AN ORDINANCE VACATING AND EXTINGUISHING PORTIONS OF
BELLAIRE DRIVE NORTH, WABASH AVENUE AND A PORTION OF
AN ALLEY, SITUATED IN THE WADE HUDSON SURVEY, ABSTRACT
NO. 717 AND THE JAMES SMITH SURVEY, ABSTRACT NO. 1383, IN
THE CITY OF FORT WORTH, TARRANT COUNTY, TEXAS, AND
CONTAINING APPROXIMATELY 62,023 SQUARE FEET, 11,515
SQUARE FEET AND 3,009 SQUARE FEET RESPECTIVELY AND AS
RECORDED IN CABINET A, SLIDE 4483, INSTRUMENT NUMBER
D209113172 AND VOLUME 310, PAGE 49 OF THE REAL PROPERTY
RECORDS OF TARRANT COUNTY, TEXAS, PROVIDING FOR THE
REVERSION OF FEE IN SAID LAND; THE RETAINMENT OF EXISTING
UTILITY EASEMENTS; REPEALING ALL ORDINANCES IN CONFLICT
HEREWITH; AND PROVIDING AN EFFECTIVE DATE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH,
TEXAS:
SECTION 1.
1. That a portion of Bellaire Drive North, situated in the Wade Hudson Survey, Abstract
No.717 and the James Smith Survey, Abstract No. 1383, as shown on TCU Addition, an
addition to the City of Fort Worth, Tarrant County, Texas, as recorded in Cabinet A, Slide
4483 of the Real Property Records of Tarrant County, Texas and containing 62,023 square
feet or 1.424 acres of land, and as more specifically described in Exhibits A attached hereto
and incorporated herein by reference, be and the same is vacated and extinguished.
2. That a portion of Wabash Avenue, situated in the James Smith Survey, Abstract No. 1383
in the City of Fort Worth, Tarrant County, Texas, as recorded in Instrument No.
D209113172 of the Real Property Records of Tarrant County, Texas, and containing
11,515 square feet or 0.2873 acre of land and as more specifically described in Exhibits B
attached hereto and incorporated herein by reference, be and the same is vacated and
extinguished.

3. That a portion of an alley, situated in the James Smith Survey, Abstract No. 1383, as shown
on Block 9, Forest Park Addition, an addition to the City of Fort Worth, Tarrant County,
Texas, as recorded in Volume 310, Page 49 of the Real Property Records of Tarrant
County, Texas and containing 3,009 square feet or 0.0691 acres of land, and as more
specifically described in Exhibits C attached hereto and incorporated herein by reference,
be and the same is vacated and extinguished.
SECTION 2.
That the fee to the land in the above-described street right-of-way and public access
easement is released and shall revert to the adjacent owner as provided by law.
SECTION 3.
That all existing utility easements shall be retained by the City until such time all utilities
located in that easement are relocated at the owner's expense.
SECTION 4.
That all ordinances or parts of ordinances in conflict herewith are hereby repealed.
SECTION 5.
That this ordinance shall take effect upon adoption.

THENCE North 89 degrees 32 minutes 00 seconds East, along the common northerly right—of—way line of said
Bellaire Drive North and the southerly line of said Block 2, a distance of 975.74 feet to a 5/8 Inch Iron rod with
cap stamped 'Dunaway Assoc LP" set for corner;
THENCE South 00 degrees 30 minutes 55 seconds East, departing said common line and crossing said Bellaire Drive

SUBJECT:
Adopt Ordinance Vacating a Portion of Belliare Drive North, Wabash Avenue and an Alley in Block 9,
Forest Park Addition to be Replatted with the Adjoining Property for a New Administration Building and
Parking on the Texas Christian University (TCU) Campus (COUNCIL DISTRICT 3)
RECOMMENDATION:
It is recommended that the City Council:
1. Adopt the attached ordinance vacating a portion of Belliare Drive North, Wabash Avenue and an alley
in Block 9, Forest Park Addition to be replatted with the adjoining property for a new administration
building and parking on the Texas Christian University (TCU) campus; and
2. Waive any and all purchase fee value of the vacated land in accordance with City policy.
DISCUSSION:
JB Davies, Inc., on behalf of Texas Christian University, has requested vacation of these streets and alley
to be replatted with the adjoining property for a new administration building and additional parking for the
TCU campus. The City Plan Commission recommended approval of this request at its meeting on April
25, 2018. An acceptable final plat (FS -18-044) has been received in accordance with the Subdivision
Ordinance.
The City of Fort Worth (City) originally obtained the above mentioned right-of-way through plat
dedication. The City does not own any fee interest in the rights-of-way or own any property adjacent to
the right-of-way and did not expend any City funds to purchase the right-of-way easement. In accordance
with the City's policy regarding street and alley vacation transactions approved by the City Council on
March 6, 2007, Mayor and Council Communication (M&C G-15624), staff recommends waiving the fair
