222.43(d)(2)(vi) Accurate and complete grade crossing inventory forms for each public, private, and pedestrian grade crossing with in the quiet zone that reflects SSMs in place upon establishment of the quiet zone are provided in Attachment D. NOTICE OF INTENT—222.43(d)(2)(vii) A Notice of Intent to Establish a New Quiet Zone at the above listed location was sent, by certified mail — return receipt requested, to all railroads operating over the public grade crossings within the proposed quiet zone, the State agency responsible for grade crossing safety, and the State agency responsible for highway and road safety on August 14, 2018. DISCUSSION: The establishment of these quiet zones is being done in conjunction with the construction of the new TEXRail line, which is anticipated to be open in January 2019. The Transportation and Public Works Department proposes to create quiet zones, pursuant to the Federal Railroad Administration (FRA) Train Horn rule at the seven crossings listed below: YE. 1st Street (Council District 8) -TEXRail "29th Street (Council District 2) -TEXRail, FWWR Decatur Avenue (Council District 2) - TEXRail, FWWR, Schwartz Avenue (Council District 2) -TEXRail, FWWR, UPRR Deen Road (Council District 2) - TEXRail, FWWR, UPRR Sylvania (Council Districts 2 and 4) - TEXRail, UPRR Beach Street (Council District 4) -TEXRail, UPRR Upon approval of this M&C, the City will execute and submit the NOE to the FRA and affected railroads. With the expected approval from FRA, the quiet zones could be established first quarter 2019. The required Notice of Intent was provided on August 14, 2018 to the affected railroads. The City and Trinity Metro will execute an interlocal agreement governing maintenance responsibilities for these quiet zones. CTC Inc., provided quiet zone application services for the City in the amount of$50,288.07 pursuant to City Secretary Contract No. 49643. The quiet zones are in COUNCIL DISTRICTS 2, 4, and 8. This M&C does not request approval of a contract with a business entity.
