AN ORDINANCE VACATING AND EXTINGUISHING AN ALLEY
LOCATED BETWEEN WEST ROSEDALE STREET AND WEST
OLEANDER STREET IN DISSELL TRACTS, AN ADDITION TO THE
CITY OF FORT WORTH, TAItRANT COUNTY, TEXAS AS RECORDED
IN VOLUME 106, PAGE 129 OF THE DEED RECORDS OF TAR]E2AlvT
COUNTY, TEXAS, BEING AN ALLEY 18 FEET WIDE, AND
CONTAINING 3,525 SQUARE FEET OF LAND; PROVIDING FOR
REVERSION OF FEE IN SAID LAND, PROVH)ING THAT THE CITY
SHALL RETAIN ALL EXISTING UTILITIES; REPEALING ALL
ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING AN
EFFECTIVE DATE
BE IT ORI2AINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH,
TEXAS:
SECTION 1.
That an alley located between West Rosedale Street and West Oleander Streets in the
Dissell Tracts, an addition to the City of Fort Worth, Tarrant County, Texas as recorded in
Volume 106, Page 129 of the Deed Records of Tarrant County, Texas and being an alley
eighteen (18) feet wide and containing 3525 square feet of land, and as more specifically
described in Exhibits "A", "B", and "C" attached hereto and incorporated herein by reference be
and the same is vacated and extinguished.
SECTION 2.
That the easement to the land in the above-described vacated alley is hereby released and
shall revert to the adjacent owner as provided by law.
SECTION 3.
All existing utility easement be shall be retained by the City until such time all utilities
located in that easement are relocated at the owner's expense.
SECTION 4.
That all ordinances or parts of ordinances in conflict herewith are hereby repealed.
SECTION 5.
That this ordinance shall take effect upon adoption.

Description for an Eighteen Feet (18') wide Alley in Disse! Trac#, an
addition to the City of Fort Worth, Tarrant Gounty, Texas, according to the
plat recorded in Volume 146, Page '[ 29, Deed Records, Tarrant County,
Texas, and being described by metes and bounds as follows:
BEGINNING at the intersection of the east line of said alley with the north line of West
Oleander Street, at the southwest corner of Lot 7 of said Dissel Tract;
THENCE WEST a distance of '! 8.00 feet along the nar#h tine of West Oleander Street to
the west Line of said alley and to the southeast corner of Lot 69-R-1, Dissel Tract,
according to the plat recorded in Volume 388-172, Page 84, Plat Records, Tarrant
County, Texas; .
THENCE NORTH a distance of '(99.42 feet along the west line of said alley and the
east line of Lot 69-R-1 to the south line o€ West Rosedale Street;
THENCE South 68 degrees 08 minutes 54 seconds East a distance of 19.39 feet along
the south line of West Rosedale Street to the east line of said alley and to the east line
of Lot 9 of said Dissel Tract;
THENCE SOUTH 192.20 fleet along the east line of said alley and along the west line of
Lots 9, 8, and 7, of said Dissel Tract to the POINT OF BEGINNING, said described tract
containing 3,525 square feet of land.

Adopt an Ordinance Vacating an 18 Foot Wide Alley in the Dissell Tracts Addition, Located between
West Rosedale and West Oleander Streets, in the City of Fort Worth, Texas
RECOMMENDATION:
It is recommended that the City Council:
1. Adopt an ordinance vacating an 18 foot wide alley in the Dissell Tracts Addition, located between West
Rosedale and West Oleander Streets in the City of Fort Worth, Texas, from a point at West Rosedale Street
to a point at West Oleander Street, in the City of Fort Worth, Texas, as recorded in volume 106, page 129,
DRTCT and containing approximately 3,525 square feet of land; and
2. Waive any and all fee value of the vacated area.
DISCUSSION:
Gideon Toal, on behalf of Harris Methodist/Harris Place of Fort Worth, Texas, requests to vacate the above
referenced property, to expand its parking lot and to relocate a trash receptacle (dumpster). Reviewing City
departments and public utility companies have raised no objections to this request. The City Plan
Commission recommended approval of this request at its meeting on November 17, 2006. An acceptable
replat (FS-06-247) has been submitted. Any existing utilities will be relocated at the applicant's expense, or,
retained in an appropriately designated easement.
The Engineering Department, Real Property Service's Division, states that the fee value of the subject
property is $48,766.61. The original dedication was obtained through the platting process. Since no City
funds have been expended to purchase the property or easement rights, collection of the fee value, or any
portion of the fee value, is recommended by staff to be waived.
This request is in COUNCIL DISTRICT 8.
