HomeMy WebLinkAboutOrdinance 19933-10-2011Ordinance No. 19933-10-2011 AN ORDINANCE INCREASING THE ESTIMATED RECEIPTS AND APPROPRIATIONS IN THE GRANTS FUND IN THE AMOUNT OF $700,000.00, SUBJECT TO RECEIPT OF FUNDS FROM THE UNITED STATES DEPARTMENT OF HOUSING AND URBAN DEVELOPMENT, FOR THE PURPOSE OF FUNDING THE FAIR HOUSING ASSISTANCE PROGRAM FOR FISCAL YEAR 2012; PROVIDING FOR A SEVERABILITY CLAUSE; MAKING THIS ORDINANCE CUMULATIVE OF PRIOR ORDINANCES; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. That in addition to those amounts allocated to the various City departments for Fiscal Year 2011 -2012 in the Budget of the City Manager, there shall also be increased estimated receipts and appropriations in the Grants Fund in the amount of $700,000.00, subject to receipt of funds from the United States Department of Housing and Urban Development, for the purpose of funding the Fair Housing Assistance Program for Fiscal Year 2012. SECTION 2. That should any portion, section or part of a section of this ordinance be declared invalid, inoperative or void for any reason by a court of competent jurisdiction, such decision, opinion or judgment shall in no way impair the remaining portions, sections, or parts of sections of this ordinance, which said remaining provisions shall be and remain in full force and effect. SECTION 3. That this ordinance shall be cumulative of Ordinance No. 19911 and all other ordinances and appropriations amending the same except in those instances where the provisions of this ordinance are in direct conflict with such other ordinances and appropriations, in which instance said conflicting provisions of said prior ordinances and appropriations are hereby expressly repealed. Authorize the City Manager to execute, and ratify the execution on September 30, 2011 of, a Fair Housing Assistance Program Cooperative Agreement through the Fort Worth Human Relations Commission with the United States Department of Housing and Urban Development for Fiscal Year 2012 and accept funds in an amount up to $700,000.00, for a contractual award of $670,977.00 plus current and future accrued interest from contractual award funds in an amount up to $29,023.00; and 2. Adopt the attached appropriation ordinance increasing estimated receipts and appropriations in the Grants Fund by an amount up to $700,000.00. DISCUSSION: In order to appropriately obligate the funds called for in the Cooperative Agreement, the United States Department of Housing and Urban Development (HUD) has informed the Fort Worth Human Relations Commission (HRC) that the Cooperative Agreement should be signed and dated no later than September 30, 2011, because of the federal government's fiscal year. The first regular meeting of the HRC at which the HRC could consider and recommend the approval of this Cooperative Agreement was on September 27, 2011. On September 27, 2011, the Fort Worth Human Relations Commission voted to recommend the approval of the Fair Housing Assistance Program (FHAP) Cooperative Agreement with(HUD). Pursuant to a Cooperative Agreement, HUD will provide funding to the Fort Worth Human Relations Commission, a designated FHAP, based on the number of fair housing complaints resolved from July 1, 2010 to June 30, 2011. The Human Relations Unit staff, on behalf of the Fort Worth Human Relations Commission, resolved 208 complaints during this time period. Additional funds are awarded to qualifying FHAP agencies for administrative costs and training. The Cooperative Agreement provides payment for the following: a. Resolution of housing discrimination complaints in the amount up to $540,680.00; b. Administrative costs in the amount of $111,297.00 (20 percent of the Fiscal Year 2011 Agreement); c.
