HomeMy WebLinkAboutOrdinance 19909-09-2011ORDINANCE NO. 19909-09-2011 AN ORDINANCE AMENDING THE CODE OF THE CITY OF FORT WORTH (1986), AS AMENDED, CHAPTER 35 "WATER AND SEWERS ", SECTION 35 -56, "WATER AND SEWER RATES WITHIN THE CITY" BY AMENDING SUBSECTIONS (g) THROUGH (j); BY ADDING SUBSECTION (k); PROVIDING THAT THIS ORDINANCE SHALL BE CUMULATIVE; PROVIDING A SEVERABILITY CLAUSE; AND PROVIDING AN EFFECTIVE DATE BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH: SECTION 1. That Section 35 -56(g) of Chapter 35 of the Code of the City of Fort Worth (1986), as amended, is hereby further amended to be and read as follows: (g) The following schedule of rates per month, or fraction thereof, shall be the charges to all wholesale customers for furnishing water to such customers: RATES FOR WHOLESALE WATER SERVICE Volume ($ /1,000 gallons)* $0.7735 Maximum Day ($/MGD excess) $148,810.00 Maximum Hour ($ /MGD excess) $12,799.00 Customer ($ /Meter/Month) $25.00 *plus raw water cost RAW WATER SERVICE All use inside Tarrant Regional Water District shall be $0.93648 per 1,000 gallons per month. All use outside Tarrant Regional Water District shall be $0.96264 per 1,000 gallons per month. SECTION 2. That Section 35 -56(h) of Chapter 35 of the Code of the City of Fort Worth (1986) as amended is hereby further amended to be and read as follows: (h) The following schedule of rates per month, or fraction thereof, shall be the charges to all wholesale customers for furnishing wastewater services to such customers: CRR082411 v2 RATES FOR WHOLESALE WASTEWATER SERVICE Volume ($ /1,000 gallons) $0.8093 BOD ($ /pound) $0.3653 TSS ($ /pound) $0.1552 Customer ($ /month) $75.00 SECTION 3. That Section 35 -56(h) of Chapter 35 of the Code of the City of Fort Worth (1986) as amended, is hereby further amended by the addition of subsection (i) to provide for a Standby Charge and the re- lettering of the previous subsections (i) and 0) to be and read as follows: (i) The Standby Charge per month shall be $0.7104 per 1,000 gallons. 0) The following schedule of rates per month, or fraction thereof, shall be the charges to all wholesale customers for furnishing reclaimed water to such customers: RATES FOR WHOLESALE RECLAIMED WATER SERVICE Volume ($ /1,000 gallons) October 1, 2010 to September 30, 2012 $1.45 October 1, 2012 to September 30, 2014 $1.50 Starting October 1, 2014, the wholesale reclaim water service rates shall increase by five (5) percent annually until such time as the cumulative amount of the annual system deficits has been recovered. The customer shall be charged on a monthly basis the volume rate charge multiplied by a minimum fifty percent (50 %) of the customer's contracted average monthly amount (annual amount divided by twelve (12) months) in order to establish a minimum cash flow to meet the operating and debt expenditures for the system. (k) A permit /contract fee up to five thousand dollars ($5,000.00) will be assessed for a ground water remediation discharge permit. The term of the permit /contract shall not exceed two (2) years. In addition to a volume charge based on current rates, a monthly service fee of four dollars and fifty cents ($4.50) will be assessed. SECTION 4. This ordinance shall be cumulative of all provisions of ordinances and of the Code of the City of Fort Worth, Texas (1986), as amended, except where the provisions of this ordinance are in direct conflict with the provisions of such ordinance and such Code, in which event conflicting provisions of such ordinances and such Code are hereby repealed. It is hereby declared to be the intention of the City Council that the sections, paragraphs, sentences, clauses and phrases of this ordinance are severable, and, if any phrase, clause, sentence, paragraph or section of this ordinance shall be declared unconstitutional by the valid judgment or decree of any court of competent jurisdiction, such unconstitutionality shall not affect any remaining phrases, clauses, sentences, paragraphs and sections of this ordinance, since the same would have been enacted by the City Council without the incorporation in this ordinance of any such unconstitutional phrase, clause, sentence, paragraph or section. DISCUSSION: Each year, wholesale water and wastewater rate studies are prepared in accordance with the terms of the standard wholesale customer contracts. For Fiscal Year 2012, the wholesale water cost of service study was completed by Red Oak Consulting. The wholesale wastewater cost of service study was performed by Water Department staff based on the wholesale water cost of service study completed by Red Oak Consulting for Fiscal Year 2011. The result of these studies indicated the rates, as proposed below, will recover the cost of providing wholesale water and wastewater service. A joint meeting of the Wholesale Water Advisory Committee and the Wholesale Wastewater Advisory Committee was held July 14, 2011, to present the studies and the rates.
