WHEREAS, the City of Fort Worth (CITY) and Transystems Corporation
Consultants (ENGINEER) made and entered into City Secretary Contract No.
35341, (the CONTRACT) which was authorized by the City Council by M&C C-
22140 on the 29th day of May, 2007; and subsequently revised by Amendment
Number 1 which was authorized by the City on the 1st day of October,
2007;
WHEREAS, the Contract involves engineering services for the following
project:
Hemphill. Street Connection from Vickery Boulevard to Lancaster Avenue;
WHEREAS, it has become necessary to execute Amendment No. 2 to said
Contract to include a revised scope of work;
NOW THEREFORE, CITY and ENGINEER, acting herein by and through their
duly authorized representatives, enter into the following agreement,
which amends the Contract:

Article I of the Contract is amended to include the revised scope of
engineering services specified in the proposal letter dated March 30,
2009, copies of which are attached hereto and incorporated herein. The
cost to City for the additional design services to be performed by
Engineer total $178,000 . 00 .
2 .
Article II of the Contract is amended to provide for an increase in
the maximum fee to be paid to Engineer for all work and services
performed under the Contract, as amended, so that the total fee paid by
the City for all work and services shall not exceed the sum of
$945,476 . 00 . -- --

All other provisions of the Contract, which are not expressly amended
herein, shall remain in full force and effect.

Amendment Request
Design of a Single Track Passenger Rail Bridge Lump Sum $75,000
1. Bridge Alternatives-TranSystems will evaluate alternatives that will include: 1)
extending the City's proposed Bridge structure to accommodate an additional railroad
track and 2) constructing a separate bridge that will accommodate one future railroad
track.
2. Bridge Design -The scope of Bridge design is based on the following;
a. TranSystems will design this additional bridge based on horizontal and vertical
track geometries that are supplied by URS on behalf of The T.
b. Currently it is assumed that this additional bridge will be completely inside
Union Pacific Railroad property and will not require additional right-of-way.
Any additional right-of-way acquisition is not anticipated in this scope.
c. The design of this bridge will be in accordance to ARE MA and Union Pacific
Railroad design guidelines.
3. Track Design - TranSystems will revise the City's current proposed track and
construction sequencing plan to accommodate this additional passenger rail bridge.
4. Permitting -TranSystems will coordinate the design of this additional bridge, including
submittals and permitting, through the Union Pacific Railroad. All permitting and
review fees will be paid directly by the City or The T.
5. Construction Docum ents -TranSystems proposes the following considerations
relating to the contract documents,
a. The City and The T projects will be included in one set of plans and
specifications that will be bid together.
b. The bid process will follow the City of Ft. Worth's normal competitive bid
process.
c. The proposal section of the contract documents will be partitioned such that
the construction pay items related to The T bridge will be separately itemized
with its own subtotal.
6. Opinions of Probable Costs - as design progresses through 30, 60 and 90 percent
completion, updated Opinions of Probable Costs will be submitted.
Construction Assistance (The T bridge) Lump Sum $10,000
1. Bidding Assistance
a. TranSystems will assist the CITY during bid phase including preparation and
delivery of addenda to plan holders and responses to questions submitted to
the prospective bidders.
b. Engineer shall attend the scheduled pre-bid conference.
c. TranSystems will assist in reviewing the bids for completeness and accuracy.
d. TranSystems will attend the project bid opening.
2. Construction Related Assistance
a. TranSystems will review shop drawings that have been submitted to the City.
These drawings will be reviewed and returned to the City with comments for
the contractor to address.
b. TranSystems will make occasional visits to the site as may be requested.
The T Bridge Sub-Total $85,000
Additional Engineering Services:
Aesthetic Enhancements Lump Sum $69,000
1. Landscape design— preparation of landscaping design alternatives. Design will
include public involvement with stakeholders, Park Dept. and Public Artist. Final
planting plans and specifications will be prepared based on Public Art coordination.

