WHEREAS, the City of Fort Worth (City) and Teague Nall &
Perkins, Inc., (Engineer) made and entered into City Secretary
Contract No. 35816, (the Contract) which was authorized by the
City Council by M&C; C —22294 on the 9t` day of August 2007 ; and
WHEREAS, the Contract involves engineering services for the
following project:
Storm Water Utility Project - Scott -Sunset Drainage Improvements,
Project, No. 00628; DOE No. 5560
WHEREAS, it has become necessary to execute Ay-vzendment No. 1
to said Contract to include an increased scope of work and revised,
maximum fee;
NOW THERETO E- , City and. Engineer, acting herein by and
through their duly authorized representatives, enter into the
following agreement which amends the Contract:

Article I of the Contract is amended to include the
additi ona.l engineering services specified in a proposal letter
dated. November 13, 2008, a copy of which is attached hereto and
incorporated herein. The cost to City for the additional design
services to be performed by Engineer total $20,950.00.
2.
Axticle II of the Contract is amended to provide for an
increase in the maximum fee to be paid to Engineer for all work
and services performed under the Contract, as amended, so that the
total fee paid by the City for all work and services shall not
exceed the stun of $66,199.00.

All other provisions of the Contract which are not expressly amended
herein shall remain in full force and effect.

Dear Ms. Johnson:
As per your request, this amendment revises the previous Contract No. 00628, Scott -Sunset Master
Drainage Studv. Specifically, this amendment includes provisions for Additional Study as described in the
Attached Exhibit A-1, Supplemental Scope of Services and is summarized as follows:
a. Evaluate up to two (2) design alternatives for conveyance storm water outside of the paved
area for the proposed improvements in Sunset Lane, Scott Street, and Nursery Lane, which
will minimize the impact to the existing utilities, paved streets, curbs, and drainage ditches.
These alternatives will include an evaluation of non-standard inlets associated with the
roadside ditch grading. The work will also include a re -development of the storm sewer
models and calculations, due to the anticipated increase of inlets required.
Provide a "study -level" assessment of potential utility impacts and/or adjustment that may
be required for the construction of the design alternatives versus the traditional curb and
gutter inlet and curb inlets.
Prepare an opinion of probable construction costs for the proposed design alternatives.
Identify preliminary easements and ROW acquisition that may be needed for the
construction of the proposed improvements. (NOTE: Preparation of easement and ROW
documents is not considered a part of this Amendment).
e. Prepare an updated (amended) report/study to document the traditional drainage
improvements option versus the alternate design option(s).

No "Additional Services" are anticipated in conjunction with this Amendment; however, this amendment
will include the following revisions to the contract values:
Original Contract Fee: $ 45,249.00

ENGINEERING PLANNING/STUDY SERVICES: Additional Study
The following is a clarification of the tasks that the ENGINEER will perform under ATTACHMENT
"A". Work under this, attachment includes engineering services for additional study and an
evaluation of design alternatives for the drainage improvement facilities recommended in the
"Drainage Study for Future Storm Water Improvements" associated with the "Scott -Sunset Master
Drainage Plan" as shown on Exhibit D. The work will include the following:
a. Evaluate up to two (2) design alternative for conveyance storm water
outside of the paved area for the proposed improvements in Sunset Lane,
Scott Street, and Nursery Lane, which will minimize the impact to the
existing utilities, paved streets, curbs, and drainage ditches. These
alternates will include an evaluation of non-standard inlets associated with

Upon receipt of notice to proceed, the ENGINEER will perform the following tasks:

