HomeMy WebLinkAboutOrdinance 23536-01-2019Ordinance No. 23536-01-2019 AN ORDINANCE INCREASING ESTIMATED RECEIPTS AND APPROPRIATIONS IN THE AVIATION GAS LEASE CAPITAL PROJECT FUND, FROM AVAILABLE FUNDS IN THE AMOUNT UP TO $183,920.00, FOR THE AIRPORT PROPERTY FENCING PROJECT; PROVIDING FOR A SEVERABILITY CLAUSE; MAKING THIS ORDINANCE CUMULATIVE OF PRIOR ORDINANCES; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1 That in addition to those amounts allocated to the various City departments for Fiscal Year 2018-2019 in the Budget of the City Manager, there shall also be increased estimated receipts and appropriations in the Aviation Gas Lease Capital Project Fund, from available funds in the amount up to $183,920.00, to provide the Airport Property Fencing Project. SECTION 2. That should any portion, section or part of a section of this ordinance be declared invalid, inoperative or void for any reason by a court of competent jurisdiction, such decision, opinion or judgment shall in no way impair the remaining portions, sections, or parts of sections of this ordinance, which said remaining provisions shall be and remain in full force and effect. SECTION 3. That this ordinance shall be cumulative of Ordinance 23392-09-2018 and all other ordinances and appropriations amending the same except in those instances where the provisions of this ordinance are in direct conflict with such other ordinances and appropriations, in which instance said conflicting provisions of said prior ordinances and appropriations are hereby expressly repealed. Authorize the use of revenue derived from mineral leases on City -owned airports in the amount of $183,920.00 for cost associated with fencing to secure airport property previously acquired through the Federal Aviation Administration's Part 150 Noise Program at Meacham International Airport; and 2. Adopt the attached appropriation ordinance increasing estimated receipts and appropriations in the Aviation Gas Lease Capital Project Fund, from available funds in the amount of $183,920.00 for the fencing project. DISCUSSION: On April 6, 1993 (M&C G-10116), the City Council approved the adoption of the Federal Aviation Regulation Part 150 Noise Study for Fort Worth Meacham International Airport (Airport). The Noise Study program was purposed with determining the impacts of noise on private residences located within the immediate proximity of the Runway Protection Zone located at the south end of Runway 17/35. On September 10, 2002 (M&C G-13729), the City Council approved the acceptance of Federal Aviation Administration grant funds for one of two phases to acquire property heavily impacted by aviation noise activity and incorporate the area into the airport boundary for aviation reuse. On August 24, 2004 (M&C G-14473), the City Council approved the acceptance of additional Federal Aviation Administration grant funds for the second phase of property acquisition off the south end of Runway 17/35. Since the acquisition of properties, the area incorporated into the boundaries of the airport have remained vacant in accordance with the Airport Layout Plan. Future plans show to extend Runway 17/35 to the south which necessitates the need to keep the federally funded, acquired parcels vacant for future airport use. The Aviation Department is seeking Council approval to authorize the use of revenue derived from mineral leases for the purpose of securing the property with fencing and gates. The Airport has continuously monitored the unsecured property and has surveilled various illegal activities including dumping, prostitution, drug related activities, and discharging firearms. Securing the vacant property will improve the overall security of the Airport and improve Public Protection in accordance with the Code of Logname: 55FTW AIRPORT PROPERTY FENCING Page 1 of 2 Federal Regulations Title 14 Part 139. The Aviation Department is using a current Annual Agreement with Cleburne Fencing to complete the project. This project was not included in the Aviation Department's Five -Year Capital Improvement Plan (CIP) for fiscal year 2019-2023 as approved by City Council on September 18, 2018 and the Aviation Department is seeking approval to add this capital project. The Park and Recreation Department previously maintained the vacant property, providing the Airport the ability to monitor and patrol it. Due to costs associated with maintenance, the Park and Recreation Department notified Aviation about a termination of services in late fall 2018. The Airport is seeking approval to proceed with the fencing project in order to reduce the illegal activities taking place on the property. Fort Worth Meacham International Airport is located in COUNCIL DISTRICT 2. This M&C does not request approval of a contract with a business entity.
