HomeMy WebLinkAboutOrdinance 19968-11-2011Ordinance No. 19968-11-2011 AN ORDINANCE INCREASING THE ESTIMATED RECEIPTS AND APPROPRIATIONS IN THE PARK DEDICATION FEES FUND IN THE AMOUNT OF $139,903.00, FROM AVAILABLE FUNDS, FOR THE PURPOSE OF TRANSFERRING SAID FUNDS TO THE GENERAL FUND TO OFFSET OPERATION AND OVERSIGHT COSTS ASSOCIATED WITH MANAGEMENT OF THE NEIGHBORHOOD AND COMMUNITY PARK DEDICATION POLICY; PROVIDING FOR A SEVERABILITY CLAUSE; MAKING THIS ORDINANCE CUMULATIVE OF PRIOR ORDINANCES; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. That in addition to those amounts allocated to the various City departments for Fiscal Year 2011 -2012 in the Budget of the City Manager, there shall also be increased estimated receipts and appropriations in the Park Dedication Fees Fund in the amount of $139,903.00, from available funds, for the purpose of transferring said funds to the General Fund to offset operation and oversight costs associated with management of the Neighborhood and Community Park Dedication Policy. SECTION 2. That should any portion, section or part of a section of this ordinance be declared invalid, inoperative or void for any reason by a court of competent jurisdiction, such decision, opinion or judgment shall in no way impair the remaining portions, sections, or parts of sections of this ordinance, which said remaining provisions shall be and remain in full force and effect. SECTION 3. That this ordinance shall be cumulative of Ordinance No. 19911 and all other ordinances and appropriations amending the same except in those instances where the provisions of this ordinance are in direct conflict with such other ordinances and appropriations, in which instance said conflicting provisions of said prior ordinances and appropriations are hereby expressly repealed. SECTION 4. This ordinance shall take effect upon adoption. Adopt the attached appropriation ordinance increasing estimated receipts and appropriations in the Park Dedication Fees Fund by $139,903.00 from available funds; and 2. Authorize the transfer of $139,903.00 from the Park Dedication Fees Fund to the General Fund to offset operation and oversight costs associated with management of the Neighborhood and Community Park Dedication Policy. DISCUSSION: The purpose of this Mayor and Council Communication (M &C) is to authorize the transfer of funds from the Park Dedication Fees Fund to the General Fund to offset the costs related to the management of the Neighborhood and Community Park Dedication Policy (Policy). The Policy ensures the provision of adequate park and recreational areas with needed facilities in the form of neighborhood and community parks to serve population increases resulting from the addition of new residential units in the City. Park development fees and fees that are paid in lieu of making land dedications are placed in an interest bearing account and are used to achieve the Policy's objectives. Beginning with the Fiscal Year 2010 Adopted Budget, costs for program oversight and operation were eliminated from the General Fund. Correspondingly these costs were identified for payment from interest income on fees collected. Expenses associated with the operation and management of the program includes salary and benefits of the Parks and Community Services Department employees that run the program. Since 2000 when the current Policy was established, 1,053 acres and 47 new parks have been added to the park system through this Policy. Since 2006, Staff has inspected and accepted 35 new parks and continues to monitor the progress of approximately 35 future parks. This program serves ALL COUNCIL DISTRICTS.
