CALL TO ORDER With a quorum of the City Council Members present, Mayor Price called the regular session of the Fort Worth City Council to order at 7:03 p.m. on Tuesday, January 29, 2019, in the City Council Chamber of the Fort Worth City Hall, 200 Texas Street, Fort Worth, Texas. II. INVOCATION—Imam Talib Salahuddin, Masiid Hassan Al-Islam The invocation was provided by Imam Talib Salahuddin, Masjid Hassan Al-Islam. III. PLEDGES OF ALLEGIANCE TO THE UNITED STATES AND THE STATE OF TEXAS The Pledges of Allegiance to the United States of America and the State of Texas were recited. IV. CONSIDERATION OF THE MINUTES OF THE CITY COUNCIL REGULAR MEETING OF JANUARY 15,2019 Motion: Council Member Byrd made a motion, seconded by Mayor Pro tem Shingleton, that the minutes of the Regular meeting of January 15, 2019, be approved. Motion passed 8-0, one abstention from Mayor Price. V. ITEMS TO BE WITHDRAWN FROM THE CONSENT AGENDA There were no items to be withdrawn from the Consent Agenda. M&C G-19453 - Adopt Resolution No. 5033-01-2019 Authorizing an Increase of$50,000.00 in the Total Amount to be Paid to the Law Firm of Kelly Hart & Hallman, LLP, as Outside Legal Counsel for Legal Matters Relating to Lawsuits Challenging the City's Game Room Ordinances for a Total Amount of$410,000.00 (ALL COUNCIL DISTRICTS) 3. A Resolution of the City Council of the City of Fort Worth, Texas, Canceling the Regularly Scheduled City Council Work Session and City Council Meeting on Tuesday, February 19, 2019 Motion: Mayor Pro tem Shingleton made a motion, seconded by Council Member Flores, that Resolution No. 5037-01-2019 be adopted. Motion passed 9-0. 2. A Resolution Appointing a Resident of the City of Fort Worth to Place 8, Place 10, Place 11 and Place 12 on the Board of Trustees of the City of Fort Worth Employees' Retirement Fund Motion: Council Member Jordan made a motion, seconded by Mayor Pro tem Shingleton, that Resolution No. 5038-01-2019 be adopted. Motion passed 9-0. IV. REPORT OF THE CITY MANAGER B. General 1. M&C G-19463 - Adopt Resolution Establishing an Economic Development Program Authorized by Chapter 380 of the Texas Local Government Code and Adopt New Economic Development Program Policy (ALL COUNCIL DISTRICTS) otion: Council Member Allen Gray made a motion, seconded by Council Member Zadeh, that Mayor and Council Communication G-19463 be approved and Resolution No. 5039-01-2019 establishing an Economic Development Program and a new Economic Development Program Policy, including guidelines and criteria governing certain economic development loans and grants made by the City of Fort Worth, as authorized by Chapter 380 of the Texas Local Government Code with the following revisions: Section 15.1 of the Policy will be revised to read: All projects receiving 380 Grants must make a commitment to utilize Certified M/WBE Companies for a minimum of 15% of all construction costs (both hard and soft) associated with the project. Failure to meet the goal will result in a reduction in the calculation of the maximum 380 Grant each by 10 percentage points be adopted as amended. Motion passed 9-0. M&C G-19464 - Adopt Resolution Stating the City of Fort Worth Elects to be Eligible to Participate in Tax Abatement Authorized by Chapter 312 of the Texas Tax Code and Adopt New General Tax Abatement Policy (ALL COUNCIL DISTRICTS) Motion: Council Member Allen Gray made a motion, seconded by Council Member Bivens, that Mayor and Council Communication G-19464 be approved and Resolution No. 5040-01-2019 stating that the City elects to be eligible to participate in property tax abatement, pursuant to the Texas Property Redevelopment and Tax Abatement Act, Chapter 312 of the Texas Tax Code, as amended; and adopting the updated General Tax Abatement Policy, including guidelines and criteria, governing certain property tax abatements granted by the City of Fort Worth with the following revisions: Section 11.1 of the Policy will be revised to read: All projects subject to Tax Abatement must make a commitment to utilize Certified M/WBE Companies for a minimum of 15% of all construction costs (both hard and soft) associated with the project. Failure to meet the goal will result in a reduction of the overall percentage of Abatement available under the Tax Abatement Agreement of 10% be adopted as amended. Motion passed 8-1, Council Member Byrd casting the dissenting vote. 3. M&C G-19465 - Adopt Ordinances Amending Section 10-3 "Judges, Chief Judge, Chief Prosecutor" of Chapter 10 "Courts" of the City Code to add Provisions Regarding the Appointment and duties of a Deputy Chief Judge and Appointing Simon Gonzalez as Deputy Chief Judge as Recommended by the Ad Hoc Municipal Court Advisory Committee and Setting the Salary for the Deputy Chief Judge (ALL COUNCIL DISTRICTS) Motion: Council Member Zadeh made a motion, seconded by Council Member Moon, that Mayor and Council Communication G-19465 be approved and Ordinance Nos. 23546-01-2019 and 23547-01-2019 be adopted. Motion passed 9-0. 4. M&C G-19466 - Adopt Ordinance Authorizing Issuance and Sale of City of Fort Worth, Texas Drainage Utility System Revenue Refunding Bonds, Series 2019, in an Aggregate Principal Amount Not to Exceed $33,000,000.00, Establishing Parameters with Respect to Sale of the Bonds, Delegating to Designated City Officials Authority to Effect Sale of the Bonds, Authorizing Escrow and Other Related Agreements, Enacting Other Provisions Relating to the Subject, and Declaring an Immediate Effective Date, and Adopt Appropriation Ordinances (ALL COUNCIL DISTRICTS) Motion: Council Member Jordan made a motion, seconded by Council Member Allen Gray, that Mayor and Council Communication G-19466 be approved and Ordinance No. 23548-01-2019 and Appropriation Ordinance Nos. 23549-01-2019 and 3550-01-2019 be adopted. M&C G-19468 - Adopt Resolution to Dissolve and Terminate all Existing Neighborhood Empowerment Zones and Adopt Ordinance to Terminate and Repeal all Existing Neighborhood Empowerment Reinvestment Zones(COUNCIL DISTRICTS 2,3, 4, 5, 8 and 9) otion: Council Member Bivens made a motion, seconded by Council Member Byrd, that Mayor and Council Communication G-19468 be approved and Resolution No. 5041-01-2019 and Ordinance No. 23551-01-2019 be adopted.
