HomeMy WebLinkAboutOrdinance 19866-09-2011Ordinance No. 19866-09-2011 AN ORDINANCE INCREASING THE ESTIMATED RECEIPTS AND APPROPRIATIONS IN THE STREET IMPROVEMENTS FUND IN THE AMOUNT OF $7,658.20, FROM AVAILABLE FUNDS, FOR THE PURPOSE OF PROVIDING FUNDS FOR THE DESIGN OF HARLEY AVENUE FROM UNIVERSITY DRIVE TO MONTGOMERY AVENUE; PROVIDING FOR A SEVERABILITY CLAUSE; MAKING THIS ORDINANCE CUMULATIVE OF PRIOR ORDINANCES; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. That in addition to those amounts allocated to the various City departments for Fiscal Year 2010 -2011 in the Budget of the City Manager, there shall also be increased estimated receipts and appropriations in the Street Improvements fund in the amount of $7,658.20, from available funds, for the purpose of providing funds for the design of Harley Avenue from University Drive to Montgomery Avenue. SECTION 2. That should any portion, section or part of a section of this ordinance be declared invalid, inoperative or void for any reason by a court of competent jurisdiction, such decision, opinion or judgment shall in no way impair the remaining portions, sections, or parts of sections of this ordinance, which said remaining provisions shall be and remain in full force and effect. SECTION 3. That this ordinance shall be cumulative of Ordinance No. 19355 and all other ordinances and appropriations amending the same except in those instances where the provisions of this ordinance are in direct conflict with such other ordinances and appropriations, in which instance said conflicting provisions of said prior ordinances and appropriations are hereby expressly repealed. SECTION 4 This ordinance shall take effect upon adoption. Authorize the transfer of $7,658.20 from the Culture and Tourism Operating Fund to the Street Improvements Fund; 2. Adopt the attached appropriation ordinance increasing the estimated receipts and appropriations in the Street Improvements Fund by $7,658.20 from available funds; and 3. Authorize Amendment No. 2 in the amount of $7,658.20 to City Secretary Contract No. 38347, an Engineering Services Agreement with Freese & Nichols, Inc., for the design of Harley Avenue from University Drive to Montgomery Avenue for a total Contract cost of $388,387.20. DISCUSSION: The City of Fort Worth has contracted with Freese and Nichols, Inc., to provide planning and design services for the realignment of Harley Avenue. The contract includes coordinating the planning and design efforts with Event Facilities Fort Worth, Inc. This proposed Amendment No. 2 is for property platting services to incorporate the property associated with new Multi- Purpose Facility now under construction and the right -of -way vacation of portions of W.R. Watt Drive, Burnett -Tandy Drive and Rip Johnson Drive. These plat changes are necessary to fully incorporate the property and rights -of -way into the Will Rogers Complex and to place them under full control of the Public Events Department. This increase in scope is being funded by the Public Events Department. Freese & Nichols, Inc., proposes to complete the items included in Amendment No. 2 for a lump sum fee of $7,658.20. City staff considers this fee to be fair and reasonable for the scope of services to be performed. This project is located in COUNCIL DISTRICT 7, Mapsco 76E and benefits the Will Rogers Memorial Center which serves the entire City.
