HomeMy WebLinkAboutOrdinance 19859-08-2011Ordinance No.19859 -08 -2011 AN ORDINANCE INCREASING THE ESTIMATED RECEIPTS AND APPROPRIATIONS IN THE SPECIAL TRUST FUND IN THE AMOUNT OF $500,000.00, SUBJECT TO RECEIPT OF A DONATION FROM BNSF FOUNDATION, FOR THE PURPOSE OF TRANSFERRING SAID FUNDS TO THE UNITED WAY OF TARRANT COUNTY FOR SUPPORT OF THE HOMELESSNESS INITIATIVE; PROVIDING FOR A SEVERABILITY CLAUSE; MAKING THIS ORDINANCE CUMULATIVE OF PRIOR ORDINANCES; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. That in addition to those amounts allocated to the various City departments for Fiscal Year 2010 -2011 in the Budget of the City Manager, there shall also be increased estimated receipts and appropriations in the Special Trust Fund in the amount of $500,000.00, subject to receipt of a donation from BNSF Foundation for the purpose of transferring said funds to the United Way of Tarrant County for support of the homelessness initiative. SECTION 2. That should any portion, section or part of a section of this ordinance be declared invalid, inoperative or void for any reason by a court of competent jurisdiction, such decision, opinion or judgment shall in no way impair the remaining portions, sections, or parts of sections of this ordinance, which said remaining provisions shall be and remain in full force and effect. SECTION 3. That this ordinance shall be cumulative of Ordinance No.19355 and all other ordinances and appropriations amending the same except in those instances where the provisions of this ordinance are in direct conflict with such other ordinances and appropriations, in which instance said conflicting provisions of said prior ordinances and appropriations are hereby expressly repealed. Accept a donation of $500,000.00 from Burlington Northern Santa Fe Railroad Foundation for support of the homelessness initiative; 2. Adopt the attached appropriation ordinance increasing estimated receipts and appropriations in the Special Trust Fund in the amount of $500,000.00; and 3. Authorize the City Manager to disburse $500,000.00 to the United Way of Tarrant County. DISCUSSION: On June 17, 2008, the City Council adopted the City's Homelessness Plan, Directions Home (Resolution No. 3628 -06- 2008). The United Way of Tarrant County (United Way) offered to serve as a funding conduit at no cost for the implementation of the Directions Home programs funded by the City. United Way created a special fund to administer and distribute public and private dollars to be used for the implementation of county -wide homelessness programs. United Way administered funding allocated by the City Council in Fiscal Years 2008 -2009, 2009 -2010 and 2010 -2011 for Program Years I, II and III of Directions Home. The City Council approved the most recent Agreement (M &C C- 24633) on December 7, 2010, with the United Way for the administration of funds (City Contract No. 41247). Burlington Northern Santa Fe Railroad Foundation (BNSF) donated $500,000.00 to the City in Fiscal Year 2010 for the purpose of supporting Directions Home. The City is still holding these funds, but pursuant to this Agreement, the $500,000.00 donation from BNSF will be disbursed to the United Way for the purpose of distributing funds to designated Directions Home activities.
