AN ORDINANCE INCREASING THE ESTIMATED RECEIPTS AND
APPROPRIATIONS IN THE GRANT CAPITAL PROJECTS FUND IN THE AMOUNT
OF $1,333,333.33, SUBJECT TO RECEIPT OF THE LEGISLATIVE PRE- DISASTER
MITIGATION GRANT FROM THE DEPARTMENT OF HOMELAND SECURITY,
FEDERAL EMERGENCY MANAGEMENT AGENCY, FOR THE PURPOSE OF
FUNDING PROPERTY ACQUISITION, DEMOLITION AND RECONSTRUCTION
OF THE DEWEY STREET BRIDGE FOR THE LEBOW CHANNEL ROADWAY
CROSSINGS PROEJCT; PROVIDING FOR A SEVERABILITY CLAUSE; MAKING
THIS ORDINANCE CUMULATIVE OF PRIOR ORDINANCES; REPEALING ALL
ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING AN EFFECTIVE
DATE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH,
TEXAS:
SECTION 1.
That in addition to those amounts allocated to the various City departments for Fiscal Year 2010 -2011 in the
Budget of the City Manager, there shall also be increased estimated receipts and appropriations in the Grant
Capital Projects Fund in the amount of $1,333,333.33, subject to receipt of the Legislative Pre - disaster
Mitigation grant from with the Department of Homeland Security, Federal Emergency Management
Agency, for the purpose of funding property acquisition, demolition, and reconstruction of the Dewey
Street bridge for the Lebow Channel Roadway Crossings project.
SECTION 2.
That should any portion, section or part of a section of this ordinance be declared invalid, inoperative or
void for any reason by a court of competent jurisdiction, such decision, opinion or judgment shall in no way
impair the remaining portions, sections, or parts of sections of this ordinance, which said remaining
provisions shall be and remain in full force and effect.
SECTION 3.
That this ordinance shall be cumulative of Ordinance No. 19355 and all other ordinances and appropriations
amending the same except in those instances where the provisions of this ordinance are in direct conflict
with such other ordinances and appropriations, in which instance said conflicting provisions of said prior
ordinances and appropriations are hereby expressly repealed.
SECTION 4.
This ordinanc&shall take effect upon adoption.

Authorize Acceptance and Execution of a Grant from the Department of Homeland Security, Federal
Emergency Management Agency in an Amount Not to Exceed $1,000,000.00 for Flood Migitation
Improvements on Lebow Channel, Authorize the Transfer of $333,333.33 from the Storm Water Capital
Projects 2009 Bond Fund to the Grant Capital Projects Fund Towards the Local Match and Adopt
Appropriation Ordinance (COUNCIL DISTRICT 2)
RECOMMENDATION:
It is recommended that the City Council:
1. Authorize acceptance and execution of a Legislative Pre - disaster Mitigation Funding Agreement with
the Department of Homeland Security, Federal Emergency Management Agency in an amount not to
exceed $1,000,000.00 to provide funding for property acquisition, demolition and reconstruction of the
Dewey Street bridge for the Lebow Channel Roadway Crossings project;
2. Authorize the transfer of $333,333.33 from the Storm Water Capital Projects 2009 Bond Fund to the
Grant Capital Projects Fund to be used towards the local match; and
3. Adopt the attached appropriation ordinance increasing estimated receipts and appropriations in the
Grant Capital Projects Fund in the amount of $1,333,333.33.
DISCUSSION:
The agreement recommended by this M &C will allow the City to accept a grant from the Federal
Emergency Management Agency (FEMA), in an amount up to $1,000,000.00, for the Lebow Channel
Roadway Crossing (Dewey Street only) project, and provide the minimum required matching funds from
the City in the amount of $333,333.33 which is being funded with Storm Water 2009 Revenue Bonds. The
drainage improvements are needed to reduce the risk of property and street flooding in the area as part of
a multi -phase plan to be implemented over the next 10 -15 years to mitigate flood risk along Lebow
Channel.
In December 2007, Congresswoman Kay Granger identified the City of Fort Worth as being eligible for a
grant under the Legislative Pre - Disaster Mitigation (LPDM) Program from FEMA, pending application by
the City and approval by FEMA, for the Lebow Channel Drainage Improvement project. On May 11, 2011,
the State of Texas and FEMA approved the City's application for funding.
The Department of Homeland Security, through FEMA, will make funding available for property
acquisition, demolition of structures, and reconstruction of the Dewey Street bridge for the portion of the
Lebow Channel Roadway Crossings project related to the Dewey Street bridge crossing. Two other
bridge crossings included in the Lebow Channel Roadway Crossings project — 28th Street and Brennan

Avenue — are not eligible for reimbursement under this grant award. As a condition of the federal grant,
and to remain eligible for continued funding, the Dewey Street project must be completed within three
years of award of the grant (two years plus one -year extension). The property acquisition has already
begun, with final closing and relocation projected to occur in six -12 months. The demolition phase will
begin after acquisition and relocation of existing occupants, and will be completed in approximately 12 -18
months. The design and permitting phases, although not in the FEMA grant reimbursement, are projected
to be completed in 12 -18 months as well. The construction phase is projected to begin in approximately 18
months and be completed before the expiration of the three -year FEMA time limit.
The federal grant is for an amount not to exceed $1,000,000.00 and will be funded on a reimbursement
basis. The terms of the grant require that the City of Fort Worth provide at least a 25 percent match for all
eligible expenses, resulting in a 75 percent/25 percent split between FEMA/City for eligible expenses. The
City will be responsible for any additional costs. The project funding consists of the following:

The Financial Management Services Director certifies that upon approval of the above recommendations,
receipt of the grant, and adoption of the attached appropriation ordinance, funds will be available in the
current capital budget, as appropriated, of the Grant Capital Projects Fund. Funds will be reimbursed by
the grantor after the expenditures are made.
