HomeMy WebLinkAboutOrdinance 23533-01-2019Ordinance No. 23533-01-2019 AN ORDINANCE INCREASING ESTIMATED RECEIPTS AND APPROPRIATIONS IN THE SPECIAL PURPOSE FUND, IN AN AMOUNT UP TO $130,000.00, SUBJECT TO RECEIPT OF FUNDS, FOR ALLOCATION PAYMENT FROM LAW ENFORCEMENT OFFICER STANDARDS AND EDUCATION ACCOUNT; PROVIDING FOR A SEVERABILITY CLAUSE; MAKING THIS ORDINANCE CUMULATIVE OF PRIOR ORDINANCES; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. That in addition to those amounts allocated to the various City departments for Fiscal Year 2018-2019 in the Budget of the City Manager, there shall also be increased estimated receipts and appropriations in the Special Purpose Fund in an amount up to $130,000.00, subject to receipt of funds, for the allocation payment from law enforcement officer standards and education account. SECTION 2. That should any portion, section or part of a section of this ordinance be declared invalid, inoperative or void for any reason by a court of competent jurisdiction, such decision, opinion orjudgment shall in no way impair the remaining portions, sections, or parts of sections of this ordinance, which said remaining provisions shall be and remain in full force and effect. SECTION 3. That this ordinance shall be cumulative of Ordinance 23392-09-2018 and all other ordinances and appropriations amending the same except in those instances where the provisions of this ordinance are in direct conflict with such other ordinances and appropriations, in which instance said conflicting provisions of said prior ordinances and appropriations are hereby expressly repealed. Authorize the acceptance of the Fiscal Year 2019 allocation payment from the State of Texas Law Enforcement Officer Standards and Education Program in the amount up to $130,000.00; and 2. Adopt the attached appropriation ordinance increasing estimated receipts and appropriations in the Special Purpose Fund in an amount up to $130,000.00 subject to receipt of the funds. DISCUSSION: The State Comptroller of Public Accounts is directed, under Section 1701.157 of the Texas Occupations Code, to make allocations from the Law Enforcement Officer Standards and Education (LEOSE) account to qualified law enforcement agencies. Section 1701.157 of the Texas Occupations Code sets forth the two permissible uses of LEOSE funds. Funds received from the LEOSE account may be used to provide for the continuing education of licensed law enforcement officers. Additionally, LEOSE funds may be used to provide necessary training, as determined by the Chief of Police, to full-time law enforcement support personnel within the Fort Worth Police Department. Twenty percent of the LEOSE funds are allocated to all local law enforcement agencies in Texas in equal shares. Eighty percent of the LEOSE funds are allocated to local law enforcement agencies based on the Agency's ability to meet certain statutory requirements. The Fort Worth Police Department qualified for the annual LEOSE allocation. The allocation is derived from the LEOSE account funded through court costs collected in criminal cases. The Fort Worth Police Department anticipates to receive no more than $130,000.00 LEOSE allocation for fiscal year 2019. Funds are received by March of each year. The Police Department has the responsibility to verify the receipt of funds and notify the Performance and Budget Office when received so they may be appropriated.
