AN ORDINANCE INCREASING THE ESTIMATED RECEIPTS AND
APPROPRIATIONS IN THE RENTAL REHABILITATION PROGRAM FUND IN THE
AMOUNT OF $300,000.00, FROM AVAILABLE FUNDS, FOR THE PURPOSE OF
PAYING THE UNITED STATES DEPARTMENT OF HOUSING AND URBAN
DEVELOPMENT TO CLOSE FINDINGS REGARDING THE USE OF COMMUNITY
DEVELOPMENT BLOCK GRANT FUNDS; PROVIDING FOR A SEVERABILITY
CLAUSE; MAKING THIS ORDINANCE CUMULATIVE OF PRIOR ORDINANCES;
REPEALING ALL ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING AN
EFFECTIVE DATE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH,
TEXAS:
SECTION 1.
That in addition to those amounts allocated to the various City departments for Fiscal Year 2011 -2012 in the
Budget of the City Manager, there shall also be increased estimated receipts and appropriations in the Rental
Rehabilitation Program Fund in the amount of $300,000.00, from available funds, for the purpose of paying
the United States Department of Housing and Urban Development to close findings regarding the use of
Community Development Block Grant funds.
SECTION 2.
That should any portion, section or part of a section of this ordinance be declared invalid, inoperative or
void for any reason by a court of competent jurisdiction, such decision, opinion or judgment shall in no way
impair the remaining portions, sections, or parts of sections of this ordinance, which said remaining
provisions shall be and remain in full force and effect.
SECTION 3.
That this ordinance shall be cumulative of Ordinance No. 19911 and all other ordinances and appropriations
amending the same except in those instances where the provisions of this ordinance are in direct conflict
with such other ordinances and appropriations, in which instance said conflicting provisions of said prior
ordinances and appropriations are hereby expressly repealed.
SECTION 4.
This ordinance shall take effect upon adoption.

SUBJECT:
Authorize Payment of Up to $300,000.00 from the Rental Rehabilitation Program Fund to the United States
Department of Housing and Urban Development to Close Findings Regarding the Use of Community
Development Block Grant Funds and Adopt Appropriation Ordinance (ALL COUNCIL DISTRICTS)
RECOMMENDATION:
It is recommended that the City Council:
1. Authorize payment of up to $300,000.00 from the Rental Rehabilitation Program Fund to the United
States Department of Housing and Urban Development to close findings regarding the use of Community
Development Block Grant funds; and
2. Adopt the attached appropriation ordinance increasing estimated receipts and appropriations in the
Rental Rehabilitation Program Fund by $300,000.00 from income currently available in the fund.
DISCUSSION:
The Housing and Economic Development Department (HEDD) has been working to close older
Community Development Block Grant (CDBG) projects and activities in an effort to resolve issues outlined
in monitoring reviews by the United States Department of Housing and Urban Development (HUD). These
efforts have resulted in HEDD closing out several open activities dating back to 1992. The department
was notified by HUD in September that the City needs to immediately complete and close the remaining
CDBG- funded projects from 1992 -2005.
It is expected that some of these activities will lack documentation that meets CDBG requirements.
Because of the need to respond to HUD in a timely fashion, Staff recommends that Council authorize the
use of up to $300,000.00 of income generated by the Rental Rehabilitation Program Fund for repayment
to HUD for any CDBG housing - related project that cannot be closed in compliance with HUD regulations.
FISCAL INFORMATION / CERTIFICATION:
The Financial Management Services Director certifies that upon approval of the above recommendations
and adoption of the attached appropriation ordinance, funds will be available in the current Operating
Budget, as appropriated, of the Rental Rehabilitation Program Fund.
