WHEREAS, the City of Fort Worth (City) and HDR, Inc. , (Engineer)
made and entered into City Secretary Contract No. 35348, (the Contract)
which was authorized by the City Council by M&C C-35348 on the 21st day
of June, 2007; and
WHEREAS, the Contract involves engineering services for the
following project:
Mercado Channel Improvements, Project No. 00779: DOE No. 5682
WHEREAS, it has become necessary to execute Amendment No. 1 to
said Contract to include an increased scope of work and revised maximum
fee;
NOW THEREFORE, City and Engineer, acting herein by and through
their duly authorized representatives, enter into the following
agreement which amends the Contract:
1.
Article 1, of the Contract is amended to include the additional
engineering services specified in a proposal letter dated May 7, 2009,
copies of which are both attached hereto and incorporated herein. The
cost to City for the additional services to be performed by Engineer
total $ 24,605.00.
2.
Article II, of the Contract is amended to provide for an increase
in the maximum fee to be paid to Engineer for all work and
services performed under the Contract, as amended, so that the
total fee paid by the City for all work and services shall not
exceed the sum of $ 79,465.00.

All other provisions of the Contract which are not expressly

Storm Water Utility Projects-Mercado Channel
City Project Number 00779
Dear Ms. Young:
On June 21, 2007 the City of Fort Worth authorized HDR to provide a hydrologic
and hydraulic study of Mercado Channel. The original scope included a study of
Mercado Creek beginning at its confluence with Marine Creek. The scope included
the establishment of a hydrologic and hydraulic model of the channel based on
current or existing conditions. Upon completion of the model, the scope provided
for a report which would outline three alternative designs that would mitigate the
known flooding in the area. The original scope did not include models of the
proposed alternatives, the new box culverts installed at NE 21't and 22"d Street,
nor FEMA CLOMRILOMR applications or USACE environmental permitting.
A report was submitted to the City in accordance with the original scope and a final
review meeting was held on August 11, 2008 to discuss the recommendations. In
attendance at this meeting were: Mike Owens - CFW, Steve Eubanks - CFW,
Richard Argomaniz — CFW, Kathy Berek — HDR, and Rodrigo Vizcaino — HDR.
The City requested the contract be amended to include the proposed detention
pond upstream [data to be provided by the City], the new box culverts at NE 2151
and 22"0, and three design alternatives as directed by Steve Eubanks. In response,
this request for an amendment seeks to revise the scope of work of the previously
approved Storm Water Utility Projects, City Secretary Contract No. 00779 Design
Pians and Contract Documents. The work to be included will augment the channel
improvement evaluations and the designs associated with the original contract.
The specific works to be included in this amendment are as follows:
Determine maximum flows assuming detention upstream of the study area on
Marine Park to avoid overland flooding beyond the top of banks. The
conceptual data related to this pond will be provided by the City. It is assumed,
per Mr. Steve Eubanks' direction, that the design of an adequate detention
basin to match these calculated flows will be conducted at a later date.

• A maximum of 3 conceptual alternatives intended to resolve the flooding and
overtopping shown in the conceptual flood study report of existing conditions
submitted in November, 2007 will be modeled and evaluated. These
alternatives will include a natural or bio-engineered channel, a flexible
pavement channel, and/or a gabion lined channel. Each alternative may
incorporate the following:
o Conceptual design layout of channel areas to be improved.
o Hydraulic modeling with gabion lining at areas of improvement.
o Hydraulic modeling with grass lined stream bed, stabilized bank vegetation
and bio-engineered to enhance sustainability.
❑ Modeling with flexible pavement lining at areas for improvement.
o Document results and meet with the City to discuss the best alternative.
• Model and Upgrade boxes at 21st and 22n4 Streets as directed by Mr. Steve
Eubanks.
o Determine necessary culvert box size to avoid overtopping of street
assuming detained flows as mentioned in the first bullet point of this
document.
Schedule
HDR assumes that it will take approximately six to seven weeks to prepare and
submit the technical report and exhibits associated with this drainage study.
Deliverables
➢ HDR will provide the City with a detailed report and exhibits for their review.
Key Understanding
Proper project management will allow for good communication during the project
and promote the integration of teamwork between client, contractor and consultant.
This scope of work is for study purposes only and does not include any design or
construction fees. A scope and fee proposal will need to follow this study.
Fee Estimate
HDR is proposing to complete services and deliverables outlined above for a lump
sum fee of $24,605.00. This fee does not include any additional City review fees
and/or any additional surveying fees. Invoices will be sent monthly and will be
based on a percent complete of the lump sum fee.

HDR's fees for the aforementioned services are itemized below:
Conceptual layout of design alternatives = $ 4,925.00
Hydraulic modeling of 3 different alternatives = $ 13,015.00
Analysis and documentation of results and City meetings = $ 6,215.00
Expenses = $ 450.00
Total Contract Amendment No. 1 Value: = $ 24,605.00