2. Irrigation design —final plans and specifications will be prepared to irrigate proposed
landscaping.(8K)
3. Green Retaining Wall Design—coordinate with Public Artist and Landscape Architect
to design a modular retaining wall system that will accommodate plantings. (10K)
4. Enhanced Lighting design—In addition to safety lighting which is already included in
the base contract, this work will include working with the Public Artist to add accent
lighting and enhanced Iight ornamentation to the project. (15K)
5. Coordination and Integration of Public Art (15K)
a. TranSystems will create clear zone rendering, elevations and profiles for the artist
to use in conceptualizing and presenting art. (21K)
b. TranSystems will attend all FWPA meetings and presentations relating to proposed
art. (2K)
c. TranSystems will meet with artist to evaluate various art proposals to determine
feasibility. (2K)
d. TranSystems will assist artist in obtaining necessary permit/approval from TxDOT
(1 K)
e. TranSystems will work with artist to identify art locations, provide infrastructure to
accommodate art installation and work with artist to include specifications that will
inform roadway contractor on art related construction features. (8K)
Public Involvement Lump Sum$10,000
1. Presentations and outreach to Downtown Ft. Worth, Inc, Fort Worth South, ICARE,
Cleopatra Investments, Steve Nichols, TxDOT, Fort Worth Public Art, Historic Ft.
Worth, Ron Investments, and The T. (6K)
2. Meetings with Cleopatra Investments and City concerning various site plans,
engineering firms and architectural firms. (2K)
3. Review of Site plans and traffic impact studies for T&P Warehouse developm ent. (2K)
T&P Warehouse Improvement Lump Sum $4,000
1. Acel/Decel lane design —design of acceleration/deceleration lane on east side of the
HL Connector adj acent to the T&P Warehouse development. This design will be
coordinated with the owners and their engineers. (2K)
2. Driveway and Retaining coordination -design of retaining wall on east side of the HL
Connector adjacent to the T&P Warehouse development will be coordinated with the
owners and their engineers. It is anticipated that a driveway will be constructed by the
owner at a future date after the HL Connector is constructed. Therefore the retaining
wall design will be coordinated with the owner to determine how the wall will be
constructed such that the owner can remove and replace a designated section of the
wall when their development occurs. (2 K)
Off-Site Drainage Desig n Lump Sum $10,000
1. Survey
a. Topographic— perform approximately 1000' of off-site topographic surveys along
proposed alignment to connect into TxD OT culvert(2K)
b. Easement Document--preparation of legal description and exhibit for off-site
storm drain construction. (1 K)
2. Design— preparation of plan profile sheets for off-site drainage outfall design.
Coordination with TxDOT and adjacent property owner for approvals.(7K)
Additional Engineering Services Sub-Total $93,000

SUBJECT: Authorize Amendment No. 2 in the Amount of$178,000.00 to City Secretary Contract No.
35341 an Engineering Services Agreement with TranSystems Corporation Consultants
for the Hemphill Street Connection from Vickery Boulevard to Lancaster Avenue
RECOMMENDATION:
It is recommended that the City Council authorize the City Manager to execute Amendment No. 2 in
the amount of$178,000.00 to City Secretary Contract No. 35341 an Engineering Services Agreement
with TranSystems Corporation Consultants for the design of the Hemphill Street Connection from
Vickery Boulevard to Lancaster Avenue for a total contract cost of$945,476.00.
DISCUSSION:
Amendment No. 2 to the Engineering Services Agreement(Agreement) is needed for the following
additional design services:
A new single-track passenger railroad bridge over proposed Hemphill Street for a design fee of
$85,000.00. On August 18, 2009, (M&C C-23719) the City Council authorized the City Manager to
execute an Interlocal Agreement with The Fort Worth Transportation Authority (The T) under which
The T will pay the City of Fort Worth $85,000.40 for the design of the new commuter rail bridge for
the Southwest to Northeast Railway crossing of the future Hemphill Street Connection from Vickery
Boulevard to Lancaster Avenue and adopted Appropriation Ordinance No. 18758-08-2009
increasing estimated receipts and appropriations in the Street Improvements Fund by $85,000.00;
Aesthetic enhancements for landscaping and irrigation, modular retaining walls to accommodate
landscaping and enhanced lighting and ornamentation in coordination with Fort Worth Public Art's
design contract for a design fee of $69,000.00;
Additional public involvement with Downtown Fort Worth, Inc., Fort Worth South, Inc., the Texas
Department of Transportation (TXDOT), Fort Worth Public Art and coordination with adjacent
property owners for a design fee of $14,000.00; and
Storm drain outfall connection to the existing system located outside of the original project limits
for a design fee of$10,000.00.
HISTORY:
The 2004 Capital Improvement Program (CIP)approved $9,705,000.00 for the design and construction
of this project as a four lane divided roadway under Interstate Highway 30 and the Union Pacific
Railroad Tracks.
On May 29, 2007, (M&C C-22140) the City Council authorized the City Manager to execute
Engineering Services Contract No. 35341 with TranSystems Corporation Consultants in the amount of
$767,476.00 for the final design of Hemphill Street Connection from Vickery Boulevard to Lancaster
Avenue four lane divided arterial street.
On October 1, 2007, the City administratively authorized Amendment No. 1 with TranSystems
Corporation Consultants for the final design of Hemphill Street Connection from Vickery Boulevard to

Lancaster Avenue. There was no cost for this revised scope of work.
TranSystems Corporation Consultants proposes to complete the final design plans and specifications
for a lump sum fee of$178,000.00. City Staff considers this fee to be fair and reasonable for the scope
of services to be performed.
TranSystems Corporation Consultants is in compliance with the City's MlWBE Ordinance by achieving
16 percent MIWBE participation on this project. The City's MWBE goal is 16 percent.
This project is located in COUNCIL DISTRICTS 8 and 9, Mapsco 76D and 76H.
FISCAL INFORMATIONXERTIFICATION:
The Financial Management Services Director certifies that funds are available in the current capital
budget, as appropriated, of the Street Improvement Fund.
