ORDINANCE NO. 17406-02-2007 AN ORDINANCE VACATING AND EXTINGUISHING KAREN CIRCLE FROM ITS NORTH TEII;MIPIUS TO ITS SOUTH TERMINUS WITH WESTRIDGE AVENUE LOCATED IN RIDGEWAY MANORS NO. 1, AN ADDITION TO THE CITY OF FORT WORTH, TAIZItANT COUNTY, TEXAS AS RECORDED IN VOLUME 388-G, PAGE 125 OF THE PLAT RECORDS OF TAR]E2ANT COUNTY TEXAS AND BEING APPROXIMATELY 1,116.57 FEET LONG AND 30 FEET WIDE AND CONTAINING APPROXIMATELY 0.807 ACRE OF LAND; PROVH)ING FOR THE REVERSION OF FEE IN SAID LAND; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. That Karen Circle, from its north terminus to its south terminus with Westridge Avenue, located in Ridgeway Manors No. 1, an addition to the City of Fort Worth, Tarrant County, Texas as recorded in Volume 388-G, Page 125 of the Plat Records of Tarrant County Texas and being approximately 1,116.57 feet long and 30 feet wide and containing approximately 0.807 acres of land more or less, and as more specifically described in Exhibit "A", and "B" attached hereto and incorporated herein by reference, be and the same is vacated and extinguished. SECTION 2. That the fee to the land in the above-described street is released and shall revert to the adjacent owner as provided by law. SECTION 3. That all existing utility easements shall be retained by the City until such time all utilities located in that easement are relocated at the owner's expense. 1 SECTION 4. That all ordinances or parts of ordinances in conflict herewith are hereby repealed. SECTION 5. That this ordinance shall take effect upon the acceptance and filing by the City of the replat of the property. It is the intent of the City to repeal this ordinance vacating the above-described streets if the replat is not accepted and filed by the City by August 13, 2007. Adopt an ordinance vacating Karen Circle from its north terminus to its south terminus with Westridge Avenue, being approximately 1,116.57 ft long and 30 ft. wide right-of-way, consisting of 0.807 acre of land, in the Ridgeway Manor No. 1 Addition, as recorded in Volume 388-G, Page 125, PRTCT, City of Fort Worth, Tarrant County, Texas; and 2. Waive any and all purchase fee value of the vacated land. DISCUSSION: Kline & Co. of Fort Worth, Texas on behalf of Colony/Fort Worth Apartments, LP, requests to vacate the above referenced right-af-way to replat it with adjoining property for development. The City Plan Commission recommended approval of this request at its meeting on January 24, 2007. An acceptable replat (FS-07-002) has been submitted. Any existing utilities will be relocated at the applicant's expense, or, retained in an appropriately designated easement. If the City Council approves the vacation of the above referenced right-of-way, the corresponding plat has to be recorded by August 13, 2007. If the corresponding plat is not recorded by the above referenced date, Karen Circle will revert to public right-of-way. The Engineering Department, Real Property Service's Division, states that the fee value of the subject property is $90,992.06. The City of Fort Worth originally obtained the above mentioned right-of-way through prescription. The City does not own land adjacent to the above referenced property. Since no City funds have been expended to purchase property or easement rights, collection of the fee value, or any portion thereof, is recommended to be waived. The proposed right-of-way vacation lies within COUNCIL DISTRICT 3. FISCAL INFORMATION/CERTIFICATION: The Finance Director certifies that this action will have no material effect on City funds.
