DENTON,PARKER AND WISE § RECEIVED SECOND EXTENSION TO INTERLOCAL AGREEMENT(CITY SECRETARY FEB —7 2019 CONTRACT NO.37987)WITH THE TARRANT REGIONAL WATER DISTRICT FOR CITY OFFORTWOR'fN THE USE OF AND MODIFICATION OF A RADIO TOWER C►TY5ECRETARY THIS SECOND EXTENSION TO INTERLOCAL AGREEMENT (CITY c� SECRETARY CONTRACT NO. 37987 WITH THE TARRANT REGIONAL WATER 1 " " Of 6 8 L DISTRICT FOR THE USE OF AND MODIFICATION OF A RADIO TOWER is entered into by and between the City of Fort Worth ("City "), a home-rule municipality in the State of Texas, acting through Jesus Chapa, its duly authorized Assistant City Manager, and the Tarrant Regional Water District ("District"), by and through James Oliver, its duly authorized General Manager. WHEREAS,the City and District,entered into that certain Interlocal Agreement identified as City Secretary Contract No. 37987 (the "Agreement") for a term of five (5) years beginning November 25,2008 allowing the City to co-locate its communication equipment on the District's radio tower located on the Eagle Mountain Balancing Reservoir site for the purposes of facilitating provision of water service to its customers;and WHEREAS,on March 12, 2014,the City and District entered into that certain Extension and Amendment to Interlocal Agreement (City Secretary Contract No. 37987) with the Tarrant Regional Water District for the Use of and Modification of a Radio Tower(the"Amendment"), amending certain terms of the Agreement and extending the term for an additional five(5)years; and WHEREAS,the parties wish to extend and amend the Agreement,as amended. NOW,THEREFORE,for and in consideration of the mutual covenants contained herein, and other good and valuable consideration, the receipt and sufficiency of which are hereby acknowledged and confessed,the parties hereto agree as follows: I. Term: The term of the Agreement shall be renewed and extended an additional five (5) years,to terminate on November 25,2023,pursuant to Section 2 of the Agreement. II. Other Terms and Conditions. All other terms and conditions of the Agreement, as amended, remain in full force and effect, including, but not limited to,those provisions relating to installation,operation and maintenance of the communication equipment and access to the radio tower. Adopt the attached supplemental appropriation ordinance increasing appropriations in the Water and Sewer Fund by$35,000.00 and decreasing the unreserved,undesignated fund balance by the same,and 2. Authorize the City Manager to execute an interlocal agreement for use of and modification of a radio tower owned and operated by Tarrant Regional Water District not to exceed$35,000.00. DlscusstoN: The Tarrant Regional Water District(TRWD)intends to build a radio tower on the balancing reservoir tower located adjacent to the Westland Water tank and pump station. The proposed tower which will be located due west of downtown will be approximately 1-1.5 miles from the proposed site for the CFW Water Department's West/Norlhwest water treatment membrane plant. The Water Department is asking TRWD to modify the structure to accommodate communication equipment. The Water Department will derive substantial benefits with regards to the proposed radio tower since the location will allow the Department to gain a communication advantage by ensuring the availability of high speed communication at the proposed plant. Currently,our local phone carrier can not guarantee the ability to supply this necessary service to the anticipated facility. With the tower,the future plant will have the ability to have high speed communications capabilities which will allow for the use of security technology, monitoring of the plant for distribution purposes and the potential to provide personnel offices. In addition, the availability of high speed communications would allow this location to be designated as a backup location for mission critical applications. The tower also offers the department higher degrees of area coverage for future mobile technology implementations. The agreement will outline the terms and conditions to construct and maintain the radio tower.The cost to share the facility and tower shall not exceed$35,000.If the Water Department was to construct a tower,the cost would be ten times the shared cost at approximately$300,000. http://apps.cfwnet.orgteouncil_packet/Reports/mcLprint.asp 11/21/200$ Page 2 of 2 FISCAL INFORMATIONlCERTIFICATION: The Finance Director certifies that upon approval of the above recommendation and adoption of the attached supplemental appropriation ordinance, funds will be available in the current operating budget, as appropriated,of the Water and Sewer Fund.
