AN ORDINANCE INCREASING ESTIMATED RECEIPTS AND APPROPRIATIONS IN THE
CULTURE AND TOURISM DFW REVENUE SHARE CAPITAL FUND IN THE AMOUNT OF
$1,931,050.00, FROM AVAILABLE FUNDS, FOR THE WILL ROGERS MEMORIAL
CENTER PIONEER TOWER REHABILTATION PROJECT; PROVIDING FOR A
SEVERABILITY CLAUSE; MAKING THIS ORDINANCE CUMULATIVE OF PRIOR
ORDINANCES; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH; AND
PROVIDING AN EFFECTIVE DATE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS:
SECTION 1
That in addition to those amounts allocated to the various City departments for Fiscal Year 2018-2019 in the
Budget of the City Manager, there shall also be increased estimated receipts and appropriations in the Culture
and Tourism DFW Revenue Share Capital Fund in the amount of $1,931,050.00, from available funds, for the
Will Rogers Memorial Center pioneer tower rehabilitation project.
SECTION 2.
That should any portion, section or part of a section of this ordinance be declared invalid, inoperative or void
for any reason by a court of competent jurisdiction, such decision, opinion or judgment shall in no way impair
the remaining portions, sections, or parts of sections of this ordinance, which said remaining provisions shall
be and remain in full force and effect.
SECTION 3.
That this ordinance shall be cumulative of Ordinance 23392-09-2018 and all other ordinances and
appropriations amending the same except in those instances where the provisions of this ordinance are in
direct conflict with such other ordinances and appropriations, in which instance said conflicting provisions of
said prior ordinances and appropriations are hereby expressly repealed.
SECTION 4
This ordinance shall take effect upon adoption.

Muckleroy & Falls, in the Not -to -Exceed Amount of $3,319,781.00, Including 7.5% Owner's Contingency
Allowance and a $325,000.00 Allowance for Public Art, to Provide Construction Services for the
Rehabilitation of the Pioneer Tower at the Will Rogers Memorial Center, Total Cost for the Project,
Including Project Management Administration is $3,756,050.00 and Adopt Appropriation Ordinance
(COUNCIL DISTRICT 7)
RECOMMENDATION:
It is recommended that the City Council:
1) Authorize the transfer of $1,931,050.00 of available appropriated funds from the Culture and Tourism
Project Finance Zone to the Culture and Tourism DFW Revenue Share Capital Fund to provide additional
funding for the Pioneer Tower rehabilitation project;
2) Adopt the attached appropriation ordinance in the amount of $1,931,050.00 increasing estimated
receipts and appropriations in the Culture & Tourism DFW Revenue Share Capital fund for the
Rehabilitation of the Pioneer Tower at the Will Rogers Memorial Center; and
3) Authorize execution of a Construction Manager at Risk Construction (CMAR) contract with HM & MF
Ltd. d/b/a Muckleroy & Falls, in the not -to -exceed amount of $3,319,718.00.00, including 7.5% Owner's
Contingency Allowance and a $325,000.00 allowance for Public Art, to provide construction services for
the Rehabilitation of the Pioneer Tower at the Will Rogers Memorial Center.
DISCUSSION:
The purpose of this M&C is to authorize execution of a Construction Manager at Risk Construction
Contract with HM & MF Ltd. d/b/a Muckleroy & Falls, in the not -to -exceed amount of $3,319,781.00,
including 7.5% Owner's Contingency Allowance and a $325,000.00 allowance for Public Art, to Provide
Construction Services for the Rehabilitation of the Pioneer Tower at the Will Rogers Memorial Center. The
$325,000.00 allowance will be funded through the City's Public Art Program and will cover any cost
associated with construction infrastructure required to support the public art. This is a not to exceed
amount and does not commit this amount to be spent.
Noted Fort Worth architect Wyatt C. Hedrick designed the 208 foot tall Pioneer Tower and adjacent
buildings of the Will Rogers Memorial Center for the Texas Centennial celebration in 1936. The tower is
on the National Register of Historic Places. It stands as the centerpiece of the Will Rogers Memorial
Center and of the Fort Worth Cultural District. The tower is built of concrete framing, cladded with
limestone and brick. The corners are accentuated with stepped pilasters, lighted lanterns and crowned
with an aluminum cap. At the base of the tower there is a large room with a high domed ceiling and a
bronze bust of Will Rogers. Originally the tower had a vertical strip of glass block which was back lit at