TASK 1 - Initial Data Collection
A. Coordination Meetings
ENGINEER will attend and document meetings, as required, to discuss and coordinate
various aspects of the project and to ensure that the project stays on schedule. For
purposes of establishing a level of comfort, two (2) meetings are anticipated. These
include the following:
1. One (1) pre -design kick-off meeting, (including the CITY's Department of
Engineering, Storm Water Management, and other departments that are impacted
by the project);
2. One (1) review meeting at completion of the City's review of the amended Scott -
Sunset Master Drainage Plan.
B. Data Collection
In addition to the data already obtained from the City, the ENGINEER will research and
make efforts to obtain pertinent information to aid in coordination of the proposed
improvements with any planned future improvements that may influence the project.
ENGINEER will also identify and seek to obtain additional data for existing conditions that
may impact the project including; utilities, City Master plans, CITY drainage complaint files,
existing applicable drainage studies and property ownership as available from the Tax
Assessor's office.
C. Schedule Submittal and Monthly Progress Report
The ENGINEER shall submit a project schedule after the design contract is fully executed.
The schedule shall be updated and submitted to the CITY along with monthly progress
reports as required under Attachment B of the contract.
TASK 2 — Evaluate Desiqn Alternates
A. Identify and Evaluate Design Alternates
Where appropriate, up to two alternate alignments will be evaluated for the proposed
storm drains located in Sunset Lane, Scott Street, and Nursery Lane. Each alternate will

include the design of non-standard inlets at certain locations assuming no re -construction
of the existing pavement. The objective of each alternate will consider the possible
reconstruction of the street at some future date while minimizing, to the extent possible,
relocation of the storm sewer.
B. Drainage Computations
The ENGINEER will review and document the storm water watershed drainage runoff
area and existing street, right-of-way, storm sewer capacities for each design alternate.
A drainage area map will be drawn at 1" = 200' scale from available contour maps for
each alternate design. Calculations regarding street, right-of-way, ditches, and inlet
capacities and design discharges (5-year and 100-year frequencies) at selected critical
locations will be provided within the amended report. The ENGINEER's responsibility
includes recommendations for improvements of the existing system as deemed
reasonable and consistent with City standards.
C. Presentation of Results and Evaluation
1. ENGINEER shall submit an amended report which summarizes the design
alternates for review and comment to the City 25 working days after the notice to
proceed is issued. The amended report shall summarize/compare the traditional
drainage improvement concepts with each alternate design.
2. The ENGINEER shall furnish four (4) copies of the amended report which will
include appropriate exhibits depicting the layouts, preliminary right-of-way needs
and opinion of probable cost for each design alternate. The ENGINEER shall
provide a "study -level" assessment of the impact of potential utility adjustments
required for construction of these improvements shall submit such evaluation in
writing to the City as a part of the amended report for the project.
D. As part of the submittal, the ENGINEER will submit for review, a "study -level" opinion of
probable cost for each design alternate.
E. Upon receipt of the City review comments, the ENGINEER will revise the amended study
and re -submit it.
TASK 3 — Right of Wav Research
A. The ENGINEER will conduct preliminary research for availability of existing easements

where open -cut construction or relocation of existing alignments is probable. Temporary
and permanent easements will be evaluated based on available information and
recommendations will be made for approval by the City.
B. Right-of-way/Easement Preparation and Submittal
No right-of-way/easements preparation is included in this scope of services.

COMPENSATION AND PAYMENT SCHEDULE

ADDITIONAL STUDY
SCOTT-SUNSET DRAINAGE IMPROVEMENTS
Project No. 00628
I. Compensation
A. The ENGINEER shall be compensated a total lump sum fee of Twentv
Thousand, nine hundred, fiftv dollars ($20,950) for Basic & Additional
Services, as summarized in Exhibit "13-313". Payment of the total lump sum
fee shall be considered full compensation for the Basic & Additional Services
as described in Attachment "A" and Exhibit "A-1", for all labor materials,
supplies and equipment necessary to complete the project.
B. No Special Services are anticipated for this project.
C. The Engineer shall be paid monthly as described in Exhibit "13-1 ", Section I —
Method of Payment.
D. Each invoice is to be verified as to its accuracy and compliance with the
terms of this contract by an officer of the Engineer.
II. Schedule
A. A review copy of the amended report, along with opinions of probable costs
shall be submitted to the owner to the OWNER within 25 working days after
the "Notice to Proceed" letter is issued.
B. A revised copy of the amended report shall be submitted within 5 working
days after receipt of OWNER's comments regarding the initial submittal of
the amended report.
C. Special Services will be scheduled and completed as requested by the City.
