HomeMy WebLinkAboutOrdinance 19927-09-2011Ordinance No. 19927-09-2011 AN ORDINANCE INCREASING THE ESTIMATED RECEIPTS AND APPROPRIATIONS IN THE SEWER CAPITAL PROJECTS FUND IN THE AMOUNT OF $627,021.00, FROM AVAILABLE FUNDS, FOR THE PURPOSE OF FUNDING SANITARY SEWER REPLACEMENT MAIN 253, PART 2 IN RANDOL MILL ROAD AND MALLARD COVE PARK; PROVIDING FOR A SEVERABILITY CLAUSE; MAKING THIS ORDINANCE CUMULATIVE OF PRIOR ORDINANCES; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. That in addition to those amounts allocated to the various City departments for Fiscal Year 2010 -2011 in the Budget of the City Manager, there shall also be increased estimated receipts and appropriations in the Sewer Capital Projects Fund in the amount of $627,021.00, from available funds, for the purpose of funding Sanitary Sewer Replacement Main 253, Part 2 in Randol Mill Road and Mallard Cove Park. SECTION 2. That should any portion, section or part of a section of this ordinance be declared invalid, inoperative or void for any reason by a court of competent jurisdiction, such decision, opinion or judgment shall in no way impair the remaining portions, sections, or parts of sections of this ordinance, which said remaining provisions shall be and remain in full force and effect. SECTION 3. That this ordinance shall be cumulative of Ordinance No. 19355 and all other ordinances and appropriations amending the same except in those instances where the provisions of this ordinance are in direct conflict with such other ordinances and appropriations, in which instance said conflicting provisions of said prior ordinances and appropriations are hereby expressly repealed. SECTION 4. This ordinance shall take effect upon adoption. Authorize the transfer of $627,021.00 from the Water and Sewer Operating Fund to the Sewer Capital Projects Fund; 2. Adopt the attached appropriation ordinance increasing estimated receipts and appropriations in the Sewer Capital Projects Fund in the amount of $627,021.00 from available funds; and 3. Execute a contract with Ark Contracting Services, LLC, in the amount of $4,066,142.00 for Sanitary Sewer Replacement Main 253, Part 2. DISCUSSION: On July 29, 2003, (M &C C- 19678) City Council authorized an Engineering Agreement with TranSystems Corporation, d /b /a TranSystems Corporation Consultants, for the design of the South Shore Sanitary Sewer Main 253 Replacement from the Woodhaven Boulevard - Randol Mill Road intersection easterly to the Village Creek Wastewater Treatment Plant. The project is planned to be constructed in three separate parts. Construction of Part 1 is expected to be complete in September 2011. The construction contract for Part 2 consists of installation of nearly 10,000 LF of 42 -inch sanitary sewer main in Randol Mill Road, along the Trinity River and through Mallard Cove Park from approximately Precinct Line Road to the west boundary of the Northeast Landfill. This project is part of the Sanitary Sewer Overflow Initiative with the TCEQ. The project was advertised for bid on June 9, 2011 and June 16, 2011 in the Fort Worth Star-Telegram. On July 7, 2011, the following bids were received: Bidder Ark Contracting Services, LLC S. J. The City's goal on this project is 25 percent. Most State Revolving Loans are granted for construction contracts only. However with this particular loan the City of Fort Worth was authorized to pay for both an engineering agreement (design and survey) and the construction contract. Since no other expenses can be covered by SRF funding, additional appropriations of $627,021.00 ($309,214.00 for land acquisition, $114,500.00 for construction staking, project management material testing and inspection and $203,307.00 for project contingencies) are needed from the Sewer Capital Projects Fund. The project is located in COUNCIL DISTRICTS 4 and 5 MAPSCO map 67N, P and Q. FISCAL INFORMATION / CERTIFICATION: The Financial Management Services Director certifies that upon approval of the above recommendations, and the adoption of the attached appropriation ordinance, funds will be available in the current capital budgets, as appropriated, of the Sewer Capital Projects Fund and The Clean Water State Revolving Fund 2007 Series.