night on all four sides. Over the years occasional movement and other forces placed stress on the block
and many of them have broken. At some point in the past, rather than repair the block, the glass block
was covered with aluminum louvers.
On June 12, 2018 (M&C C-28724), Council authorized an Architectural Service Agreement with Elements
of Architecture to produce design documents to make structural repairs, replace the broken glass block,
provide design, estimating and construction management for a new lighting system for the tower, provide
cleaning and other associated work for the restoration of the Pioneer Tower. It was determined that
engaging a contractor early on this project to assist with the design and cost estimating would be
beneficial. A request for Statement of Qualifications (SOQ) for a Construction Manager at Risk (CMAR)
contractor was advertised in the Fort Worth Star - Telegram on April 19, 2018 and April 26, 2018. The City
received SOQs from 4 offerors, listed below:

• RJM Contractors, Inc.
• Scott Tucker Construction Company, LLC
• Thos. S. Byrne, Inc., d/b/a/ Byrne Construction Services
A selection team, comprised of representatives of the Public Events Department, the architect, Property
Management Department and the MWBE Office reviewed the SOQs. After individual review and
consideration, the selection team met to review a detailed comparison of the cost of services, experience
and review of references.

In the M&C that authorized the award of the design contract (M&C C-28724, June 12, 2018), staff advised
that in order to meet the aggressive schedule to have the tower rehabilitated before the Dickies Arena
completion, a pre -construction services contract would be administratively awarded to the recommended
CMAR contractor. This agreement was administratively awarded to Muckleroy & Falls on July 2, 2018, in
the amount of $7,500.00. As the design progressed, it became apparent that several mock-ups would be
needed to visualize the options available for the glass block and lighting. A construction contract for the
lighting mock-up was administratively awarded to Muckleroy & Falls for $89,932.00 on November 21,
2018.
Staff recommends that City Council authorize execution of a Construction Manager at Risk (CMAR)
Construction Contract with HM & MF Ltd. d/b/a Muckelroy & Falls for rehabilitation of the Pioneer Tower.

Operating - The Pioneer Tower Rehabilitation is projected to be complete in October 2019, and is
expected to have a negligible impact on the electrical use at the Will Rogers Memorial Center.
Source of Funds - On August 14, 2018 M&C G-19341 authorized an original appropriation of
$1,500,000.00 for the project. The purpose of this M&C is to appropriate the additional $1,931,050.00 to
complete the project. A Transfer from the Project Finance Zone Operating Fund will provide the additional
funding to the DFW Revenue Share Capital Fund for the Pioneer Tower Rehabilitation project.
M/WBE Office — HM & MF Ltd. d/b/a Muckleroy & Falls is in compliance with the City's BDE Ordinance by
committing to 25% MBE participation on this CMAR project. The City's MBE goal on this CMAR project is
15%.
Schedule — This construction work will start following the 2019 Stock Show and be completed before the
opening of the new Dickies Arena in November of 2019.
Fees - In accordance with Chapter 7, Article III, Section 7-47, Section 109.2.1 of the City Code, Building,
Trade Permit Fees and Impact and Street Closure Fees are waived for this project.
The Will Rogers Memorial Center is located in COUNCIL DISTRICT 7.
FISCAL INFORMATION / CERTIFICATION:
The Director of Finance certifies that upon approval of the above recommendations and adoption of the
attached appropriation ordinance, funds will be available as appropriated in the Culture and Tourism DFW
Revenue Share Capital Fund.
