AN ORDINANCE INCREASING THE ESTIMATED RECEIPTS AND
APPROPRIATIONS IN THE WATER CAPITAL PROJECTS FUND IN THE AMOUNT
OF $135,482.60, FROM AVAILABLE FUNDS, FOR THE PURPOSE OF FUNDING
IMPROVEMENTS TO THE WATERLINE SERVING THE WEST SIDE OF SPINKS
AIRPORT; PROVIDING FOR A SEVERABILITY CLAUSE; MAKING THIS
ORDINANCE CUMULATIVE OF PRIOR ORDINANCES; REPEALING ALL
ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING AN EFFECTIVE
DATE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH,
TEXAS:
SECTION 1.
That in addition to those amounts allocated to the various City departments for Fiscal Year 2010 -2011 in the
Budget of the City Manager, there shall also be increased estimated receipts and appropriations in the Water
Capital Projects Fund in the amount of $135,482.60, from available funds, for the purpose of funding
improvements to the waterline serving the west side of Spinks Airport.
SECTION 2.
That should any portion, section or part of a section of this ordinance be declared invalid, inoperative or
void for any reason by a court of competent jurisdiction, such decision, opinion or judgment shall in no way
impair the remaining portions, sections, or parts of sections of this ordinance, which said remaining
provisions shall be and remain in full force and effect.
SECTION 3.
That this ordinance shall be cumulative of Ordinance No. 19355 and all other ordinances and appropriations
amending the same except in those instances where the provisions of this ordinance are in direct conflict
with such other ordinances and appropriations, in which instance said conflicting provisions of said prior
ordinances and appropriations are hereby expressly repealed.
SECTION 4.
This ordinance shall take effect upon adoption.

Authorize the Transfer of Funds from the Airports Gas Lease Project Fund to the Water Capital Projects
Fund in the Amount of $135,482.60 for Improvements to the Waterline Serving the West Side of Spinks
Airport to Accommodate the Development of Hangars and Adopt Appropriation Ordinance (COUNCIL
DISTRICT 8)
RECOMMENDATION:
It is recommended that the City Council:
1. Authorize the transfer of funds from the Airports Gas Lease Project Fund to the Water Capital Projects
Fund in the amount of $135,482.60 for improvements to the waterline serving the west side of Spinks
Airport to accommodate the development of hangers; and
2. Authorize the adoption of the attached appropriation ordinance increasing estimated receipts and
appropriations in the Water Capital Projects Fund in the amount of $135,482.60, from available funds.
DISCUSSION:
On March 28, 2006, M &C C- 21373, City Council approved a ground lease agreement with mandatory
improvements with Clendenen Development Company and Westside Two, LLC, on the west side of Fort
Worth Spinks Airport. Phase One of this project consisted of the construction of a 31,200 square foot
hangar. The hangar was built and the certificate of occupancy was issued December 4, 2008. Phase Two
of this Agreement consisted of three additional hangars which have yet to be constructed.
In the lease Agreement it states: Lessor covenants and agrees to pay all costs and expenses for any
extension, maintenance or repair of any and all utility main lines serving the Premises. Lessee agrees that
all utilities shall fully comply with Lessor's Mechanical, Electrical, Plumbing, Building and Fire Codes, as
they exist or may hereafter be amended. Pursuant to the lease terms, the City is requiring that the tenant
comply with all Codes, yet the size of buildings that M &C C -21373 authorized in 2006 would require more
water demand than what the current water line can offer.
Adequate fire suppression cannot be achieved with the current eight -inch water line that is in place for
these future buildings, and therefore a building permit cannot be issued. It has been determined that a
twelve -inch water line is the minimum size required to satisfy the fire suppression of these buildings.
On December 28, 2008, (M &C G- 16371), City Council authorized the use of existing revenue derived from
natural gas well leases on City -owned Airport Properties in the amount of $900,000 for water and sewer
infrastructure improvements at Fort Worth Spinks Airport. Funds authorized by (M &C G- 16371) will be
accessed for this project. This M &C has been drafted to transfer the previously approved funds, in the
amount of $135,482.60, into the Water Capital Projects Fund.

The total cost of this project is $181,700.00 plus $15,982.60 contingency, with the Aviation Department
paying $135,482.60 and the Water Department paying $62,200.00. The Water Department's portion is
being paid from funds already appropriated for such a purpose.
This property is located in COUNCIL DISTRICT 8.
FISCAL INFORMATION / CERTIFICATION:
The Financial Management Services Director certifies that upon approval of the above recommendations
and adoption of the attached appropriation ordinance, funds will be available in the current capital budget,
as appropriated, of the Water Capital Projects Fund.
